Inspection posts for control of kitchen articles of polyamide or melamine originating in or consigned from China and Hong Kong


The full text of the Ordinance concerning imports of certain plastic kitchenware originating in or consigned from China and Hongkong1)

Pursuant to § 49 paragraph 1, § 50, and section 60, paragraph 3, of the law on food, see. lovbekendtgørelse nr. 820 of 1. July 2011, fixed: scope and definitions



§ 1. The notice shall specify the special conditions and detailed procedures for the importation of plastic kitchenware of polyamide or melamine originating in or consigned from People's Republic of China and the Hong Kong Special Administrative Region, China, § 2. In this notice applies the definitions in Regulation (EU) No. 284/2011 setting out special conditions and detailed procedures for import of plastic kitchenware of polyamide and melamine originating in or consigned from People's Republic of China and the Hong Kong Special Administrative Region, China. In addition, for the purposes of: 1) "lot" means a specific quantity of a given plastic kitchen article or of sets of plastic kitchenware with a corresponding reference number or code, etc., which corresponds to the description in the accompanying document for the Declaration of the basic regulation. the annex to Regulation (EU) No. 284/2011.

2) "importer" means a person or company resident in Denmark, which introduces food contact materials, and which has received confirmation that the activity to be registered with the food Department, see. section 20 of the Ordinance No. 83 of 2. February 2011 for approval and registration of food businesses.

Points of entry and prior notification



§ 3. All consignments at importation into Denmark must enter via one of the inspection posts referred to in annex 1.

(2). The importer or their representatives must give prior notification of the arrival of each consignment to the competent authorities at the inspection post of kitchen articles introduced, see. (1). The pre-information notice shall be effected no later than the last working day (Monday to Friday) prior to the introduction, but not later than 48 hours before the estimated time of arrival.

(3). Paragraphs 1 and 2 shall also apply to products imported to Denmark via other EU-countries, but which are not released for free circulation.

Application for further transport



§ 4. Further transport of consignments after documentary check shall only be carried out after authorisation from the Food Agency.

(2). Application for permission for further transport must be Food Agency, the food Department not later than the last working day (Monday to Friday) prior to the introduction, but not later than 48 hours before the estimated time of arrival.

Control provisions



§ 5. Consignments which are illegal according to. to Regulation (EU) No. 284/2011 will be handled according to. the rules laid down in article 19 of Regulation (EC) No 1782/2003. 882/2004 on official controls for the purpose of verification of compliance with feed and food law, animal health and animal welfare rules are complied with.

Criminal provisions



§ 6. With fine punished anyone who violates sections 3-4 of this Ordinance.

(2). The penalty can rise to imprisonment for up to 2 years, if it knows the action or failure occurred violations are committed with intent or gross negligence, and there in the infringement is 1) caused damage to the health or caused danger for doing so or 2) achieved or intentional obtained a financial benefit for the person himself or others.

(3). That can be imposed on companies, etc. (legal persons) criminal liability in accordance with the provisions of the criminal code 5. Chapter.

§ 7. Unless a higher penalty is inflicted upon the rest of the law is punishable by a fine anyone who violates the following rules of Commission Regulation (EU) No. 284/2011 by 22. March 2011 setting out special conditions and detailed procedures for import of plastic kitchenware of polyamide and melamine originating in or consigned from People's Republic of China and the Hong Kong Special Administrative Region, China: 1) article 3, paragraph 1-3, 2) article 4 or 3) article 8.

Date of entry into force provisions



§ 8. The notice shall enter into force on the 20. April 2011.

(2). At the same time repealed Executive Order No. 776 of 28. June 2011 setting out special conditions and detailed procedures for import of plastic kitchen utensils of polyamide and melamine originating in or consigned from People's Republic of China and Hong Kong.

Official notes 1) Ordinance contains provisions which are necessary for the implementation of Commission Regulation (EU) No. 284/2011 by 22. March 2011 setting out special conditions and detailed procedures for import of plastic kitchenware of polyamide and melamine originating in or consigned from People's Republic of China and the Hong Kong Special Administrative Region, China, the EUROPEAN UNION official journal 2011, nr. L 77, p. 25-29. According to art. 288 TFEU applies a regulation immediately in each Member State. The issuance of this order is thus entirely justified in practical terms and shall not affect the validity of that regulation look in Denmark.
