Annex 3 The full text of the Decree amending the Decree on support for public housing, etc.

§ 1

In executive order No. 643 of 15. June 2006 on support for social housing, etc., as amended by Decree No. 135 of 9. February 2007, Decree No. 223 of 14. March 2007, Decree No. 25 of 22. January 2008, Decree No. 1384 of 19. December 2008 and Decree No. 247 of 27. March 2009, is amended as follows:

1. The introductory part shall be replaced by the following:




» Under section 73 (4), article 100, paragraph 4, § 102, section 112, § 113, § 115, paragraph 9, article 118, paragraph 3, article 143, paragraph 3, section 149, § 157, paragraph 4, section 160, section 178 (3) and (4) and section 184 of the law on public housing, etc., see. lovbekendtgørelse nr. 1000 of 9. October 2008, as amended by section 138 of the Act No. 1336 of 19. December 2008 and § 1 of lov nr. 490 of 12. June 2009, fixed: '



2. section 15, paragraph 2 is replaced by the following:

' (2). The maximum amount of acquisition cost per square metre of living space be established for commitments from and with the 1. July 2009 onwards for the areas listed in annex 5. The maximum amount of acquisition cost per square metre of living space be established for commitments from and with the 1. January 2008 up to and including 30 June. June 2009 for the areas listed in annex 6 and for commitments made before 1 May 2004. January 2008 for the areas listed in annex 7. The area is calculated according to the rules laid down in section 18. The maximum amount is adjusted accordingly once a year per 1. January in accordance with the increase in an index, where the increase in the net price index respectively, the increase in the labour cost index for the private sector over a 12-month period, each a weighting of 50% 12-month period ending in september, the net price index for the previous year and for the labour cost index in the private sector in May the previous year. The regulated maximum amount shall be published in the official journal. '

3. In paragraph 15 the following paragraph 3 is added:

' (3). Index adjustment of contract sum, after the expiry of the fixed price can be included in the acquisition cost in addition to the maximum amount provided for in paragraph 1. '

4. Under section 15 shall be inserted:

» § 15 a. For commitments granted as from the 1. July 2009 shall be granted an energy surcharge to the maximum amount of 1,020 € per m2 of living space for multi-storey buildings and 880 € per m2 of living space for low construction (without horizontal apartment divisions). section 15 (2), (3). and (4). paragraph shall apply mutatis mutandis for the regulation of energy complement.

(2). Commitments announced in the period from the 1. July 2009, and until a new building regulations come into force shall comply with the power consumption requirements for low energy buildings class 2 in building regulations 2008.

(3). The Municipal Council may, in respect of commitments granted as from the 1. July 2009 up to and including the 1. October 2009 dispensers for energy requirements as referred to in paragraph 1. paragraph, in the case of continued construction, or where omprojektering give rise to significant additional costs. There shall not be an energy surcharge for commitment after 1. paragraph. '

5. section 16, paragraph 2 is replaced by the following:

' (2). Each home's area may not exceed 115 m2. '

6. Chapter 6 is repealed.

7. section 30, paragraph 3, are repealed.

8. section 52 (6), is repealed.




Paragraph 7 becomes paragraph 6



9. In section 54 shall be replaced by ' section 52, paragraphs 3, 4 and 7 ' to: ' section 52, paragraphs 3, 4 and 6 '.

10. paragraph 65, paragraph 2 is replaced by the following:

' (2). Housing contribution constitutes a fixed amount per m2 gross floor area of the property. The contribution shall be granted for the first time 3 months after the recording. For youth housing covered by the commitments announced in the period from the 1. January 1997 up to and including 30 June. June 2009 adjusted contribution once a year per 1. January with 75 per cent of the increase in the net price index. For youth housing covered by the commitments granted after 30 June. June 2009 adjusted contribution once a year per 1. January in the first 20 years after the recording with the increase in the net price index and then with 75 per cent of the increase in the mentioned index. '

11. Annex 5 shall be replaced by Appendix 1 to this notice.

12. Annex 6 shall be replaced by Annex 2 to this order.

13. Annex 7 shall be replaced by Annex 3 to this order.

§ 2

The notice shall enter into force on the 1. July 2009.
