Ordinance amending Ordinance on the breeding of ratite birds 1)

§ 1

In executive order No. 192 of 25. March 1998 on breeding of ratite birds, as amended by Decree No. 334 of 10. June 1998 and Decree No. 16 by 8. January 2007, shall be amended as follows:

1. As a footnote to the notice title shall be inserted: ' 1) Ordinance contains provisions implementing parts of a European Parliament and Council Directive 2005/36/EC of 7. September 2005 on the recognition of professional qualifications (Official Journal No. L 255, p. 22). '



2. The introductory part shall be replaced by the following: ' in accordance with sections 4 and 5, section 13, paragraph 2, article 14, paragraph 1, article 15, section 16, paragraph 2, § 53, § 67 and section 70 (3) of law No. 432 of 9. June 2004 on the keeping of animals shall be determined as follows: '



3. In article 2, paragraph 1, the words ' Veterinary and Food Directorate ': ' food region '.

4. In article 2, paragraph 2, the words ' Veterinary and Food Directorate, Rolighedsvej 25, 1958 Frederiksberg C ': ' food region '.

5. In article 2, paragraph 3, the words ' Veterinary and Food Directorate ': ' food region '.

6. In section 3, paragraphs 1 and 3, the words ' Veterinary and Food Directorate ': ' food agency '.

7. In paragraph 3 is inserted as paragraphs 4 and 5:

' (4). Exempted from the requirement referred to in paragraph 1 are individuals who can demonstrate that, during the last 10 years from the filing date has been in charge of the operation of a breeding of ratites, referred to in § 1, paragraph 1, for at least 2 years.

(5). The requirement referred to in paragraph 1 may be waived in the case of additional persons, as





1) is recognised pursuant to the Ordinance on the recognition of professional qualifications within the breeding of foxes, feathered, cervids and ratites, or

2) temporarily or occasionally responsible for the operation of a breeding of ratites in accordance with Ordinance on the recognition of professional qualifications within the breeding of foxes, feathered, cervids and ratites. '





8. In section 4, paragraph 5, the words ' Veterinary and Food Directorate ': ' food agency '.

9. In article 18, paragraph 1, the words ' Veterinary and Food Directorate ': ' food region '.

10. section 19 is replaced by the following: ' § 19. The region's food costs for the registration of a facility with the breeding of ratites and supervision of this paid pursuant to executive order on payment for the control of food and live animals, etc. '

11. Article 20, paragraph 1, is replaced by the following: ' With fine punished anyone who violates section 2, section 3, paragraphs 1-2, section 4, paragraphs 1 to 4, §§ 5-10, section 11, paragraph 1, §§ 12-13, article 14, paragraph 1, and §§ 15-17. '

12. In section 20 shall be inserted after paragraph 1 as new paragraph: "(2) the penalty can rise to imprisonment for up to 2 years, if it knows the action or failure occurred violations are committed with intent or gross negligence, and there in the infringement is





1) caused damage to human or animal health or caused danger therefor, or

2) achieved or intentional obtained a financial benefit for the person himself or others, including savings. '








Paragraph 2 becomes paragraph 3.



13. In article 21, paragraphs 1 and 2, the words ' Veterinary and Food Directorate ': ' food region '.

§ 2

The notice shall enter into force on the 15. December 2008.
