Under section 30, paragraph 1 and 3, § 34, section 63 and section 70, paragraphs 3 and 5 of law No 21/92. 432 of 9. June 2004 on the keeping of animals, as last amended by Act No. 105 of 20. February 2006, lays down the following:

Chapter 1

Scope and definitions

§ 1. This notice applies to herds in which production exceeds an annual average of 500 animal units.

(2). The notice shall not, however, crews, which only poultry, fur animals or aquaculture animals.

§ 2. In this notice, the term:

1) ' Herd ' means a collection of animals of the same species, which is linked to a specific geographical location.

2) ' livestock units ': A calculator, which is calculated according to the rules laid down in section 2 of the Ordinance on animal husbandry and land requirements, etc.

3) ' Quarantine Department ' means Premises physically separated from the other rooms on the property. The premises must have a reasonable distance from the premises with animals of species that can be infected with the same livestock diseases.

4)» Team operation ' means the operation of a herd so that animals in pasted over a period of a maximum of 4 weeks in a section of the crew, who are protected from the spread of infection from other animals in the herd. Before inserting a new team animals section is emptied completely, cleaned and disinfected.

5)» Common grass ': A pasture, where agri-food the region has approved the existence of animals of the same species from more than one crew.

Chapter 2

Requirements for infection protective measures in herds with more than 500 animal units

Health advice

§ 3. The crew must be covered by a health-care consultancy agreement entered into with a veterinarian.

Infection protection plan

§ 4. A herd of more than 500 animal units may only be established at a particular geographic location, if the owner or the person in charge of the crew have developed a infection protection plan approved by the article 3, paragraph 1, said veterinarian. Similarly, by extending an existing crew for more than 500 animal units.

(2). Infection protection plan shall include all species of livestock on the crew area and include a plan for the risks that are relevant to the specific crew with regard to prevention of infectious animal diseases, and what infection prevention measures that must be implemented.

(3). Infection protection plan must, at a minimum, address the following elements:

1) crew's geographical position in relation to other crews.

2) delimitation of the crew area, including outdoor areas.

3) supply of animals, feed, bedding, medicine, tools mv, semen. to the crew.

4) Persons access to and in the crew.

5) Prevention and protection against rats, mice, birds, and insects and control as necessary.

6) Departure of animals for live use, slaughter or destruction, disposal of urine, fertilizer, products, tools, etc.

7) Critical points of infection protection of the crew, including the particular characteristics of the outdoor production.

8) what are the requirements for infection protection and health monitoring in the supply crews.

9) Documentation of infection protection procedures, including for visitors and health status of supplier's crews and purchased animals etc.

§ 5. Infection protection plan, which must be signed by the owner or the person in charge of the crew and in section 3, paragraph 1, said veterinarian, must be submitted to the food the region.

(2). Food region can within 4 weeks from receipt of infection protection plan to order the owner or the person responsible for the crew to make changes in infection protection plan.

§ 6. The owner or the person in charge of the crew shall comply with infection protection plan.

§ 7. For herds with more than 500 animal units already in operation at the date of entry into force of this order, the owner or the person in charge of the crew by 1. November 2008 have produced an infection protection plan which satisfies the conditions laid down in section 4, paragraphs 2-3, and which is approved by the article 3, paragraph 1, said veterinarian. The provisions of sections 5 and 6 shall apply mutatis mutandis.

§ 8. Infection protection plan must be revised once a year, for the first time no later than 12 months after the entry into service of the crew.

(2). The revised infection protection plan must be approved by the article 3, paragraph 1, said veterinarian, and are submitted to food region. Until this can be done, the existing infection protection plan shall apply.

(3). The provision in section 4, paragraphs 2-3, and sections 5 and 6 shall apply mutatis mutandis for the revised infection protection plan.

§ 9. The at all times approved and signed the infection protection plan must be retained in the herd and whenever food region.

Quarantine and sectioning

§ 10. In kvægsbesætninger calves for fattening must only be inserted if it happens either to a quarantine section for the purpose of migrating to a different barn section no earlier than after three weeks or for a section that is designed and used for team operation.

§ 11. In swine herds must shed section for piglets and slaughter pigs adapted to hold operation in sections of up to 500 m², if the building will be constructed after 1. January 2009.

(2). In herds with Lakes may only happen to pigs a deployment of quarantine Department. Migrating to another barn section shall not be made after three weeks.

Restrictions on the number of suppliers

§ 12. In a continuous 12 month period must in dairy herds of cattle fed in from a maximum of three different crews, see. However, section 14.

(2). Dairy herds must not accept animals from assembly centres.

§ 13. In a continuous 12 month period must in herds with Lakes maximum fed pigs from three different crews, see. However, section 14.

§ 14. Notwithstanding the provisions of article 12, paragraph 1, and section 13 may in the event of redevelopment purchased animals from different herds.

(2). At the time of significant expansion of a herd can Food Agency also under defined conditions allow the purchase of animals from more crews than those referred to in article 12, paragraph 1, and section 13.

Ban on common grazing

§ 15. Animals must not be received from the grass.

Prohibition of certain activities on the property

§ 16. There must not be established slaughterhouse, cutting plant or be processing of by-products pursuant to by-product regulation, including the production of mink feed and petfood or processing of dead animals.

(2). However, this does not apply to biogas plants, if there are taken into account in infection protection plan, and the home slaughter of own animals for use in their own household.

Failure to comply with the infection protection plan

§ 17. Meet the owner or the person in charge of the crew not infection protection plan, can food region in serious or repeated cases require that the crew is reduced to a maximum of 500 animal units.

Chapter 3

Penalty provisions, entry into force and transitional rules

§ 18. With fine punished anyone who violates

1) § § 3-7, section 8, paragraph 1-2, §§ 9-13, section 15 and section 16, paragraph 1,

2) injunctive relief provided under section 5, paragraph 2, and section 17 or

3) conditions laid down pursuant to section 14, paragraph 2.

(2). The penalty can rise to imprisonment for up to 2 years, if it knows the action or failure occurred violations are committed with intent or gross negligence, and there in the infringement is

1) caused damage to human or animal health or caused danger therefor, or

2) achieved or intentional obtained a financial benefit for the person himself or others, including savings.

(3). That can be imposed on companies, etc. (legal persons) criminal liability in accordance with the provisions of the criminal code 5. Chapter.

§ 19. The notice shall enter into force on the 1. June 2008.

(2). The provisions of section 10 and section 11, paragraph 2, however, only have effect from 1 January. June 2010.
