Law amending the law on the State educational support (SU-law)

(Scholarship for certain learners under the age of 18, automatic control of residence, etc.)

WE, MARGRETHE the SECOND, by the grace of God Queen of Denmark, do indeed:

The Danish Parliament has adopted and we know Our consent confirmed the following law:

§ 1

The law on State educational support (SU-law), see. lovbekendtgørelse nr. 661 of 29. June 2009, is amended as follows:

1. In article 2, paragraph 1, no. 3, 18 years, ' is inserted after ': ' without prejudice to article. However, paragraph 3 of this article, '.

2. In article 2, paragraph 2, shall be inserted after ' year ': ' without prejudice to article 18. However, paragraph 3 '.

3. In paragraph 2 shall be inserted after paragraph 2 as new paragraph: "(3). The provisions of paragraph 1, nr. 3, and paragraph 2 shall not apply for learners who are seeking scholarship, see. § 7 (1) (8). 1, to education, giving the right to training aid within the cut card, see. § 15. '




Paragraph 3 becomes paragraph 4-8-9.



4. In article 2, paragraph 6, there will be (7), the words ' without prejudice to article. paragraph 4, or punishment execution, see. (5) ' is replaced by: ' without prejudice to article. paragraph 5, or punishment execution, see. (6) '.

5. In article 2, paragraph 7, which becomes paragraph 8, the words ' without prejudice to article. (4) ' is replaced by: ' without prejudice to article. paragraph 5 '.

6. In section 2, paragraph 8, which becomes paragraph 9 shall be inserted after ' other special relationship ': ', and if the educational institution has organized a prolonged vacation period in a support eligible training courses that the students do not meet the conditions laid down in paragraph 1, no. 2, in this holiday period '.

10. section 38 c, paragraph 3, shall be repealed, and replaced by: ' (3). The learners are not allowed to request payment of the amount referred to in paragraph 1, have been released to outline, in periods when the learners

1) is enrolled in an education that provides the right to education grants, but has a leave of absence from the training,

2) is enrolled in an education that provides the right to education grants, but not Studio asset, or

3) not enrolled in and go through a training which confer the right to training aid.

(4). Amount referred to in paragraph 1 that are available, but not paid, lapses in support of the year. '




Paragraph 4 becomes paragraph 5.



11. In paragraph 38 (c), paragraph 4, which will be the fifth paragraph shall be inserted as 2. item:




' The Minister may also establish rules on cases in which learners in paper form can submit a cashout request. '



12. section 38 d (2), shall be repealed, and replaced by: ' (2). The learners, however, have no access to request payment of the amount referred to in paragraph 1, have been released to outline, in periods when the learners

1) is enrolled in an education that provides the right to education grants, but has a leave of absence from the training,

2) is enrolled in an education that provides the right to education grants, but not Studio asset, or

3) not enrolled in and go through a training which confer the right to training aid.

(3). Amount referred to in paragraph 1 that are available, but not paid, lapses in support of the year. '




Paragraph 3 becomes paragraph 4.



13. In paragraph 38 (d), paragraph 3, which becomes paragraph 4, insert as 2. item:




' The Minister may also establish rules on cases in which learners in paper form can submit a cashout request. '



14. In section 39 shall be inserted after paragraph 1 as new paragraph: "(2). Agency can without consent to use for checking if the trainees are from the parental home, see. § 8, paragraph 3, and the rules laid down pursuant to § 8, paragraph 4, nr. 1, collect information from the Central Person register if the applicant's education and his parents ' registration of place of residence. This information can be cross-referenced and combined with the Agency's information on the allocation of aid, with the aim to verify whether the aid is granted with the proper rate. '




Paragraph 2-9 becomes paragraph 3-10.



15. In article 39, paragraph 5, which becomes paragraph 6, shall be replaced by ' article 2, paragraphs 4 and 5 ' to: ' section 2, paragraphs 5 and 6 ".

16. In section 39, paragraph 9, which becomes paragraph 10 shall be replaced by ' paragraphs 1-4 ': ' paragraph 1-5 '.

17. In article 42, paragraph 1, the words ' section 39, paragraphs 1 to 3 of the basic regulation. (9) ' to: ' section 39, paragraphs 1 to 4, of the basic regulation. (10) '.

§ 2

(1). The law shall enter into force on the 1. January 2010.

(2). section 30, paragraph 2 2. paragraph, of the law on State educational support (SU-Act), as amended by section 1, nr. 9, in this law, shall apply to the final allocation of the aid referred to in article 6. SU-Chapter 7, and with support from the year 2009.
