Completion of reimbursement and allowances for the carriage of passengers by means of participation in vocational training and training

In accordance with section 2 (2), 2, section 3, section 2, section 4, section 5, section Three and four, section 6, section 7, paragraph 7. 3, section 8, paragraph. 4, section 9, section 11 (4). 1, section 12, paragraph 1. 2, section 14 (4). 1, 2, and 5, section 15, section 16 (4). 3 and 4 and Section 19 (3). 5, Law No. No. 639 of 14. In June 2010 on the allowance and subsidy for carriage by means of participation in vocational training and training, as amended by law no. 573 of 7. June 2011, and after negotiations with the Minister for Employment, shall be determined :

Chapter 1

Personal circles, etc.

§ 1. People who have a real and actual employment in Denmark as a wage earners or self-employed persons may obtain compensation for the loss of income resulting from participation in training covered by Section 5 (5). 1, and subsidies for the carriage of passengers in training referred to in section 5 (5). 2.

Paragraph 2. However, in the case of employees, it is a condition for obtaining reimbursement and subsidies for the provision of a grant to the employer from receiving public services as a subsidy to the paycheck, but exempted from flexing jobs.

Paragraph 3. As employed by the second paragraph. 1 shall also be considered :

1) the person who has been discharged and commentate in the immediate extension of the termination of the employment relationship, if the person concerned and his employer have concluded an agreement on participation in training before the person concerned was made redundant and

2) persons made redundant and participating in training which extends beyond the period of termination if the training site has taken up the person concerned at the training stage before it was terminated.

§ 2. Employment in accordance with section 1 (1). 1, must take place in a natural or legal person's company or in his own company that is carried out from a business location in Denmark or in another person's private housekeeping in Denmark. Employment can only be regarded as real and, in fact, if the participant in addition to participating in the training must perform benefits or exercise activity that is normally a matter for the labour market in the company.

§ 3. It is a condition for obtaining reimbursement and support for the provision of the participation of the participant in the level of training which is higher than the level of vocational training or other training which may be treated as a person ; hereby, unless the training has not been used for the last five years, cf. Section 2 of the Act of Allowance and Allowance for the participation of professionals in the adult and after-training activities.

Paragraph 2. Persons whose training is resolved by a new equivalent training can only be reimbursed if the new level of completion training does not exceed the level of vocational training.

§ 4. In addition, it is a condition for obtaining reimbursement and subsidies for the provision of persons employed in workers who are employed in workers who are employed in the case of persons employed in the Community ;

1) have been in employment of the same employer for at least 14 days immediately prior to the commencement of the training, or

2) receive pay during training, for which, by law, notification or binding trade agreements, specific requirements are associated with the requirements.

Chapter 2

§ 5. Allowance may be obtained by participating in the following vocational training and after training :

1) labour market training and individual subjects engaged in a common competence description according to the law on labour market training and so on.

2) Individual powers of competence according to the law on labour market training and so on, and on the subject of the law on basic education and training for adult education (training).

3) Basic adult education (GVU) training to the extent that the process has been composed of labour market training is included in a joint competence description, individual competency assessment after paragraph 1. 2 and a single-class subject to vocational training (vocational training and adult education), etc., and according to the respective educational notices.

Paragraph 2. Supplements may be obtained for the participation of the following professionals in the following trainfully adult and after training :

1) labour market training and individual subjects engaged in a common competence description according to the law on labour market training and so on.

2) Individual skills assessment according to the law on labour market training and so on.

§ 6. That is a condition for obtaining compensation, except in section 5 (5). 1, no. The F5 and 6 Flow and in order to obtain grants for the provision of a grant of training in the field of open training law (vocational training and adult education) etc.

Paragraph 2. Participants in training, which are to be held as a distance education, cannot be reimbursed and subsidises to transport. For the purposes of driving distance, education means training less than 50%. the teaching is organized as an attendance study.

Chapter 3

Allowance

§ 7. As revenues after paragraph 1 (1). 1, the profit or self-employed person shall be counted as earnings.

§ 9. Allowance may be paid only at the time when the participant has participated in the teaching, cf. however, paragraph 1 2.

Paragraph 2. A participant who is entitled to compensation after this notice shall retain the right to reimbursement if the training is interrupted due to unforeseen circumstances at the training site. Allowance may, however, be paid only for the first day, the instruction has been suspended.

Chapter 4

Accession to transport

§ 10. People meeting the conditions laid down in Chapter 1 and which participate in training activities in accordance with section 5 (5). 2, may obtain grants for the carriage of goods, cf. however, paragraph 1 Six and eight.

Paragraph 2. The participant shall be entitled to a daily allowance for the daily transport between the place of residence and the educational site of the kilometres above the first 24 kilometres, but not more than 576 km per kilometre. Day. Benefits may not be obtained for daily transport if the participant is suburban during training, cf. paragraph 3.

Paragraph 3. If the participant is the subject of the training period, the participant shall be entitled to a grant for carriage at the beginning and end of training at the start of the public holidays and on weekends. The amount of the subsidy shall be paid for the distance between the resident and the educational site of the participant, but not more than 400 kilometres. per Travel.

Paragraph 7. In the case of payment of aid for the carriage of goods, the amount of the payment shall be rounded to the nearest entire crown amount.

Paragraph 8. A grant may not be obtained for the carriage of passengers if training is carried out on the company where the participant is employed, cf. § 8 (3) 2, in the case of allowances and allowances for the carriage of passengers by means of participation in business adult and training. This also applies in cases where the instruction takes place on a different section of the company other than the one where the participant is usually employed or in separate premises that the company has leased to use for the teaching.

Chapter 5

Applications for reimbursement and subsidies for the carriage of goods and so on

§ 11. The application for reimbursement and subsidies intended for transport must be submitted to the unemployment rate, the training facility or the Board of Appeal and Management Board, which, in accordance with section 16, must take a decision on repayment or subsidy for the carriage of goods.

Paragraph 2. Application for paragraph 1 1 shall be submitted no later than four weeks after the end of the training.

Paragraph 3. The unemployment rate, the training facility or the management board, to which the application is to be submitted, decide whether the application has been received in a timely manner. The decision of the unemployment rate, training, or management decision may not be brought to the second administrative authority.

§ 12. The application for reimbursement and subsidies for the carriage of goods shall be submitted by the participant, cf. however, paragraph 1 2.

Paragraph 2. When employers pay the usual salary to participants who are entitled to training, justifying reimbursement and subsidies for transport, the application for reimbursement and subsidies for the carriage of passengers shall be submitted by the employer. In other cases, employers may submit an application for reimbursement and subsidies for the carriage of power of attorney, cf. § 12, paragraph 1. 1, in the case of allowances and subsidies for the carriage of passengers by means of participation in vocational training and training.

§ 13. Applications for reimbursement and allowances for the transport of goods may be carried out either :

1) digitally via the PostTraining .dk web portal, when the training takes place at an educational place that uses the Study Administrative System EASY-A, cf. however, paragraph 1 2, or

2) on a paper scheme drawn up by the Management Board.

Paragraph 2. Employers and self-employed persons who have a social security number shall apply for the allowance and support for the universal service provided that this option is available, cf. paragraph 1. Furthermore, employers and self-employed persons must receive decisions and notifications of reimbursement and subsidies for the transport of digital via e-Boks or similar digital mailboxes.

Paragraph 3. For digital applications, digital signature or other secure identification of persons providing access to the Subtraining .dk shall be used.

Paragraph 4. In exceptional cases, the management may exempt employers and self-employed persons from the obligation to apply for reimbursement and subsidies for the universal service, and to receive decisions and communications digitally.

§ 14. It is a condition for the treatment of an application for reimbursement and subsidy for the provision of the fact that all mandatory fields in the application form are completed.

Paragraph 2. In the case of a digital application for reimbursement and subsidies for transport, the application procedure may be stopped automatically if certain conditions are not available for the granting of compensation and subsidies for the transport of Chapter 1-4, including that training is not available ; are covered by Section 5.

Paragraph 3. An employer providing for the application for reimbursement and subsidy for carriage shall inform the participant as to the content of the application and that the accuracy of the information given in the application for the participant may be checked by : interconnector of registers.

§ 15. The training sites must provide information on a digital application for reimbursement and support for the provision of services, including on their websites, and provide guidance and assistance in doing so.

Chapter 6

Administration, disbursement, monitoring and complaint

§ 16. The Management Board shall have overall responsibility for the management of allowances and grants for transport by participating in business adult and after-training.

Paragraph 2. The compensation and allowance for the carriage of a participant who is a member of a unemployment fund shall be taken by the unemployment rate of the participant and the unemployment fund shall make the payment.

Paragraph 3. The compensation and allowance for carriage of a participant who is not a member of a unemployment fund shall be taken by the training site, cf. however, paragraph 1 4, and the Board shall make the payment.

Paragraph 4. The compensation to a participant who is not a member of a unemployment fund and participating in training after paragraph 5 (2) shall be reimbursed. 1, no. 5 or 6, the Board shall be made by the Management Board and shall make the payment.

Paragraph 5. The Management Board may, at any time, make or amend a decision in cases of reimbursement and subsidy for the carriage of transport, which is under consideration or is determined by a training facility.

Paragraph 6. Allowance and subsidies for the carriage of goods shall be paid to the participant, cf. however, paragraph 1 Seven and eight.

Paragraph 7. If the employer ' s employer has entered the right to reimbursement, cf. § 7, 1. a pkton, in the case of allowances and allowances for the carriage of passengers by means of vocational training and training, the compensation payable to the employer shall be paid in accordance with the rules of the Member ' s employer. Act 7, 2. and 3. Act.

Paragraph 8. Profit for carriage may be paid to the participant ' s employer if the employer is obliged to pay a minimum amount equal to that of the carriage of goods which the participant may otherwise have been paid or to hold all ; the costs of the participation of the participants in the course of training, and the participant has approved the payment of grants to the employer, as set out in the case of the employer, cf. § 8 (3) 2, in the case of allowances and allowances for the carriage of passengers by means of participation in business adult and training.

Niner. 9. The approval and allowance for carriage shall be paid to the beneficiary ' s NemKonto.

§ 17. Before a decision is taken on reimbursement and subsidies for the carriage of goods, cf. Section 16 shall make an inventory of the extent to which the participant has followed the instruction. For participants who are members of an unemployment fund, the training shall be sent to the unemployment fund. In the case of non-members of a non-unemployment fund, the inventory shall be used for the granting of allowances and allowances for the carriage of goods by the training. For participants who are not members of an unemployment fund and who have been following training after paragraph 5 (5). 1, no. However, 5 and 6 shall be sent to the Management Board.

§ 19. The steering guide shall guide the unemployment rates and the training centres on the rules concerning administration, calculation and payment of reimbursement and subsidies for the carriage of goods.

Paragraph 2. The Management Board shall lay down guidelines for the administration of reimbursement and the provision of services by individual training, and the Management Board may impose on the training facilities to apply the management systems of the steering system at the time of delivery of the tasks of training and training. after § 16 and § 17.

Paragraph 3. Management shall supervise the taking of the tasks assigned to the training sites and may require all information necessary for the supervision of the surveillance authorities. Paragraph 3. The unemployment fund, the training facility or the Management Board shall be determined within four weeks of the receipt of the complaint, whether the appeal is fully accommodated. If the complaint is not fully accommodated, it shall be forwarded by a statement to the Employment Committee of the AnkeGovernance Committee.

Paragraph 4. The Employment Committee of the Employment Board may be disregarded from the time limit laid down in paragraph 1. Two, when there is particular reason for this.

§ 21. The decisions of the Employment Committee on Employment and Social Affairs cannot be brought to an end to the second administrative authority.

§ 22. Written communication between educational establishments, the level of unemployment, the recovery authority, the management board and the management board shall be digitally carried out unless the Board of Directs takes a different decision.

Paragraph 2. Written communication between training places or the management of unemployment and the management board shall be digitally, unless the Danish Board takes a decision otherwise. Digital signature or other secure identification shall be used for the digital exchange of information on participants and employers.

Paragraph 3. Paragraph 4. Decisions taken exclusively on the basis of digital data processing may be issued alone with the indication of the unemployment fund, the training site or the management authority of the department of the department of dispatch.

Chapter 7

Repayment of reimbursement and subsidy for the carriage of goods

-23. Entry into force and transitional provisions
