Executive order amending Executive order on direct payments to farmers in accordance with the single payment scheme 1)

§ 1

In executive order No. 1598 by 19. December 2007 on direct payments to farmers in accordance with the single payment scheme shall be amended as follows:

1. Footnote to notice the title is replaced by the following: ' the Ordinance contains provisions which are necessary for the application of the following regulations: Council Regulation (EC) No 1782/2003. 1782/2003 of 29. April 2008, Commission Regulation (EC) No 1782/2003. 795/2004 of 21. April 2004 on detailed rules for the application of the single payment scheme in Council Regulation (EC) No 1782/2003. No 1782/2003 establishing common rules for the schemes under the common agricultural policy for direct aid and establishing certain support schemes for farmers, as last amended by Commission Regulation (EC) No 1782/2003. 319/2008 of 7. April 2008, and Commission Regulation (EC) No 796/2004 of 21. April 2004 laying down detailed rules concerning cross-compliance, modulation and the integrated administration and control system provided for in Council Regulation (EC) No 1782/2003. No 1782/2003 establishing common rules for the schemes under the common agricultural policy for direct aid and establishing certain support schemes for farmers, as last amended by Commission Regulation (EC) No 1782/2003. 319/2008 of 7. April 2008. The notice is included in certain provisions of the aforementioned regulations. According to article 249 of the EC Treaty where a regulation is directly applicable in each Member State. Version of these provisions is thus entirely justified in practical terms and shall not affect the validity of the said regulations look in Denmark. '



2. section 4, paragraphs 2 and 3, shall be replaced by the following: ' (2). In 2008 used about 26 per cent of the annual compensation for a temporary General sugar addition.

6. section 15 is replaced by the following:

7. section 19 is replaced by the following:

» § 19. An area in which there have been forest or non-eligible permanent crops can only serve as a basis for the payment of aid, if the roots are removed before the beginning of the calendar year, which sought support for the area, so that ploughing of the land can be. 8. In section 30 shall be added as paragraph 2:

9. section 32 shall be replaced by the following:

» § 32. 10. section 33 shall be replaced by the following:

The notification shall be the Directorate not later than on the expiry of the deadline laid down in paragraph 2 in the calendar year in which the acquirer will use the transferred payment entitlements in an application under section 2.

(2). If the transferor and acquirer wants to change the end date for a temporary transfer of payment entitlements to which they have previously informed, the Directorate of this must be done on a special form, which can be obtained in the Directorate-General or via the DG's website. The notification shall be the Directorate not later than on the expiry of the deadline provided for in section 2 of the calendar year, if a change of the date shall have effect for the application year.

(3). If the Directorate receives notification of a transfer or modification of the end date of a temporary transfer after the expiry of the deadline, but before the expiry of the deadline for making changes to the application, the parties may by a modification of the applications indicate that the payment entitlements shall be added to the acquirer, and that they be deleted from the application of the person selling the application, if they were covered by this. '

11. In section 34 is inserted as paragraph 2:

' (2). The inspection authority may carry out checks on holdings, which sought support, regardless of whether all or part of the holding is transferred after submission of the aid application. "

§ 2

The notice shall enter into force on 23 March. April 2008.
