Act amending the Act on the prohibition of commercial imports and production of and trade in fur and fur products from dogs and cats
(Punishment for violation of EU rules on the prohibition of the placing on the market, etc. of fur from dogs and cats)
WE, MARGRETHE the SECOND, by the grace of God Queen of Denmark, do indeed:
The Danish Parliament has adopted and we know Our consent confirmed the following law:
In Act No. 390 of 28. May 2003 prohibiting commercial importation and production of and trade in fur from cats and dogs, shall be amended as follows:
1. the title of the Act is replaced by the following: ' law on the prohibition of the placing on the market, etc., as well as the import and export of cat and dog fur or fur products and cats '
2. section 1, paragraph 1 is replaced by the following: "it is prohibited to introduce commercially, producing and trading with other cat and dog (Canis lupus familiaris) and cats (Felis silvestris) than the fur pelts and fur fur products covered by European Parliament and Council regulation on the prohibition of the placing on the market and imports into and exports from the community of fur from cats and dogs and products containing such fur. '
3. paragraph 2 shall be replaced by the following: ' article 2. Unless a higher penalty is inflicted for other legislation, is punishable by a fine anyone who violates:
1) § 1, paragraph 1, or
2) article 3 of the European Parliament and of the Council regulation on the prohibition of the placing on the market and imports into and exports from the community of fur from cats and dogs and products containing such fur.
(2). Experiments on offences covered by paragraph 1 is punishable.
(3). Is the infringement committed intentionally or by serious negligence, the penalty under aggravating circumstances increase to jail for 4 months.
(4). In regulations issued under section 1, paragraph 2, may be fixed penalty of fine or, under aggravating circumstances and when the violation has been committed intentionally or grossly negligently, jail until 4 months.
(5). That can be imposed on companies, etc. (legal persons) criminal liability in accordance with the provisions of the criminal code 5. Chapter. '
The law will enter into force on 31 December 1996. December 2008.
