Publication of the amendment of the publication of the labelling and so forth of foodstuffs 1)

§ 1

Notice no. 1308 of 14. December 2005 on the labelling, etc. of foodstuffs, as amended by publication No 1. 115 of 23. February 2006, procladition no. 829 of 20. July 2006, Notice no. 1333 of 3. December 2007, proclame no. 416 of 29. 'May 2008, announcement no.' 1124 of 1. December 2009, proclame no. 27 of 12. 1 January 2010 and Notice no. 36 of 18. In January 2011, the following changes are made :

1. Chapter 14 ITREAS :

" Chapter 14

Supplementary provisions on the labelling of food with caffeine content

§ 46. If a foodstuff, apart from the beverages referred to in section 46a, has been added to caffeine with a physiological function, the following information must appear on the label in the same field of vision as the description of the product : ' contains caffeine. Should not be included in children or pregnant `, cf. however, paragraph 1 4.

Paragraph 2. Information is followed by a reference in parentheses to the caffeine content expressed in mg per mg. 100g/ml., cf. however, paragraph 1 3.

Paragraph 3. In the case of food supplements, the caffeine content is expressed in relation to the daily dose indicated on the label.

Paragraph 4. Paragraph 1 shall not apply to food produced from coffee, tea, coffee extract or teext, if the food label contains the word "coffee" or "tea".

§ 46a. If a beverage intended for consumption without further processing or preparation other than reconstitution of a concentrated or dried product, contains more caffeine than 150 milligrams per litre, regardless of the source, the following information must appear on the label in the same field of vision, such as the description of the beverages : ' Highly caffeinine content. Should not be enlisted by children or pregnant women or amming women, cf. however, paragraph 1 3.

Paragraph 2. Information is followed by a reference in parentheses to the caffeine content expressed in mg per mg. 100 cc's.

Paragraph 3. Paragraph 1 shall not apply to beverages made of coffee, tea, coffee extract or teext, if the food label contains the word "coffee" or "tea".

2. Chapter 25 ITREAS :

" Chapter 25

Penalty provisions

§ 77. The penalty shall be penalised by the penalty that violates sections 1 to 5, § 8, § 10 20, § § 22-28, § § 31-34, § § 36-39, section 41-46 (6). 1-3, section 46a, paragraph. 1-2, § § 47-62, § § 68-71, section 73, paragraph 2-4 or § § 75-76 of this notice or decisions made in accordance with the notice.

Paragraph 2. The penalty shall be penalised by the penalty which is in breach of section 72, section 74 or the Regulations referred to therein.

Paragraph 3. The sentence may rise to prison for two years if the infringement has been carried out with a set of presets or by gross negligence and if there is a breach of the infringement proceedings ;

1) injury to human health or, therefore, hazard, or

2) obtained or intended for the economic benefit of the person concerned itself or others, including in savings.

Paragraph 4. Companies can be imposed on companies, etc. (legal persons) punishable by the rules of the penal code 5. Chapter. "

3. I § 78 read paragraph 6 Thus :

" Stop. 6. Products not meeting the requirements of section 10 (3). 1, no. 11, section 46 and § 46a, but which is marked before the 15th. "December 2011, may be sold until stocks are exhausted."

§ 2

The announcement shall enter into force on the 15th. December 2011.
