§ 1

Notice no. 1301 of 17. December 2012 on the import of plants and plant products, and so on, is amended as follows :

1. Foot notation the title of the notice shall be replaced by the following :

33.2. Live pollen and plants intended for planting, excluding seeds, of Actinidia Lindl.
An official statement that
1. Lean the pollen and plants must be accompanied by a phytosanitary certificate, cf. Article 13 (1). 1, no. (ii) the first subparagraph of Directive 2000 /29/EC (hereinafter referred to as ' the certificate `), which, in the ' Declaration of ' declaration, shall contain the information referred to in paragraphs 2 and 3.
2. The certificate must include the information that the conditions of one of the following litras are met :
(a) that the plants throughout their lifetime have been grown only in a country where : Pseudomonas syringae pv. actinidiae Takikawa, Serizawa, Ichikawa, Tsuyumu & Goto not vides to occur or
b) that the plants have been cultivated throughout their lifetime in a harmful area determined as regards the harmful organisms of the country of origin of the country of origin in accordance with the FAO International Standard for the country of origin ; Phytosanitary Measures (ISPM) No 4
or
c) the plants have been produced on a peddling-free (t) place of production / location, determined by the national plant health authority in the country of origin in accordance with the FAO's ISPM No 2 ; Ten, the plants have been cultivated in a system with a certain degree of insulation and protection against the surrounding environment which effectively keeps the harmful organisms out. The plants have been officially inspected twice at the most appropriate times in order to detect symptoms of infection in the last, completed growth period prior to export and was found free from the harmful organism.
The production site is surrounded by a zone with a radius of at least 500 m where official inspections have been carried out twice at the most appropriate times in order to detect the symptoms of infection during the last period completed during the period of growth ; prior to export and all plants showing signs of infection found during these inspections, and all adjacent plants within five metres of a distance of 5 m have been destroyed without delay ;
or
d) that the plants are produced in a harmful place of production, determined by the national plant health authority in the country of origin, in accordance with the FAO's ISPM No 2 ; 10.
The production site is surrounded by a zone with a radius of 4500 m. Official controls, sampling and testing at the place of production and throughout the relevant zone are twice at the most appropriate times in order to detect the symptoms of infection during the last period completed during the period of time ; for export. The damage to the injury shall not be found under official control, sampling and laboratory tests.
2. In addition, if information is provided as referred to in point 2 (c) or (d), the certificate must include the information that the conditions of one of the following litras are met :
(a) The plants are drawn directly from maternal plants grown under conditions which satisfy the requirements of point 2 (a), (b) or (c).
(b) The plants are drawn directly from maternal plants subject to prior individual laboratory tests, which have confirmed that they are free of the harmful organisms.
c) The plants have been tested according to a sampling method which allows 99% security to confirm that the presence of the harmful organisms is less than 0,1%.
4. If information is provided as referred to in point 2 (b), the name of the harmful area of the free movement in the box ' Place of origin ` shall be indicated in the certificate.
