Annunciation of the announcement of oyster fishing in Limfjorden

§ 1

Notice no. 831 of 26. In August 2005 on oyster fishing in Limfjorden, the following changes are made :

" In accordance with section 30, section 32, paragraph. Paragraph 1, section 34-36, section 130, paragraph 1. 2, 4 and 6, in the law of fishing and fish farming, cf. Law Order no. 372 of 26. April 2006, as last amended by law no. 317 of 31. March 2007, and after authorisation :

2. § 3 ITREAS :

" § 3. The Fisheries Directorate may grant permission for Baltic fishing in the Limfjorden to owners of vessels which, in 2006 or 2007, had authorised Baltic fishing activities in the Limfjorden with other vessels other than those referred to in Section 2 and which have carried out fishing activities in accordance with the permit. The authorisation may be issued to fishing with the vessel to which fishing has been carried out so far.

Paragraph 2. Furthermore, the Fisheries Directorate may permit an owner of a vessel to which the vessel has operated a documented fishing activity in the Limfjorden for the last four calendar years (1 January to 31. in December) prior to the date of the application, fishing exercises for oysters in the Lima Order.

Paragraph 3. Granting of authorization pursuant to paragraph 1. 2 assumes that :

1) the length of the vessel does not exceed 15 metres ; and

2) the value of the vessel ' s recorded landings on fishing in the Lima has done at least 200 000 DKK. in each calendar year in the 4 year period.

Paragraph 4. In the value of the landings of the vessel, cf. paragraph 3, 2) the value of landings that may be applied to illegal fishing by :

1) Final sentence.

2) Adopted Boodeforing.

3) Attached confistion-enotable.

4) Finally, a decision on the administrative detention of fishing law pursuant to section 37 of the fisheries law. `

3. § 4 ITREAS :

" § 4. The Directorate-General may authorise the authorisation of the fishing industry, which in 2006 or 2007, for the use of hatched fishing activities, which have carried out fishing activities in accordance with the authorisation, exercise of oyster fishing in the fishing industry in the case of the fishing industry in the Community ; Limfjorden in accordance with paragraph 1. 2. A permit may be granted only to the use of the vessel that has been used up to now.

Paragraph 2. Fishing activities carried out in accordance with the authorisation laid down in paragraph 1. 1, must be carried out by means of an instrument which satisfies the following conditions :

1) The frame of the handout must be of iron and in a circular shape with a diameter of not more than 40 cm.

2) The bar on which the iron frame is attached shall have a maximum length of 5 m.

Paragraph 3. In the course of fishing activities carried out in accordance with the authorization provided for in paragraph 1. 1, the tool must be constantly kept and the vessel must not be powered by engine power. `

4. § 5 ITREAS :

" § 5. An owner or medejer of one or more vessels authorised for oyster fishing in the Limfjorden may not obtain more authorisations for Baltic fishing in the Limfjorden than the one in question in 2006 or 2007.

Paragraph 2. For a vessel authorised for the purpose of a hand-fault fishing vessel, an authorization is granted for osterfishing in accordance with section 3 if the conditions of this provision are met. It is a condition for the authorisation of Article 3 that all authorisations for fishing with the hand-fault fishing for vessels the owner or part owner of, at the same time, are abandoned. ` ;

5. § 6 ITREAS :

" § 6. The Directorate-General may authorise the replacement of vessels for vessel owners authorised for Baltic fishing in accordance with sections 2 and 3, provided that the owner has acquired a vessel for the replacement of the vessel that has been issued for authorization ; to ester-fishing, provided that the length of the vessel shall not exceed 12 m. However, the Fisheries Directorate may, in exceptional cases, allow a vessel to be replaced by a vehicle with a length of up to 15 m.

Paragraph 2. The Directorate-General may allow an owner to acquire a vessel for the replacement of a vessel to which, in 2006 or 2007, authorisation is granted for the fishing of oysters with hand-protrades, cf. section 4, provided that the length of the vessel acquired everywhere does not exceed 8 m. ` ;

The announcement will enter into force on the 25th. January 2008.
