Annuntation of fishing vessels by satellite

In accordance with section 10 (4), 1 and 2, section 124 (4). Paragraph 1 and Article 130 (1). 2, in the case of fisheries and fish farming (fisheries law), cf. Law Order no. 978 of 26. September 2008, as amended by law no. 604 of 14. June 2011, and after authorisation, shall be :

Definitions and applications

§ 1. For the purposes of this notice :

1) Vesssurveillance system (FOS) : The overall system for reception and treatment of a vessel's position report is the overall system for the vessel ' s operating system.

2) Vesssurveillance unit (FOE) : The electronic equipment on board a fishing vessel, that is, power supply, transceiver and antenna, sending reports to the FOS.

3) Fisheries Monitoring Centre (FMC) : The Monitoring Centre of the Natural Acquisius.

4) Inmarsat number, DNID and member No : Unique identification of vessel's FOE.

§ 2. The announcement shall apply to the Danish registered fishing vessels, which have a length of 12 metres long and more.

Paragraph 2. The announcement shall also apply to vessels less than 12 metres, whose authorisation to fish in or permeate an area with special fishing constraints requires it.

§ 3. A vessel shall not be allowed to leave port unless the National Services Agency has been informed of Inmartified number, DNID and Member No in the FOE of the vessel and the ship ' s FOE to the FOS function is functioning.

Paragraph 2. The DNID and Member No may only be installed in a FOE.

Paragraph 3. If a FOE is deleted because the vessel owner is replacing the existing FOE, or because the vessel is deleted as registered fishing vessels, the vessel owner shall inform the FDA of Inmarned identification number, DNID and Member No for the FOE.

§ 4. A FOE must at least once per hour transmit correct positioning messages containing : the identity, position, course and speed of the vessel and the time for measurement of such measurement.

Paragraph 2. The FOE of the vessel must send the status codes that the FOE system automatically generates by interruptions of normal transmission.

Paragraph 3. Vessels fishing in or passing through a fishing area in which special rules apply to the fishing activity may be required to transmit position messages with a shorter range of transmissions than the one in paragraph 1. One mentioned.

Paragraph 4. The coordinates of the fishing areas covered by paragraph 1. 3 will be reported by the Natural Business Authority on request. The vessel owner is responsible for updating and programing FOE.

Paragraph 5. In addition to the vessel ' s own DNID and Member No, the DNID and Member Member of the Natural Acquisition shall be installed on the vessel ' s FOE, with a view to obtaining current position communications from the vessel ("polling") at all times.

Technical malfunction or function failure

§ 5. The vessel must ensure that the ship ' s FOE is always functional, and that the data referred to in section 4 shall be transferred to the FOS.

Paragraph 2. The tramp must also ensure that,

1) data is not changed in any way ;

2) FOE's antenna is not in any way obstructing, detached or blocked ;

3) the power supply to FOE is not interrupted in any way, and

4) The FOE shall not be dismantled without the consent of the Office of the Natural Safety Agency.

§ 6. It shall be prohibited to embaron on a fishing journey or take part in any form of fishing, including fishing, joint fishing, and transhipments if the FOE of the vessel is not working. From the date on which the master or his representative finds or informed that the FOE is not working, the person concerned shall :

1) The fishing is immediately suspended.

2) All tools are immediately taken on board.

3) The vessel shall be sailed in port with a view to the repair of FOE.

4) The FMC immediately informed that the FOE is not working, cf. Annex 1.

Paragraph 2. Notwithstanding paragraph 1 1, the FMC may allow the passage to be completed before leaving the vessel in port if this is not considered to be a control risk.

Paragraph 3. From the point of paragraph 1. the time limit for the entry into port of 1 and the time of arrival at port shall be the same time interval as specified in Section 4 (2). 1. The messages shall be issued in accordance with the requirements set out in Annex 1.

Paragraph 4. Depositioning of positioning messages, cf. paragraph 3, shall continue until the FMC has given a clear message to the master of the vessel that the FOE function is working again.

§ 7. The master of the vessel shall ensure that on board the vessel is sound to the international emergency and call frequencies, (VHF, medium-wave, digital selective invocation) and on the mobile and satellite-based communications from sea to craft, if the vessel is equipped with the FMC to inform the master of errors in FOE which FMC has established on the basis of external or inadequate positioning reports.

§ 8. The vessel owner or master shall inform the FMC prior to the decommissioning of the vessel or shipyards in the event that this activity involves the termination of the positioning transmissions from the FOOT of the vessel. Notification shall be carried out when sending a message to the FMC in accordance with Annex 1 prior to the outage of the positioning transmission.

Paragraph 2. In the event of a resumption of normal activity, the vessel owner must, before the end of the last dispatched position, send a positioning position, cf. Annex 1, with the indication that the vessel is back in normal activity. A vessel has a duty to ensure that the pre-clothing has not been declared passive when a fishing voyage is started.

§ 9. A vessel owner may, by notification of the FMC, be authorised to send with a less frequent frequency than set forth in section 4 (2). 1.

Paragraph 2. That is a condition for the one in paragraph 1. 1 the approval of the vessel ' s owner prior to the FMC shall be as follows :

1) the FOE equipment used is installed, programmed and works as listed by the Natural Business Authority,

2) there is a function in FOE, which limits the port area geographically ; and

3) reduced frequency frequency in an automatic process in FOE without any possibility of a manual effect of the process that is part of the automatic system.

Paragraph 3. If the terms of the permit are not complied with, the National Services Board may withdraw this.

Expenditures of expenditure

§ 10. All purchases, installation, transmission, repair, and operation will be borne by the vessel owner.

Paragraph 2. Transmission costs for the collection of the items in section 4 (4). The current position of the vessels shall be borne by the Office of the Natural Business Authority (5).

Penalty provisions

§ 11. The penalty shall be penalised by the penalty which violates or attempts to violate § 3, section 4 (4). 1, 2 and 5, section 5, section 6 (4). One, three, and four, and section 7 and 8.

Paragraph 2. Companies can be imposed on companies, etc. (legal persons) punishable by the rules of the penal code 5. Chapter.

Entry into force

§ 12. The announcement shall enter into force on 1. December 2012.

Paragraph 2. Publication no. 902 of 28. September 2009 on the monitoring of fishing vessels via satellite is lifted.

Appendix 1

Submission of communications failure (Section 6) and ship-building (§ 8)

Operation failure report (§ 6)

1) In the event of failure, cf. section 6, the master of the vessel shall send a position of positioning in the manner and with the content specified in paragraphs 2 and 3 to the Natural Business Authority.

2) Positions must be sent by email, fax or phone.

3) Contents of positioning reports :

a) The port identification number of the vessel and the radio-call sign.

b) Position :

-Latitude (degrees and minutes), e.g. 56 o 37 ' N.
-Longitude degrees (degrees and minutes), e.g. 012 o 12 ' ISLAND.

c) Course.

d) Speed (knots).

(e) ICES/NAFO subspace.

(f) The date and time (UTC) for the position (at the time of dispatch).

Reformation of vessel (§ 8)

4) In the event of an outage of positioning transmittance, cf. § 8 (3) 1, the following shall be added to the position reports as described in paragraphs 2 and 3 :

a) Passive from start date to end date, e.g. passive 20121024 to 20121028

b) Cause, for example. shipy-hold.

Resumption of normal operation after the outage of the position reports, cf. section 8 (5). 2, the following is added : Active, starting date and time.
