Annex 4 The full text of the Decree on the prohibition of certain types of fishing in areas defined in the Kattegat and North-western part of the sound

Pursuant to sections 30 – 32, section 34 and section 130 (2) and (4) of the law on fisheries and aquaculture (fisheries), see. lovbekendtgørelse nr. 978 by 26. September 2008, and under the authority, shall be based on:

§ 1. In the Kattegat and North Sound applies in defined areas restrictions for commercial and recreational fisheries of the basic regulation. § § 2 – 3 and 5.

§ 2. In an area called area No. 1 located in the Southeast Kattegat and North Sound and bounded as specified in annex 1, established seasonally ban on commercial and recreational fisheries. In the part of the area, which is located in the Kattegat, the prohibition provided for in the period from the 1. January to the 31. March, and in the part of the area, which is located in the sound, the prohibition provided for in the period from the 1. February to 31 March. March. The boundary between Kattegat and Öresund is the straight line between Gilbjerg head and Kullen.

(2). Exempt from the prohibition referred to in paragraph 1 are:





1) trawling with selective gear that reduces by-catch of cod to a minimum, see. § 4.

2) fishing for herring with pelagic trawls.

3) Fishing of lobster and crab with pots.

4) fishing for lumpfish with nets with mesh size of at least 220 mm.

5) recreational fisheries that are not targeted cod.





§ 3. In an area called area No. 2 located in the Southeast Kattegat and delimited as set out in annex 2, establishing a closed area with a ban on all forms of commercial and recreational fisheries in the period from the 1. January to the 31. December.

(2). Exempt from the prohibition referred to in paragraph 1 is fishing of lobster and crab with pots.

(3). Exempt from the prohibition referred to in paragraph 1 is for the period from 1 July 2001. April to the 31. December:





1) trawling with selective gear that reduces by-catch of cod to a minimum, see. § 4.

2) fishing for herring with pelagic trawls.

3) recreational fisheries that are not targeted cod.





§ 4. Requirements for the design of tools, which can legally be used under section 2, paragraph 2, article 3, paragraphs 1 and 3, 1 is set out in annex 4.

§ 5. In an area called area No. 3 located in the Southeast Kattegat and delimited as set out in annex 3, the establishment of a permanent enclosed area with ban on any kind of commercial and recreational fisheries in the period from the 1. January to the 31. December. There are no exemptions from the ban.

§ 6. With fine punished anyone who violates or attempts to violate articles 2 – 5.

(2). That can be imposed on companies, etc. (legal persons) criminal liability according to the rules laid down in the Penal Code Chapter 5.

§ 7. The notice shall enter into force on 16 September. March 2009.

(2). Executive Order No. 1415 by 23. December 2008 establishing a prohibition of certain types of fishing in areas defined in the Kattegat and North-western part of the sound is repealed.

Annex 4

Requirements for tools, which can legally be used for fishing in the defined areas in the Kattegat and North Sound, see. § 4

The requirement for selectivity is fulfilled through the use of tools designed as described below:







 





1) Swedish Nephrops grate







(a)) The arts selective grating shall be mounted in the trawl, if cod consists solely of square meshes of mesh size of at least 70 mm, but less than 90 mm. The codend shall be at least 8 metres wide. It shall be prohibited to use trawls of more than 100 square meshes in the circumference of the codend, with the exception of selvages and sømliner.







(b)) the grate must be rectangular. Ristens bars must be parallel to the longitudinal axis of the ristens. The distance between the bars must not exceed 35 mm. It shall be permissible to use one or more hinges, so the grid can easily be stored at nettromlen.







(c)) the grate must be mounted diagonally in the trawl with ristens over the edge pointing backwards and upwards. It can be mounted directly in front of the codend or further on in the lengthening piece. The grate must be secured to the trawl on all sides.







(d)) in the trawl over the panel must be in close connection with ristens over the edge to be a non-obstructed opening, where the fish can escape. Udslipningsåbningen must be as wide as the grating at the back and front end into a tip, where the sides are cut along the mesh bars on each side of the grate.







(e)) It is allowed to attach a funnel-shaped device in front of the grate in order to guide the fish toward the bottom trawl and the grate. Mesh size in the funnel must be at least 70 mm. Hopper must have a vertical opening in the grating of at least 15 cm. Of the funnel opening by the grate must be as wide as the grate.





 





2) SELTRAFANGSTPOSE







Seltrafangstposen is composed of a square netsektion of at least 6 metres in length and 4 pages that are equally broad. The pages must be created by traditional masks with a mesh size of at least 90 mm. Each page in seltrafangstposen must consist of a maximum of 25 masks in addition to those used for joining and sømliner. In the top section should be placed a 3-metre long exit window, ending with a maximum of 3 meters from the end of the codend. Sort window must have a mesh size of at least 300 mm and consist of 3 open square meshes in width. By mesh size of at least 400 mm must be used 2 open meshes in width. The principle is shown in figure below.
