Completion of the prohibition of certain fishing activities in nearer-defined areas of Kattegat and northern part of the Øresund
In accordance with section 30-32, § 34 and § 130 (3). 2 and 4 in the case of fisheries and fish farming (fisheries law), cf. Law Order no. 978 of 26. September 2008, and after authorisation, the following shall be determined :
§ 1. In the case of Kattegat and Northern Øresund, the restricted areas shall be limited to business and recreational fishing in accordance with the rules laid down in the case of commercial fishing. § § 2-3 and § 5.
§ 2. In an area called area no. 1 situated in the south-east of the Kattegat and northern Øresund and defined in Annex 1, a seasonal prohibition shall be established in respect of commercial and recreational fishing. In the part of the area in the area of Kattegat, the prohibition shall apply to the period from 1. January to the 31 st. March, and in the part of the area situated in Øresund, the prohibition shall apply to the period from 1. February to 31. March. The border between Kattegat and Øresund is the right line between the Gilbjerg Hoknows and the Kullen.
Paragraph 2. Exempted from the prohibition in paragraph 1. 1 is :
1) Trawlfishing with selective gear that reduces the by-catch of cod to a minimum, cf. § 4.
2) Fishing for herring with floattrawl.
3) Fishing of lobster and crab with tea jars.
4) Fishing for stone bites with nets of mesh size of at least 220 mm.
5) Recreational fishing, which is not targeted by cod.
§ 3. In an area called area no. 2 situated in the south-east of Kattegat and delimited as set out in Annex 2, shall be established a closed area with a ban on all business and recreational fishing for the period from 1. January to the 31 st. December.
Paragraph 2. Exempted from the prohibition in paragraph 1. 1 is the fishing of lobster and crabs with tejns.
Paragraph 3. Exempted from the prohibition in paragraph 1. One is in the period from 1. April to the 31. December :
1) Trawlfishing with selective gear that reduces the by-catch of cod to a minimum, cf. § 4.
2) Fishing for herring with floattrawl.
3) Recreational fishing, which is not targeted by cod.
§ 4. Requirements for the design of instruments which may be legally applicable in accordance with section 2 (2). 2, 1 and 3 (1) and (3). 3, 1 is given in Appendix 4.
§ 5. In an area called area no. 3 in the south-east of Kattegat and delimited as set out in Annex 3, a permanent restricted area shall be established with a ban on all business and recreational fishing for the period from 1. January to the 31 st. December. There are no exceptions to the ban.
§ 6. With fine punishment, whoever violates or tries to violate § § 2-5.
Paragraph 2. Companies can be imposed on companies. (legal persons) punishable by the rules of Chapter 5 of the penal code.
§ 7. The announcement shall enter into force on 16. March, 2009.
Paragraph 2. Publication no. 1415 by 23. In December 2008, banning certain types of fishing in nearer restricted areas of Kattegat and northern part of Øresund are hereby repealed.

Appendix 4
Requirements for instruments which may be used legally for fishing in the more specific areas of Kattegat and northern Øresund, cf. § 4
The requirement for selectivity is fulfilled by using the instruments as described below :
1) Swedish virgin lobster
|
(a) The species selective rist shall be fitted into trawls, whose codend is made up of square mesh with a mesh size of not less than 70 mm, but less than 90 mm. The bag of fangs shall be at least 8 m long. The use of trawls of more than 100 square meshes in the circumference of the codend shall be prohibited except for joining and sea mlinings.

(b) Risten must be rectangular. Risten's bars must be parallel to the longitudinal axis of the rist. The distance between the bars shall not exceed 35 mm. It shall be allowed to use one or more hinges so that the grate can be stored more easily in the net.
|
c) The Risten must be fitted diagonally in the trawlet with the grate to the edge of the grate, bearing back and upward. It can be mounted right in front of the codend or further forward in the extension piece. The rigour shall be attached to the trawl on all sides.
|
(d) The panel of the trawl must in the immediate end of the rist end of the rist be an impenetrable opening where the fish may escape. The end-of-off soles shall be as wide as the grate and in the front of a pointer where the sides are cut along the mesh tropics on each side of the ribstone.
|
e) It is permissible to affix a traishaped device in front of the grate to guide the fish from the bottom and grind of the traw;. The mesh size of the funnel must be at least 70 mm. The funnel must have a vertical opening at a minimum of 6 cm. The guard's opening on the ribstone must be as wide as the grate.
|
2) SELF-TRAPPING BAG
|
The trapping bag shall consist of a square net section of at least 6 metres in length and 4 pages that are equally wide. The pages must be made of traditional meshes with a mesh size of at least 90 mm. Each side of the trapping bag may consist of not more than 25 meshes other than those used for the adjoining and the sweemlins. In the top section, a 3-foot long-distance exit window is to be placed at a maximum of 3 metres from the end of the codend. The sort window must have a mesh size of at least 300 mm and consist of 3 open square meshes in the width. The mesh size of at least 400 mm shall be applied to 2 open meshes in the width. The principle is shown in the figure below.
