Law amending the road traffic law and criminal law

(Stricter penalties for hit and run drivers)

WE, MARGRETHE the SECOND, by the grace of God Queen of Denmark, do indeed:

The Danish Parliament has adopted and we know Our consent confirmed the following law:

§ 1

In the highway code, see. lovbekendtgørelse nr. 1276 of 24. October 2007, shall be amended as follows:

1. section 9 (1) and (2) shall be replaced by the following: ' A road user, with or without own fault will be involved in an accident, should immediately stop.

(2). The road user shall also





1) where possible to provide help to people who may have come to harm,

2) participate in the measures for protection of the traffic, as the accident gives rise to

3) abandon the name and place of residence to another, who is involved in the accident, if this request it,

4) abandon the name and place of residence to the, on whose property or things there has been damage, if this request it,

5) as soon as possible, notify the police if road users have caused not insignificant damage to another person, and

6) as soon as possible, notify the victim or the police, if road users have caused damage to the property or thing and there is no present, which can receive information about the trafikantens name and place of residence. '





2. In paragraph 60 (a), paragraph 1, the words ' section 125 (1) (8). 1-3, 8 or 9.0 ' to: ' section 125 (1) (8). 1-4, 9 or 10, '.

3. In paragraph 60 (a), paragraph 2, the words ' section 125 (1) (8). 7.0 ' to: ' section 125 (1) (8). 8, '.

4. In paragraph 60 (a), paragraph 3, nr. 2, the words ' paragraph 1, nr. 1-3, ' to: ' (1). 1-4 '.

5. In paragraph 60 (a), paragraph 3, nr. 3, the words ' section 125 (1) (8). 1-3, ' to: ' section 125 (1) (8). 1-4, ', and ' section 126 (1) (8). 7 or 9. ' shall be replaced by: ' section 126 (1) (8). 8 or 10. '

6. In article 117, paragraph 2, no. 8, the words ' section 125 (1) (8). 1-4, ' to: ' section 125 (1) (8). 1 and 3-5, '.

7. § 117 (d) is replaced by the following: ' § 117 d. Violation of § 9, paragraph 2, no. 1, are punishable by imprisonment up to 1 year, under mitigating circumstances, however, with fine.

(2). Violation of section 56 (1), article 62, paragraph 1, and section 63 (a) is punishable by a fine or in aggravating circumstances with imprisonment up to 1 year. By measurement of fine for violation of section 56 (1) and section 63 (a) special consideration to the size of an achieved or intended economic advantage. Is the violation of section 56 (1) committed while driving with a vehicle subject to section 43, paragraph 1 or 2, meted out a sharpened fine. '

8. In section 118 (1) (8). 1, § 9, paragraph shall be replaced by ' 2.0 ': ' § 9 (1) and (2). 2-6 '.

9. In paragraph 118, paragraph 2, shall be inserted after paragraph 5, ' ': ' § 9 (1) and (2). 2-6 '.

10. In section 119 (a), paragraph 1, the words ' section 125 (1) (8). 2-8, ' to: ' section 125 (1) (8). 3-9, '.

11. In article 125, paragraph 1, insert after no. 1 as new number:» 2) driver has been guilty in violation of section 9, paragraph 2, no. 1, and in the absence of extenuating circumstances, '

Nr. 2-9 is then no. 3-10.

12. In article 126, paragraph 1, insert after no. 5 as the new number:» 6) has been guilty in violation of Penal Code section 253, paragraph 1, of the basic regulation. paragraph 2.0 '

No. 6-9 is then no. 7-10.

13. In section 126 (1) (8). 6, there will be no. 7, the words ' section 125 (1) (8). 1-8, ' to: ' section 125 (1) (8). 1-9, ', and ' section 125 (1) (8). 5.0 ' shall be replaced by: ' § 125 (1) (8). 6, '.

14. In article 127, 1. paragraph, the words ' section 125 (1) (8). 1-3, 7, 8 or 9.0 ' to: ' section 125 (1) (8). 1-4, 8, 9 or 10, '.

§ 2

In criminal law, see. lovbekendtgørelse nr. 1260 of 23. October 2007, as amended by Act No. 316 of 30. April 2008, is amended as follows:

1. In section 253 is inserted as paragraph 2: ' (2). With imprisonment up to 2 years punished anyone who violates paragraph (1) in connection with the escape from a traffic accident, whereby someone has added significant personal injuries. '

§ 3

The law shall enter into force on the day after publication in the Official Gazette.

§ 4

The law does not apply to the Faroe Islands and Greenland. § 2 may, however, by Royal Decree is implemented for Faroe Islands with the derogations which the special Faroese conditions warrant.
