(Extended behandlingsret for mentally ill adults)

WE, MARGRETHE the SECOND, by the grace of God Queen of Denmark, do indeed:

The Danish Parliament has adopted and we know Our consent confirmed the following law:

§ 1

In health law, see. lovbekendtgørelse nr. 95 of 7. February 2008, as amended, inter alia, by § 1 of lov nr. 539 of 17. June 2008 and at the latest by the law No. 288 of 15. April 2009, is amended as follows:

1. Pursuant to section 87 (d) is added:

» Chapter 20 (b)

Extended right to treatment for mentally ill adults

§ 87 e. Persons who, at the time of referral to psychiatric treatment is filled 19 years, can choose to be treated in accordance with the provisions of §§ 87 f-87 h.

§ 87 such A person as is referred to psychiatric treatment, can choose to be treated at one of the hospitals or one of the clinics, etc., which has signed an agreement with the regional councils under section 87 g, paragraph 1 (agreement hospitals), where the Regional Council of the region of residence does not, within 2 months after the referral has been received, can offer treatment by own hospitals or one of the hospitals mentioned in paragraph 79 which the Regional Council is collaborating with or usually use (hospitals cooperative).

(2). The right referred to in paragraph 1 to choose to be treated in a hospital appointment lapses if the waiting time for treatment at hospital exceeds the wait time for this agreement in the place of residence of the region's hospitals and cooperative hospitals.

§ 87 g. Regional Councils in association signs agreement with the privately owned hospitals, clinics, etc. in Denmark and hospitals, clinics, etc., abroad, desiring to conclude an agreement on treatment after §§ 87 e and 87 such parties can not reach agreement, the terms and conditions determined by the Minister for health and prevention.

§ 87 h. the Minister for health and prevention sets out rules for the extended behandlingsret pursuant to this chapter, including the requirements for documentation, etc. to the appointment sygehusene, see. § 87 g (1) and on the procedure for referral of patients, etc. '

2. In section 90 (1), nr. 2, the words ' § § 87 (a) and 87 (b) ' are replaced by: ' § § 87 87 87 (a), (b), (e) and 87 f '.

3. In section 90 (1), nr. 3 and 6, section 87 shall be added after ' b ': ' 87 and e-87 f '.

4. In article 171, paragraph 2, the words ' articles 86, 87 and 87 b ' to: ' sections 86, 87, 87 (b) and 87 f '.

5. In article 262, paragraph 1 1. paragraph shall be added after ' section 87 (b), ': ' § 87 f '.

§ 2

The law shall enter into force on the 1. January 2010.

§ 3

The law does not apply to Greenland and the Faroe Islands.
