Appendix 1 Rules for the technical compatibility between the vehicle and the rail network

Confession of vehicle technical compatibility with the railway network 1)

In accordance with section 21 h (1) (i), ONE, ONE. pkt., section 21 k, paragraph 1. 5 and 6, and section 26 (4). ONE, ONE. pkt;, in the law of rail, cf. Law Order no. 1249 of 11. In November 2010, according to section 24 h, paragraph, shall be adopted. 1 :

Scope of application

§ 1. The notice lays down provisions on technical compatibility requirements for vehicles which are to be approved for driving on the Danish part of the rail network, covered by Directive 2008 /57/EC of the European Parliament and of the Council of 17. June 2008 on the interoperability of the railway system in the Community with subsequent amendments (hereinafter referred to as the interoperability Directive).

Definitions

§ 2. For the purposes of this notice :

1) A rule : other countries ' rules or international standards, which are equivalent to equivalent Danish requirements, which are categorized as an A-rule of the national reference document published on the European Railway Agency's website.

2) Authorised bodies : the bodies responsible for assessing the conformity or suitability for use of interoperability constituents and to carry out the EC verification procedure for the subsystems.

3) Existing vehicle : a vehicle that is or has been operating in Denmark or abroad.

4) Compatibility certificate : the certificate drawn up by the notified body as evidence of the compatibility of the vehicle type with the network.

5) vehicles : a railway vehicle with or without traction force, which on its own wheels is running on a railway line. A vehicle consists of one or more structural or functionally defined subsystems or parts of such subsystem.

6) National technical rules : the national, technical rules which Denmark, pursuant to Article 17 (3) of the interoperability Directive, are under way. 3, notified the EU Commission (also called 'notified national technical rules').

7) Technical compatibility means the technical compatibility of a vehicle with the infrastructure at the network. Route-specific conditions are not included in the verification of technical compatibility.

8) TSI LOC&PAS : Commission Decision of 26. April 2011, on a technical specification for interoperability of the rolling stock subsystem, locomotives and passenger cars ' in the trans-European conventional rail system (EU-10 2011). In 139, s. 1-151), completed by announcement No 2 ; 1190 of 12. December 2011 on locomotives and passenger carriages used on the Danish rail network.

9) TSI WAG : Decision of the Commission of 28. July 2006, on the technical specification for interoperability of the rolling stock rolling stock-wagons ' of the trans-European conventional rail system (2006/861/EC), with subsequent amendments.

10) Outstanding items (open points) : items where the topic has been identified as important but not included in a TSI.

11) Designated bodies : the bodies responsible for assessing whether the vehicle is in accordance with the notified national technical rules.

Verification procedure and technical requirements

§ 3. For the purpose of issuing a compatibility certificate, a notified body must be designated, cf. § 2, nr. 11, verify the conformity of a vehicle type with the requirements set out in Annex 1. The notified body shall use the following columns in Annex 1 :

1) Is a vehicle verified by the TSI LOC&PAS, cf. § 2, nr. 8, by a notified body, column 1 shall be used.

2) Is a vehicle verified by TSI WAG, cf. Section 2 (2). 9, by a notified body, column 2 shall be used.

3) Is a vehicle verified by the notice No? 542 of 12. June 2012 on technical requirements for the work vehicles of a designated body, cf. § 2, nr. 11, used column 3.

4) In other cases, including by approval of existing vehicles, column 4 is used.

Paragraph 2. In cases where a foreign authorisation documents the fulfilment of A rules for a given parameter in Annex 1, no further checks should be carried out on the parameter in question.

Paragraph 3. Compatibility certificate must be prepared under Module SB, cf. Commission Decision No 2010 /713/EU of 9. November 2010 on the modules for procedures for the assessment of conformity and suitability for use and for EC verification to be used in technical specifications for interoperability adopted under the European Parliament and the Council Directive 2008 /57/EC.

Paragraph 4. In those cases where the technical compatibility, cf. Annex 1 shall be verified for the purpose of verifying a series of serial vehicles to be verified for the purpose of the vehicle ' s technical file. It must be shown separately from the verification certificate, the requirements which are controlled in relation to technical compatibility.

Closure of outstanding items in TSI LOC&PAS

§ 4. The notice closes the following outstanding items in the TSI LOC&PAS, cf. Annex 1 :

1) Section 4.2.3.3.2 (monitoring of the condition of the axle tenancy).

2) Section 4.2.3.4.2 (dynamic properties during run) and 4.2.3.4.3.2 (wheelset-equivalent conicity).

3) Section 4.2.4.8.3 (braking system, independent of the adhesion conditions).

4) Section 4.2.8.2.9.4.2 (contact piece material).

5) Section 4.2.8.2.9.10 (lowering pantograph).

§ 5. The notice closes the following outstanding items in the TSI WAG, cf. Annex 1 :

1) Section 4.2.3.3.2 (sensor to overheat of axle).

2) Section 4.2.6.3 (page winds).

§ 6. The announcement shall enter into force on 1. July, 2013.

Minimum axle cargo must be 4.5 tonnes or 3,5 t if the vehicle is braked by brake pads.
