§ 1

Notice no. 45 of 30. January 2008, on the publication of Regulation 2008 (BR08), the following change is made :

1. Appendix 1.3 the text of Annex 1 shall be replaced by this notice.

§ 2

The announcement shall enter into force on the 31. October 2008.

Appendix 1

Recognizer recognition scheme

In Denmark, on behalf of the Enterprise and Construction Authority, Denmark has set out the following rules on the recognition scheme for extras.

§ 1 Recognition

Recognition shall be assigned by decision of the recognition committee referred to in section 2.

For the award of recognition, at least 2/3 of the recognition committee shall be in favour of the award.

In cases where the recognition committee denies an applicant for recognition, the recognition committee shall be obliged to inform the person concerned.

Such notification shall contain information on :

the reasons for the refusal of the recognition committee for the rejection,

the applicant ' s opportunity to give a personal meeting of the recognition committee,

the applicant ' s appeal, cf. § 8.

§ 2 Application of the Recognition Committee

In order to carry out the tasks specified below, a committee of nine members shall be set up for four years at a time.

The Recognition Committee shall be chosen as follows :

3 members shall be designated by the Office of the Vocational and Construction of staff in the relevant research and educational establishments.

2 members shall be designated by the Association of Consultative Engineers.

2 members shall be designated by the local authorities ' Rural Development.

One member is appointed by the staff of the staff of the staff.

1 member shall be appointed by Danish Construction.

The Recognition Committee shall elect its chairman of its own centre.

section 3 Rules for the award of recognition to persons trained in Denmark or outside an EU country, EEA country or a country such as the EU has concluded an agreement on the provision of the profession as recognised extras.

A) Civil, College, technical and diplomatic engineers (construction technical direction).

As the basis for the decision of the recognition committee, the following information shall be provided :

1) One of the applicant has submitted itself independently of the project for assessment in the recognition committee. This project must, in the case of size and nature, be the appropriate way to give the impression of the applicant ' s engineering qualifications as a candidate for the applicant ' s knowledge of the building case. The submitted material shall be supplemented by a reference report that explains the static main body of the project. The project must be drawn up in the last three years, and drawings and calculations must be signed by the applicant. The project shall also meet the conditions specified in the ' Instructions for applicants ', drawn up and approved by the Engineer ' s Association in Denmark.

2) A statement by the applicant on the cases to which the applicant has dealt with the processing authorities over the last three years prior to the application for recognition. The applicant must agree that the recognition committee may, where appropriate, seek information on the cases in question in the case of the building authority concerned.

3) Documentation of the applicant for at least the preceding three years preceding the application for recognition has been employed by static calculations and, for at least 1 years, the work in self-employed and responsible manner.

4) A declaration signed by the applicant that the applicant subcasts the provisions of this Regulation, including in particular the provisions relating to the waiver of recognition and liability insurance.

Others

As the basis for the decision of the recognition committee, the following information shall be provided :

1) One of the applicant has submitted itself independently of the project for assessment in the recognition committee. This project must, in the case of size and nature, be the appropriate way to give the impression of the applicant ' s engineering qualifications as a candidate for the applicant ' s knowledge of the building case. The submitted material shall be supplemented by a reference report that explains the static main body of the project. The project must be drawn up in the last three years, and drawings and calculations must be signed by the applicant. The project shall also meet the conditions specified in the ' Instructions for applicants ', drawn up and approved by the Engineer ' s Association in Denmark.

2) A statement by the applicant on the cases to which the applicant has dealt with the processing authorities over the last five years prior to the application for recognition. The applicant must agree that the recognition committee may, where appropriate, seek information on the cases in question in the case of the building authority concerned.

3) Documentation of the applicant for at least the preceding five years preceding the application for recognition has been employed by static calculations, and for at least two years the work in self-employed and responsible manner.

4) No engineers who are not trained as structural engineers in a foreign colleges whose training in this field is recognised by the Engineers ' Association in Denmark must also declare in writing to submit a test to be used as a device ; by the recognition committee. The purpose of the test is to establish that the applicant is also personally able to practice within the area, to which the applicant has a theoretical basis for the calculation of the design of the equipment corresponding to the requirements of construction engineers, trained in the Danish structural engineering training programmes for civil or diplomas.

5) One of the applicant has signed a declaration that the applicant shall submit to the provisions of this Regulation, including in particular the provisions relating to the withdrawal of recognition and liability insurance.

It shall be the responsibility of the recognition committee to review and assess the information referred to above and on the basis of such information and on the basis of any conversations and tries to decide on the granting of recognition.

Allocation of recognition shall be granted for five years. For the renewal of recognition after the end of the five-year period, they are normally ignored from under the furtive act. A), paragraph. 1) and 2) as well as furtive. (b) (b) 1) and (2). However, the Recognition Committee may also require such information in the context of renewals. In the event of a loss of recognition later, the recognition committee shall decide which of the information the recognition committee wishes to make for a decision on the resumption of the information.

Section 4 Temporary and occasional exercise of the profession as recognised extras

The recognition committee shall keep a register of persons established as recognised extras in another EU country in an EEA country or in a country with which the EU has concluded agreement on the exercise of the profession of recognised extras, and which has notified to the recognition committee that they intend to provide the services as recognised in this country temporarily and occasionally to provide services as recognised in the country. the law of access to the practice of certain professions in Denmark. The register shall include the name, address and title or professional qualifications of the person concerned.

Such persons shall submit a written notification to the recognition committee before they provide services as recognized for the first time. The notification shall contain information on the contract of insurance or other personal or collective protection in the context of business responsibility.

The first time the service provider wishes to provide services as recognized in this country, or whose substantive circumstances are altering to the service provider, the following information shall be communicated to the recognition committee :

1) documentation of the nationality of the service provider ;

2) a certificate of attestation that the service provider is legally established in a Member State to exercise as a recognised extractions in a Member State and that, at the time of the certification of the attestation, it is not prohibited by him to exercise this undertaking, either : temporarily,

3) Proof of professional qualifications,

4) any form of proof that the service provider has exercised the company concerned for at least two years during the last 10 years if acquired or training is not legally regulated in the home Member State of the person concerned.

Notification of the recognition committee shall be renewed once a year if the notifier intends to maintain the possibility of a temporary and occasional service provider as a recognised extractor in this country during the year in question.

The recognition committee may control the professional qualifications of the service before the first time the profession shall exercise as a recognised statiker. In that case, within one month of notification, the recognition committee shall inform the person concerned of the result of the checks, or, in the event of difficulties, the reasons for the delay and the time frame of a decision. The Recognition Committee shall have taken a decision within two months of receipt of the complete documentation.

If there is a significant difference between the professional qualifications of the service provider and the level normally required to be recognised, the recognition committee shall give the relevant option to comprise an aptitude test.

People included in the register shall have the right to use the title recognised as an extras and provide services as such in this country.

The Recognition Committee may exchange information with other competent authorities in another EU country, in an EEA country or country which the EU has concluded agreement on access to the profession of the profession recognised as a recognised statiker :

1) persons established and registered as recognized extractions in this country and which intend to provide services in another EU country, in an EEA country or country which the European Union has signed up to, in a country or in a country with which the EU has entered into an agreement on access to the exercise of the profession as recognised extras, and

2) persons established in a corresponding occupation as a recognised statiker in another EU country, in an EEA country or country of which the EU has concluded an agreement on the exercise of the profession of recognised extractions, and which will be temporarily suspended or occasional services here in the country.

The competent authority shall, in this notice, be deemed to be the authority which administers the profession as a recognised statiker of the country in question.

§ 5 Fixed creation as recognised extras

Persons who are in possession of a course or training certificate, as in an EU country, an EEA country, or in a country with which the EU has concluded agreement on the exercise of the profession as recognised, an occupation gives access to the profession of profession as a profession, recognised extras, may be authorised to exercise the profession on an equal footing with persons recognised as a statistical person on the basis of section 3, provided that the course or training certificate meets the following conditions :

1) it shall be issued by a competent authority of the country of origin designated in accordance with the laws, regulations or administrative provisions of the country of origin, and

2) it shall certify that the person concerned has professional qualifications corresponding to the level immediately preceding what is required in section 3.

Permission to be employed on an equal footing with an accredi-recognised extras in accordance with section 3 may also be granted to the country of an EEA country or a country to which the EU has concluded agreement on the exercise of the profession of the profession of an EEC country, an EEA country, or in a country with which the European Union has been awarded the profession of a recognised statistical ; a full-time basis has exercised the profession of a recognised extras in the country of origin for two years in the course of the preceding 10 years, where acquired by a recognised statistical is not regulated in the country of origin, and if the applicant is in possession of one or more ; course-or training certificates which meet the following conditions :

1) they must be issued by a competent authority of the country of origin designated in accordance with the laws, regulations or administrative provisions of the country of origin, and

2) they shall certify that the person concerned has professional qualifications, which are at least equivalent to a level required in section 3, and

3) they shall certify that the holder is prepared to carry out the profession in question.

The application for authorisation shall be submitted to CIRIUS, which is a management board under the Ministry of Science, Technology and Development, cf. the law of access to the practice of certain professions in Denmark.

Section 6 Language Compees

Persons covered by Section 4 and Section 5 must be in possession of the language skills necessary to enable the profession as a recognised statiker in Denmark.

The recognition committee may, when deemed necessary, control the language skills of these persons.

Section 7 Departure of recognition

The recognition committee may, where the report by the building authority or in any other way draws attention to significant deficiencies in the projects of a recognised statiard, deduction from this recognition.

In such cases, the recognition committee shall be obliged to notify the person concerned in advance of the decision to be taken away from that decision.

Such notification shall contain information on :

the grounds for acknowledgement of the acknowledgement of the recognition of the authorization,

-that the person concerned has the right to prior decision, to give a personal meeting of the recognition committee,

-that deprivation of recognition can be taken to the Engineers ' Association in Denmark's

Executive Board, cf. § 8.

When an engineer has been deprived of the recognition as an extras, they may be given the earliest possible time.

recognition again after 3 years and, following the same procedure as at the first application, cf. § 3.

§ 8 Anke

The decision by the Recognition Committee to refuse or deny a recognition may be made by the institution concerned of the Danish Executive Board of the Danish Board of Directors.

In the case of such an appeal, the person concerned may submit its opinions in writing and shall be entitled to submit his case personally to the Executive Board personally.

9 Limitation Insurance

Recognition may be used when it is documented in respect of the recognition committee that the extras are assured of the fulfilment of responsibility as a consultative engineer in the area concerned. The insurance sum shall be at least equivalent to the mandatory collective liability insurance for advisory engineers by the Uni-Consultative Engineer.

§ 10 Use of recognition

In requests for the building permit, where the accredited statiker of the building regulation is involved, the statement of static documentation, annexes and external calculation contributions, must be signed by the recognised extras personally, and the accredited Member shall certify, with his signature, that the extras with the care required by the task have checked that the account of the corresponding Annexes is carried out in accordance with the requirements in force.

In the case of buildings where a possible failure poses a high risk of injury or resulting in serious social consequences, the recognised statistical shall be accompanied by the documentation of his professional competence in relation to the nature of the task. Alternatively, the extras must obtain specialist knowledge.

~ 11 Fees ~

For the purposes of administering the costs of administration, the applicant shall pay a fee as well as the award of recognition as in terms of renewals. The amount of fees shall be fixed by the Executive Board of the Danish Executive Board on the recommendation of the recognition committee.

The amount of fees shall be fixed in such a way that the scheme may be able to rest in its own way, so that the charge does not exceed the actual costs incurred. The size of the goat must not be so high that this implies indirect discrimination. In addition, the size of the fee may not prevent any accreditation of any accreditation, just as the fee shall reflect the cost of actual handling of the actual application.

§ 12 Reglernes adoption
