Rules for technical compatibility between vehicle and rail network

Under section 21 h, paragraph 1 1. paragraph, section 21 k, (5) and (6) and section 26, paragraph 1 1. paragraph, of the law on rail, see. lovbekendtgørelse nr. 1249 of 11. November 2010, be determined in accordance with the authorisation granted pursuant to § 24 h, paragraph 1: scope



§ 1. The Decree lays down provisions on the technical compatibility requirement for vehicles to be approved to run on the Danish part of the rail network, which is the subject of a European Parliament and Council Directive 2008/57/EC of 17 May 2006. June 2008 on the interoperability of the railway system in the community, as amended (hereinafter the interoperability directive).

Definitions



§ 2. For the purposes of this order: 1) A-rule: rules of other countries or international standards, which are equivalent to the corresponding Danish requirements and is categorized as an A-rule in the national reference document, which is published on the European Railway Agency website.

2) notified bodies means the bodies which are responsible for assessing the conformity or suitability for use of interoperability constituents, as well as to implement the procedure for "EC" verification of subsystems.

3) Existing vehicle means a vehicle which is or has been in operation in Denmark or abroad.

4 Compatibility certificate: The certificate) drawn up by the notified body as evidence that vehicle type is compatible with the network.

5) Vehicle: a railway vehicle with or without traction, which on its own wheels running on a railway line. A vehicle consists of one or more structural or functional subsystems or parts of such subsystems.

6) National technical rules: The national, technical rules, as Denmark pursuant to interoperabilitetsdirektivets article 17, paragraph 3, has informed the EU Commission (also called national technical rules notified).

7) Technical compatibility: A vehicle technical compatibility with the infrastructure level. Route specific conditions are not included in the verification of technical compatibility.

8) TSI LOC & PASSPORTS: Commission decision of 26. April 2011 on a technical specification for interoperability relating to the subsystem rolling stock» Locomotives and passenger carriages ' of the trans-European conventional rail system (Official Journal 2011 No. L 139, p. 1-151), implemented by Decree No. 1190 of 12. December 2011 on the locomotives and passenger cars used on the Danish railway network.

9) TSI WAG: Commission decision of 28 June 1999. July 2006 concerning the technical specification for interoperability relating to the subsystem "rolling stock — freight wagons" of the trans-European conventional rail system (2006/861/EC) as amended.

10) outstanding points (open points): Points, where the subject is identified as important, but not included in the TSI.

11) designated bodies: the bodies tasked with assessing whether the vehicle is in accordance with notified national technical rules.

Verification procedure and technical requirements



§ 3. By issuing a compatibility certificate, a notified body referred to in article 6. § 2, nr. 11, verify a vehicle type comply with the requirements of annex 1. The body uses the following columns of annex 1:1) Is a vehicle verified after TSI LOC & PASSPORT, see. § 2, nr. 8, by a notified body, used in column 1.

2) Is a vehicle verified after TSI WAG, see. section 2, paragraph 9, of a notified body, used column 2.

3) Is a vehicle verified in accordance with Decree No. 542 of 12. June 2012 about the technical requirements for the service vehicles of a designated body referred to in article 6. § 2, nr. 11, used column 3.

4) in other cases, including the approval of existing vehicles, used column 4.

(2). In cases where a foreign approval documents the fulfillment of A-rules for a given parameter in annex 1 shall not be carried out additional checks of the parameter concerned.

(3). Compatibility certificate drawn up in accordance with the module SB, cf. Commission decision No. 2010/713/EC of 9. November 2010 on the modules to the procedures for assessment of conformity and suitability for use and for EC verification, to be used in the technical specifications for interoperability which is adopted pursuant to European Parliament and Council Directive 2008/57/EC.

(4). In cases where the technical compatibility of the basic regulation. Annex 1, must be verified for series vehicles, with supporting evidence, shall be included in the vehicle's technical dossier. It must appear separately of the verification certificate, which claims there is controlled in relation to technical compatibility.
