Order on the basis of a sample of the welfare of farm animals and horses, which are not kept for agricultural purposes
Under section 4 (a), paragraph 1, and 24, paragraph 1 (a), in Danish, see. lovbekendtgørelse nr. 1343 by 4. December 2007, as amended by Act No. 500 by 12. June 2009, section 15 of Act No. 336 of 16. May 2001 on the keeping of chickens and after talks with the Agriculture Minister, be laid down:
§ 1. Ministry of food, agriculture and fisheries shall each year carry out a random physical checks on at least 5 percent of all herds with at least 10 farm animals or horses, which are not kept for agricultural purposes (5-procentskontrollen).
(2). Ministry of food, agriculture and fisheries, in addition to the checks referred to in paragraph 1 carry out random physical checks on herds of farm animals or with horses, which are not kept for agricultural purposes, in order to verify compliance with a given rule or a given set of rules designed to protect the welfare of animals (themed).
(3). By farm animals means vertebrates – apart from fish, reptiles and amphibians – which are kept for the production of food, wool, skin or fur or for other farming purposes.
(4). Such inspections may be risk-based.
§ 2. The check must be carried out by persons employed in, or under the Danish Ministry of food, agriculture and fisheries, or private practitioners, that of Food Agency is authorised to do so. Such inspections may be carried out in connection with the execution of control pursuant to other legislation.
§ 3. Food Agency shall designate the herds, which are to be included in monitoring and coordinating the implementation and reporting of this.
§ 4. When performing the checks referred to in article 1, paragraph 1, shall ensure that the following rules are respected:
1) Rules in Danish and regulations drawn up on the basis of the Danish animal, including rules in notice on tail docking and castration of animals Ordonnance on the dehorning of animals Ordonnance on slaughter and killing of animals, Ordinance prohibiting certain aggregates, collars, etc. to animals and notice on the earmarking of animals.
2) laws or regulations that separate protects individual species welfare.
(2). When performing the checks referred to in article 1, paragraph 1, in herds with farm animals, it must, in addition, to ensure that the rules laid down in the Ordinance on minimum requirements for the protection of farm animals are respected.
§ 5. Crew owner is informed of the results of the checks carried out pursuant to the notice.
§ 6. The notice shall enter into force on the 1. January 2010.
(2). Executive Order No. 1197 by 19. December 2003 on the basis of a sample of the welfare of farm animals and horses, which are not kept for agricultural purposes, shall be repealed.
