Notice about security measures in railway overkørsler, managed by banedanmark, and are open to regular traffic
Under section 2, paragraph 3, article 85, article 86, paragraph 1, and paragraph 113, paragraph 2, of the law on public roads, see. lovbekendtgørelse nr. 1048 by 3. November 2011, and after negotiation with the Minister of Justice, be determined in accordance with the authorisation granted pursuant to section 2, paragraph 2, of the law on public roads: scope and definitions
§ 1. The notice applies to existing crossings in level between rail and roads and trails that are open to general traffic, when railway overkørslen managed by banedanmark.
§ 2. 5) Halvbomanlæg: Plant consisting of A Cross marks, Z 72 74, 2 Red flashes signal by railway overkørsler, Bell signal and O 45 automatic beams, which blocks all traffic in the lanes with traffic direction of railway overkørslen. The plant can be supplemented with O 45 automatic barriers, blocking the traffic on the trails and sidewalks.
6) Helbomanlæg: Plant consisting of A Cross marks, Z 72 74, 2 Red flashes signal by railway overkørsler, Bell signal and O 45 automatic beams, which blocks all traffic across the carriageway width against railway overkørslen. The plant can be supplemented with O 45 automatic barriers, blocking the traffic on the trails and sidewalks.
7) sluices at the railway overkørsler, who alone can be used by pedestrians, moped riders and cyclists: Works designed to allow drivers to speed will be reduced.

Responsibility for security measures, etc.
§ 3. Banedanmark is responsible to establish, operate and maintain the security measures that are necessary for reasons of safety for both road and rail traffic in railway overkørsler covered by article 1 of the basic regulation. § 86, paragraphs 4 and 5, of the law on public roads.
(2). Banedanmark is obliged to establish and maintain procedures for operation and maintenance of the security measures referred to in article 6. (1).
(3). Banedanmark has a duty to ensure that the procedures laid down in accordance with paragraph 2 are complied with.
Requirements for security measures
§ 4. (A) 74 cross-marks must be set immediately in front of all railway overkørsler.
(2). By single track railway overkørsel to A cross-brand for single track railway 74.1 overkørsel used.
(3). By multiple track railway overkørsel to A cross-brand for multi-pronged 74.2 railway overkørsel, is used.
(4). Tick mark appearance follows by Decree on road markings.
(5). Tick mark must be placed in such a way that the distance from the tick mark to the edge of the right lane or cycle track is sufficient to ensure safety for both road and rail traffic.
§ 5. Z 72.2 Red flashes signal by railway overkørsler, must be set up immediately in front of all railway overkørsler.
(2). Additional Z 72.2 Red flashes signal by railway overkørsler can set up next to roads or paths, if these flows into the road or path in the immediate vicinity of a railway overkørsel.
(3). Blink signal appearance follows by Decree on road markings.
§ 6. Z 72.2 Red flashes signal by rail overkørsler set up in the right side of the road in the direction of the road must be fitted with a clock signal.
§ 7. O 45 Automatic b appearance follows by Decree on road markings.
§ 8. Bomsignaler must be installed on the automatic barriers. Bomsignalet must have a red light. It does not apply to automatic barriers, which alone prevents traffic on sidewalks.
§ 9. Manual closing devices, URf.eks. booms or Indent must be designed in such a way that all traffic on both sides of the railway overkørslen is blocked. Design of the manual shutoff device must ensure that road's attention is drawn to the close the décor and on railway overkørslen.
§ 10. Sluices at the railway overkørsler must be designed in such a way that the factions, knallertkøreres and cyclists ' attention is drawn to the sluice-gate facility and on railway overkørslen.
§ 11. Blocking time should be as short as practicable.
Proposal for the establishment or modification of security measures
§ 12. Course Denmark must apply to the Agency for approval, before Traffic can be carried out a project on the establishment or modification of security measures in a railway overkørsel. The rules laid down in the Ordinance on the approval of the infrastructure of the railway area shall apply in connection with the application.
(2). Course Denmark must hear: 1) the relevant vejbestyrelse, in so far as the intersecting road is a public road, or 2) the relevant vejmyndighed, in so far as the intersecting road is a private fællesvej, and 3) other relevant stakeholders in the project, as well as obtain the consent from the police before the application is sent to the Traffic Agency. Responses to the consultation and consent from the police must be attached to the application to the Traffic Agency.
§ 13. The relevant vejbestyrelse for a public road, vejmyndigheden for a private fællesvej, the police and any other relevant parties can propose banedanmark, that security measures in a rail overkørsel be changed for the sake of vejfærdslen, for example. by securing the bike path and sidewalk with automatic barriers, by reduction of the curfew, and more.
(2). Responds to banedanmark not a proposal according to paragraph 1, the authors introduce the refusal of Danish transport authority, which decides whether there is a basis for imposing banedanmark to change security measures in railway overkørslen, jf. section 86, paragraph 2, of the law on public roads.
Application of security measures
§ 14. By projects on the establishment or modification of security measures in railway overkørsler with a railway track where the train speed not exceeding 120 km/h, a risk assessment must be carried out in order to determine if either helbomanlæg, halvbomanlæg or advarselssignal installations is appropriate for reasons of safety for both road and rail traffic, without prejudice. However, paragraphs 2 to 4, and section 15.
(2). Helbomanlæg to be used in railway overkørsler with more than a railway track that can be serviced independently of each other.
(3). Helbomanlæg to be used in railway overkørsler, where the train speed exceeding 120 km/h, regardless of the number of railway track in the railway overkørslen.
(4). Hel-or halvbomanlæg to be used in railway overkørsler with a railway track in a closer developed area when a railway overkørsel, used by pedestrians, cyclists and moped drivers, can also be used by motor vehicles.
§ 15. By projects on the establishment or modification of security measures in railway overkørsler with a railway track, which alone takes place rank, and where the train speed not exceeding 40 km/h, can be carried out a risk assessment in order to determine what measures are necessary to ensure safety for both road and rail traffic.
(2). If the risk assessment in accordance with paragraph 1 shall not be carried out, find the provision in section 14, paragraph 1, shall apply.
§ 16. Traffic agency supervises the banedanmark takes care of the safety of road and rail traffic in railway overkørslerne, jf. § 3.
(2). Traffic Board shall obtain the opinion of the appropriate vejbestyrelse or vejmyndighed, banedanmark, the police and any other relevant parties before the Traffic Agency instructs banedanmark to establish new or to improve the existing security measures in railway overkørsler, jf. section 86, paragraph 2, of the law on public roads.
Access to justice
§ 17. Traffic Agency's decisions concerning security measures in railway overkørsler after this order cannot be appealed to the Secretary of State. These decisions may, within 4 weeks after the decision is announced, be appealed to the Railway Board.
§ 18. With fine punished anyone who 1) violates section 3 or section 12, paragraph 1 1. paragraph, or 2) fails to comply with the order made under section 13, paragraph 2, and section 16, paragraph 2.
(2). That can be imposed on companies, etc. (legal persons) criminal liability in accordance with the provisions of the criminal code 5. Chapter.
Entry into force and transitional provisions
§ 19. The notice shall enter into force on the 1. January 2012.
(2). Executive order nr. 1094 of 21. September 2010 concerning the responsibility for security measures in railway overkørsler on the rail networks of Denmark, which is open to general traffic, is repealed.
§ 20. As regards the existing security measures in railway overkørsler, including requirements for security measures, they may continue to exist on the basis, including guidelines, etc., as they are established in accordance with.
(2). If carried out the creation, renewal or modification of the security measures referred to in paragraph 1, the provisions of this order shall be used.
