Publication of protected designations of agricultural and food products

Purline of section 17 (2). Paragraph 1, section 49, paragraph. Paragraph 60 (1) and 60 (2). 3, in the law of foodstuffs, cf. Law Order no. 820 of 1. July 2011 :

Application for protection

§ 1. Application for the registration of a protected designation of origin (BOB) or a protected geographical indication (BGB) as provided for in Council Regulation (EC) No 2. (EC) No 510/2006 on the protection of geographical indications and designations of origin for agricultural products and foodstuffs, Council Regulation (EC) No 19. Regulation (EC) No 1234/2007 on the common organisation of agricultural markets and specific provisions for certain agricultural products (the single CMO Regulation) and Regulation (EC) No (EC) No (EC) No (EC) No, 110/2008 on the definition, description, presentation and labelling, and the protection of geographical indications for spirits and repealing Council Regulation (EEC) No 2. 1576/89 shall be submitted to the Food Service.

§ 2. The application for the registration of a guaranteed traditional speciality (GTS), in accordance with Council Regulation (EC) No (EC) No, 509/2006 on the guaranteed traditional specialities in respect of agricultural products and foodstuffs shall be submitted to the Food Service.

§ 3. The application for a change to the specifications for products registered under sections 1 and 2 of these Regulations shall be submitted to the Food and Food Authority.

National insigment procedure

§ 4. Following the verification by the Food Management Board, an application in accordance with Council Regulation (EC) No (EC) No (EC) No 510/2006 on the protection of geographical indications and designations of origin for agricultural products and foodstuffs or Council Regulation (EC) No 145.4 1234/2007 on a common organisation of agricultural markets and laying down specific provisions for certain agricultural products (the single CMO) is justified and contains the information required and documents shall be published on the application of : The hearing portal and the food-styleboard website.

§ 5. Within a period of three months from the date of publication of the application, cf. section 4, any natural or legal person with a legitimate interest established or residing in Denmark may object to the application.

Paragraph 2. Inconsistencies must be submitted to the Food Authority.

EU Insitional Procedure

§ 6. Where a natural or legal person with a legitimate interest established or residing in Denmark would wish to oppose any of the Commission's application for protection in accordance with one of the regulations referred to in Article (a) of the Regulations ; Section 1 shall be sent to the FDA within one month before the end of the notice period.

Applause of the decisions of inspection bodies

§ 7. Decisions of inspection bodies referred to in Article 2 of Regulation (EC) No (EC) of the European Parliament and of the Council. Penalty provisions

Paragraph 3. Inherit of nature. 118m (1) Two, species. 118v (1). 1, species. 118y, paragraph. 1 (b). 118za, paragraph. 2, in Council Regulation (EC) No, EUR 1234/2007 on the common organisation of agricultural markets and laying down specific provisions for certain agricultural products (the single CMO Regulation) shall be punished by fine.

Paragraph 4. Inherit of nature. 40, paragraph. 2, in Commission Regulation (EC) No, EUR 607/2009 laying down detailed rules for the application of Council Regulation (EC) 479/2008 as regards protected designations of origin and protected geographical indications, traditional terms and labelling and presentation of certain wine-growing products ; is punished by fine.

Paragraph 5. Inherit of nature. 9 (1). Four, species. 9 (1). Seven, species. 10 (1). 1, species. Fourteen, paragraph 14. 2, and kind. Regulation 16 of the Regulation (EC) No, 110/2008 on the definition, description, presentation and labelling, and the protection of geographical indications for spirits and repealing Council Regulation (EEC) No 2. 1576/89, punished by fine.

Paragraph 6. The penalty for infringement of the provisions of paragraph 1. 1-5 may go to prison for a period of two years if the infringement has been carried out with carry on or gross negligence, and there is a breach in the infringement proceedings ;

1) damage to health or to the detriment of such risks ; or

2) obtained or intended for the benefit of a financial advantage for the person concerned or for others.

Paragraph 7. Companies can be imposed on companies, etc. (legal persons) punishable by the rules of the penal code cap. 5.

Entry into force

§ 9. The announcement shall enter into force on 1. November 2012.
