Act amending the Aliens Act

(Improved efficiency and greater flexibility of access to business visa and visit visa)

WE, MARGRETHE the SECOND, by the grace of God Queen of Denmark, do indeed:

The Danish Parliament has adopted and we know Our consent confirmed the following law:

§ 1

In the Aliens Act, see. lovbekendtgørelse nr. 808 of 8. July 2008, as amended by Act No. 431 of 1. June 2008, shall be amended as follows:

1. section 4, paragraphs 4 to 7, shall be replaced by the following: ' (4). The amount referred to in paragraph 2, shall be due and payable if the alien after admission





1) be expelled after chapter 4,

2) submit an application for asylum in Denmark or another Schengen country, or

3) submit an application for a residence permit on a different basis, see. However, paragraph 5.





(5). Notwithstanding paragraph 4, nr. 3, due the amount referred to in paragraph 2, not for payment, if





1) the alien applying for a residence permit pursuant to section 9, paragraph 1, no. 1 or 2,

2) the alien applying for a residence permit pursuant to section 9 (c), paragraph 1, on the basis of such family links referred to in § 9 (1) (8). 1 or 2,

3) the alien applying for a residence permit pursuant to section 9 (c), paragraph 1, in order to study,

4) the alien applying for a residence permit pursuant to section 9 (c) (4)

5) the alien is covered by article 9 a, paragraph 2, no. 1-4 or 6, and apply for a residence permit on this basis or

6) account of the humanitarian nature of the crucial talks.





(6). Paragraph 5 shall not apply where there are specific reasons to presume that the essential purpose of this application is to avoid that the amount referred to in paragraph 2, shall be due and payable, or there are specific reasons to presume that the essential purpose of this application is to extend his stay in this country, and it is obvious that the application cannot lead to the grant of a residence permit.

(7). The Minister for refugees, immigrants and integration shall lay down detailed rules on how financial security in accordance with paragraph 2 shall be made, and for the payment of amounts payable under paragraph 3 and 4. The amount set out in paragraph 2 are established in the 2004 level and be regulated as of 2005 once a year the 1. January after percentage, cf., cf. law on a rate adjustment percentage. '

2. section 4 (c) is replaced by the following: ' article 4 (c). An alien may not obtain a visa under section 4, paragraph 1, in 5 years, if the alien for entry without the necessary permission is staying in Denmark or another Schengen country in addition to the time period that is specified in the visa issued. (3). A foreigner cannot obtain a visa under section 4, paragraph 1, in 5 years, if the alien after admission





1) be expelled after chapter 4,

3) submit an application for a residence permit on other basis, see. However, paragraph 4.





(4). Paragraph 3, nr. 3, shall not apply, if





1) the alien applying for a residence permit pursuant to section 9, paragraph 1, no. 1 or 2,

2) the alien applying for a residence permit pursuant to section 9 (c), paragraph 1, on the basis of such family links referred to in § 9 (1) (8). 1 or 2,

3) the alien applying for a residence permit pursuant to section 9 (c), paragraph 1, in order to study,

4) the alien applying for a residence permit pursuant to section 9 (c) (4)

5) the alien is covered by article 9 a, paragraph 2, no. 1-4 or 6, and apply for a residence permit on this basis or

6) account of the humanitarian nature of the crucial talks.





(5). Paragraph 4 shall not apply where there are specific reasons to presume that the essential purpose of this application is to extend his stay in this country, and it is obvious that the application cannot lead to the grant of a residence permit.

(6). Paragraph 3, nr. 2 shall not apply if the alien has submitted the application for a residence permit pursuant to section 7 in this country and contribute to the enlightenment of the basic regulation. section 40 (1), 1. and 2. point, and after the refusal or drop-out of the application itself or accessories to the outbound flight's departure without delay. '

3. Pursuant to section 4 (c) is added:

» section 4 (d). The Danish immigration service must decide whether to involve a pre-authorisation of a company notified the company in order to receive business visit from aliens from countries subject to the visa requirement, if approval is obtained by fraud, or if the conditions for approval are no longer present. The Danish immigration service may also decide to include a prior approval is granted to a company in order to receive business visit from aliens from countries subject to the visa requirement if the conditions of approval are not complied with. '

§ 2

(1). The law shall enter into force on the 1. Mar 2009, jf. However, paragraph 2.

(2). Aliens Act section 4 (d) as amended by this Act, section 1, no. 3, shall enter into force on the 1. July 2009.

§ 3

The law does not apply to the Faroe Islands and Greenland but may by Royal Decree in whole or in part is implemented in these regions with the variances, as the special Faroese or Greenlandic circumstances warrant.
