Decree on support measures for improving general conditions for the production and marketing of biavlsprodukter1)

Under text annotation nr. 143 to section 24 of the Finance Act for 2008 shall be determined pursuant to the authority:

§ 1. This notice relates to the measures for improving general conditions for the production and marketing of apiculture products. It includes projects that have been approved for Denmark under the European Community programme for apiculture products, and for which the aid may be granted.

(2). Aid may be granted only for projects which fall within the following measures:

1) technical assistance to beekeepers and groupings of beekeepers.

2) control of varroasis.

3) Rationalization of movements of beehives.

4) measures to support laboratories carrying out analyses of the physico-chemical characteristics.

5) Cooperation with specialised bodies for the implementation of applied research programmes on beekeeping and apiculture products.

6) measures to support the restocking of hives in the community.

§ 2. Directorate-General for the Food Profession shall take a decision in accordance with this Ordinance.

(2). Directorate-General for Food Business shall carry out administrative checks in accordance with this Ordinance.

(3). The Danish plant Directorate carries out the physical on-the-spot checks.

(4). The grant recipient must, in the context of the referred to in paragraphs 2 and 3 control provide the necessary guidance and assistance in the implementation of controls, including showcase sites where project activities take place, and, upon request, disclose or submit accounting material, etc.

§ 3. Application for a grant under a program, see. § 1, must be submitted to the Directorate of Food Business by 1. March of the year in which the program begins.

(2). The eligible measures, laid down for each year of the project period in accordance with the approved project, to be implemented in the project at the earliest from 1. September and be fully implemented by 31 December. August the following year.

§ 4. Request for payment of the aid shall be submitted to the Directorate-General for the Food Profession on a special application form.

(2). Request for payment of the aid and the project report must be received no later than the 15th of the Directorate. September in each year, the project runs according to its approval.

(3). The amount of the aid may be paid as a whole or in up to four installments, each withdrawal request must be accompanied by an auditor's certificate in respect of the costs incurred. The certificate for public institutions concerned can be replaced by a special declaration.

(4). Beneficiary is obliged to keep appropriate accounting material for at least 5 years after the end of the project.

§ 5. The grant recipient must carry out the project in accordance with the approved project description.

(2). Directorate-General for the Food Profession may upon written application may allow a project changes. The change of a project must not commence before the Directorate has granted permission to do so.

§ 6. Directorate-General for the Food Profession may require paid wholly or partly refunded,

1) if the project is not carried out in accordance with the approved application,

2) if the in clause 5 (2) of the said procedure have not been applied,

3) if the beneficiary takes precedence over its obligations under section 2, paragraph 4, or

4) if reimbursement conditions, moreover, are not fulfilled.

(2). By statement of claim attributed to that interest. Interest allowance shall be calculated from the due date for the repayment is done and with the renteloven provided in the reference rate plus. Interest allowance, however, is at least 50 us $.

§ 7. Appeals from decisions under this Ordinance may be submitted to the Minister of food, agriculture and fisheries.

(2). The complaint must be submitted through the Directorate-General for Food Industries. The complaint must be Directorate-General not later than 4 weeks after receipt of the decision the complaint relates.

§ 8. The notice shall enter into force on 18 October. May 2008.

(2). This notice shall also apply to the projects in the programme period 1. September 2007 to 31. August 2010 has been approved for Denmark under the European Community programme for apiculture products.

August 2007. In the notice are included certain provisions of Commission Regulation (EC) No. 917/2004 of 24. April 2004. According to article 249 of the EC Treaty where a regulation is directly applicable in each Member State. Version of these provisions is thus entirely justified in practical terms and shall not affect the validity of that regulation look in Denmark.
