Law amending the law on procurement associations for small farmers

(Extension of membership to other than land users, etc.)

WE, MARGRETHE the SECOND, by the grace of God Queen of Denmark, do indeed:

The Danish Parliament has adopted and we know Our consent confirmed the following law:

§ 1

The law on purchasing groups for less land users, see. lovbekendtgørelse nr. 566 of 3. August 1990, as amended by section 5 of law No. 967 by 4. December 2002, be amended as follows:

1. the title of the Act is replaced by the following: ' law concerning the purchasing associations for small enterprises in rural areas '



2. paragraph 2 is replaced by the following: ' article 2. The Minister of food, agriculture and fisheries can approve the statutes of purchasing groups for small businesses in rural areas, where the statutes contain the following provisions:





1 purpose of the Association shall exclusively be) to make purchases to members of machines, equipment and technical operating resources used in members ' businesses. Businesses must be located in rural areas or be companies located elsewhere, but works for the benefit of development in rural areas. The purchased is subject to the Corporation's property until the purchase price with interest and costs are fully paid, unless this is contrary to the provisions of the land registration Act, section 38.

2) Association's Board of Directors consists of 5, 7 or 9 members elected by the general Assembly.

3) amendment of the Association's bylaws require approval from the Minister of food, agriculture and fisheries.

4) the Association shall each year to use for the supervision referred to in § 7 submit report on and account for the Association's activities during the past year and is, moreover, obliged to communicate all information needed for supervision regarding the Association's activities and relationships, including evidence that the Association is managed in accordance with this law and the Association's bylaws.

5) Association's resolution by own decision requires the approval of the Minister of finance, if the Association at the time of decision is in debt to the Treasury.

6) At the Association's resolution by his own decision or under section 7, paragraph 3, shall accrue to the assets of the Association Danish Purchasing organisations National Association.





(2). An association may, after approval by the Minister for food, agriculture and fisheries in the articles of Association stipulate that the Association obtains any other form of security for the payment of the purchased than that provided for in paragraph 1, no. 1, 3. paragraph referred to safety. '

3. paragraph 3 is replaced by the following: ' 3. Purchasing groups for small rural businesses and purchasing groups for less land users occurring as members of the Danish Purchasing organisations National Association (National Association), whose statutes must be approved by the Minister for food, agriculture and fisheries. At the same time, with the approval of the articles of Association shall terminate Danish purchasing groups (samvirksomheden). '

4. section 4 is repealed.

5. § 5, paragraphs 1 to 5, shall be repealed.




Paragraph 6 becomes paragraph 1.



6. In section 5, paragraph 6, there will be (1) shall be replaced by ' Samvirksomheden ': ' the National Association '.

7. section 6 is repealed.

8. In article 7, paragraph 1, shall be replaced by ' samvirksomheden ': ' the National Association '.

9. section 7, paragraphs 3 and 4, shall be replaced by the following: ' (3). If a purchase Association without government loans do not act in accordance with the law, the rules laid down in accordance with the law and the articles of Association approved, can the Minister for food, agriculture and fisheries, stop the Association's business.

(4). The Minister of food, agriculture and fisheries can with effect for purchasing groups for smaller farmers, purchasing groups for small businesses in rural areas and the National Association establishing rules on audit of company accounts and for the inclusion of other loans other than government loans, which can be used for purchases in accordance with the Act's purpose. As a basis for credit to the Minister may lay down detailed rules on the above-mentioned associations activities and priority for Government loan, including rules on clubs ' reserve funds. '

10. Article 7, paragraph 5, shall be repealed.

11. section 8 is repealed.

12. section 10 is repealed.

§ 2

(1). The Minister of food, agriculture and fisheries shall fix the time of the entry into force of the Act.

(2). § 2 of the law on the purchasing groups for less land users, see. lovbekendtgørelse nr. 566 of 3. August 1990, as amended by section 5 of law No. 967 by 4. December 2002, shall continue to apply for purchasing groups for less land users, as long as the associations continues as such associations. The associations, however, may not make purchases of livestock to members.

(3). sections 4, 6 and 8 of the law on the purchasing groups for less land users, see. lovbekendtgørelse nr. 566 of 3. August 1990, as amended by section 5 of law No. 967 by 4. December 2002, shall continue to apply for purchasing groups for small farmers and for purchasing groups for small rural businesses, so long as the associations have federal loans.

(4). Rules laid down pursuant to the law on purchasing groups for less land users, see. lovbekendtgørelse nr. 566 of 3. August 1990, as amended by section 5 of law No. 967 by 4. December 2002, shall remain in force until they are replaced by rules laid down pursuant to this or other laws.
