Publication of imports of certain plastic paper products originating in or consigned from China and Hong Kong 1)

Scope and Definitions

§ 1. The notice lays down the special conditions and procedures for the importation of plastic paper articles of polyamide or melamin, originating in or consigned from the People's Republic of China and the Special Administrative Region of Hong Kong, China,

§ 2. This notice shall apply to the definitions laid down in Regulation (EC) No 2. 284/2011 laying down special conditions and procedures for the importation of polyamide and melamin imports of polyamide and melamin origin in or consigned from the People's Republic of China and the Special Administrative Region of Hong Kong, China. In addition to the following definitions :

1) ' lot ` shall mean any given number of a given plastic paper or by a reference number or code, etc., corresponding to the description of the accompanying document for the declaration, cf. the Annex to Regulation (EC) No, 284/2011.

2) ' importer ` shall mean a person or undertaking belonging to Denmark, which establishes food contact materials and has received confirmation that the activity is registered in the food department, cf. § 20 i Bekendtstatement nr. 83 of 2. February 2011, the authorisation and registration of food business operators.

Entry points and prior notification

§ 3. All consignments shall be entered through the entry into Denmark through one of the control points referred to in Annex 1.

Paragraph 2. The importer or their representatives shall notify prior notification of the arrival of each consignment to the competent authorities at the place of control where the kitchen articles are imported, cf. paragraph 1. The prior notification shall be made no later than the last working day (Monday to Friday) prior to importation, but not later than 48 hours before the expected arrival time.

Paragraph 3. Paragraph 1 and paragraph 1. 2 also applies to products imported into Denmark via other EU countries, but which have not been released for free circulation.

Application for further transport

§ 4. The transport of consignments after carrying out documentary checks may only be carried out in accordance with the authorisation of the Food Authority.

Paragraph 2. The application for a permit for further transport must be the Food and Food Safety Board, the food department of the last working day (Monday to Friday) prior to the introduction, but not later than 48 hours before the expected arrival time.

Checks

§ 5. Sendinger, that's illegal in about. to Regulation (EC) No, 284/2011 must be processed in respect of the rules laid down in Article 19 of Regulation (EC) No ; The official control of the feed and food legislation and animal health and animal welfare rules must be complied with by 882/2004 on official controls for verification.

Penalty provisions

§ 6. With fine penance, the person violating section 3-4 of this notice.

Paragraph 2. The sentence may rise to a maximum sentence for two years if it has been committed by the action or omission, with a set of or gross negligence, and there is a breach in the infringement proceedings ;

1) injury to public health or induced danger ; or

2) obtained or intended to benefit from the economic advantage of the person concerned himself or others.

Paragraph 3. Companies can be imposed on companies, etc. (legal persons) punishable by the rules of the penal code 5. Chapter.

§ 7. Unless higher penalties are imposed on the other legislation, the penalty shall be penalised by the penalty which infringes the following provisions of Commission Regulation (EC) No 2. 284/2011 of 22. March 2011 laying down special conditions and procedures for the importation of polyamide and melamin imports of polyamide and melamin originating in or consigned from the People's Republic of China and the Special Administrative Region of Hong Kong, China :

1) Article 3 (1). 1-3,

2) Article 4 or

3) Article 8.

Entry into force into force

§ 8. The announcement will enter into force on the 20th. April 2011.

Paragraph 2. At the same time, Bekendtstatement no 776 of 28. June 2011 laying down special conditions and procedures for the importation of polyamide and melamin imports of polyamide and melamin, originating in or consigned from the People's Republic of China and Hong Kong.

1) The declaration contains provisions necessary for the application of Commission Regulation (EU) No 2 ; 284/2011 of 22. March 2011 laying down special conditions and procedures for the importation of polyamide and melamin imports of polyamide and melamine originating in or consigned from the People's Republic of China and the Special Administrative Region of Hong Kong, China, EU Official Journal 2011, no. L 77, s. 25-29. -Yeah. Article 288 of the EDF Treaty is applicable to a Regulation immediately in each Member State. Therefore, the issue of such notification shall be based solely on practical considerations and shall be without prejudice to the immediate validity of the Regulation in Denmark.
