Notice on application of ecology control mark (e-mark) on organic agricultural products, to be used for nonfood1)
Pursuant to section 13, paragraph 1, article 18, paragraph 1, article 24, paragraphs 2 and 3, in økologiloven of the basic regulation. lovbekendtgørelse nr. 196 of 12. March 2009, and under the authority shall be based on:
§ 1. Agricultural products, to be used for non-food, can be felt with ecology control mark (Island label), provided that the
1) at least 95 vægtpct. of all the constituents of the product has been produced according to the manufacturing provisions of Council Regulation (EC) No 834/2007 on organic production and labelling of organic products and repealing Regulation (EEC) No 2377/90. 2092/91 (Council Regulation) and in the Decree on organic agricultural production, etc. (ecology Ordinance),
2) all components of different origin are authorized for use in accordance with the Council regulation and ecology Ordinance,
3) for processing of the products are not used AIDS or anything else that may not be used in accordance with the Council regulation and the ecology of the notice, and
4) products are manufactured, processed, entered or imported by holders of an authorisation after ecology notice.
(2). The Ordinance does not, however, cover with animal feed content, designed for dogs, cats and other pets.
§ 2. Products may only be labelled with Ø-mark of holders of an authorisation after ecology notice.
(2). Ø-mark must be designed and rendered in accordance with the guidelines therefor laid down in Ordinance on organic food, etc.
§ 3. The labelling shall indicate the Danish plant Directorate ecology control code: "DK-ECO-050", see. notice on organic food, etc.
(2). For processed products labelling must be accompanied by information on the main ingredients of agricultural origin which are included in the products, and their weight proportion thereof.
(3). Stocks of products which are manufactured, packaged and labelled prior to 1 May 2004. July 2010 in accordance with Regulation (EEC) No 2377/90. 2092/91 or regulation (EC) No 1782/2003. 834/2007, where the products have obtained the Danish plant Directorate previous control code "DK-Ø-50.0" may continue to be marketed until stocks are exhausted.
(4). Packaging and labels in accordance with Regulation (EEC) No 2377/90. 2092/91 or regulation (EC) No 1782/2003. 834/2007, where the packaging and labels are affixed to the Danish plant Directorate previously control control "DK-Ø-50.0" may continue to be used for products placed on the market until 1. July 2012, provided that the products meets the requirements of Regulation (EC) No 1782/2003. 834/2007.
§ 4. The Danish plant Directorate verifies that the provisions in the Ordinance are complied with.
§ 5. In accordance with section 23 (1) of the Danish plant Directorate can prohibit a product sold with reference to the organic production method, where the product does not comply with the provisions of this Ordinance.
§ 6. After section 19 has the Danish plant Directorate at any time, if deemed necessary, against proper identification and access to private property without a court order, sites, business books, parpirer, etc., including material that is stored in electronic form, in order to provide information necessary to use for solution of tasks according to the notice. The police provide assistance if necessary for that purpose. The Directorate may take exams to study without having to pay the payment for it.
(2). In accordance with section 20, the subject of this notice upon request, provide all information, including on financial and accounting matters, as required by the implementation of the control, as well as provide the Directorate the necessary assistance free of charge for testing, sampling, copying and delivery of written documents and printouts of information held in electronic form.
§ 7. Complaint against the Danish plant Directorate decisions after this notice must be submitted within four weeks from the date of receipt of the decision. The complaint must be addressed to the Ministry for food, agriculture and fisheries, and must be submitted to the Danish plant Directorate.
§ 8. With fine punished anyone who violates sections 1-3, or a ban discontinued under section 5.
(2). That can be imposed on companies, m. v. (legal persons) criminal liability in accordance with the provisions of the criminal code 5. Chapter.
Date of entry into force of
§ 9. The notice shall enter into force on the 15. September 2010.
(2). Executive Order No. 409 of 21. May 2001 on the application of ecology control mark (e-mark) on organic agricultural products, to be used for non-food purposes is repealed.
