May 2007, article 19, paragraph 4, and section 37, paragraph 1, of the law on education to the higher commercial examination (hhx) and the higher technical examination (hhx), see. lovbekendtgørelse nr. 446 of 8. in May 2007, as well as section 16, paragraph 4, and section 35, paragraph 1, of the law on education to the higher preparatory examination (hf-law), see. lovbekendtgørelse nr. 445 of 8. May 2007, lays down the following: Chapter 1 meritorious subjects and course section 1. Enelev or student ("student"), who gets the merit in an upper secondary school education, will be exempted from part of the education and apprenticeship and training can also be exempted from one or more samples at the exam.
(2). A school or a course (hereinafter referred to as "the school") must give credit when the school recognises that the pupil before the recording has acquired real professional qualifications, which means that the pupil be wholly or partly has achieved the technical objectives, as set out in one or more subjects in the training, or that the pupil has reached other professional goals, which can take the place of the established objectives.
(3). A student's merit-making vocational qualifications can be obtained by previously carried out training courses in Denmark or abroad at least upper secondary level, through tutorials or in any other way before the recording, see. However, section 7.
§ 2. The school head must assess the student's application meritorious professional qualifications. The school's head shall establish on this basis, the level of education and, where appropriate, the samples, the pupil may be exempted from the regulation. However, section 14.
§ 3. The school head must, on application, give a student merit, which gives relief from teaching and test reporting in subjects (at the A-, B-or C-level) or gradient, which the student has previously completed by a trial or, in the alternative, at a closing stop point character, at equivalent or higher secondary level, where the subjects or courses included or may be included in the relevant training, without prejudice to article fagrække. However, section 14.
(2). The level of the meritorious subjects must be laid down or approved by the Ministry of education. Level term for subjects that are started before the 1. August 2005, can be seen in annex 1 of the Executive order.
§ 4. When a student wants to get a diploma issued together by the trial evidence for individual subjects, etc., section 3 applies accordingly.
§ 5. The school's head may on application grant a student merit, which totally or partially provides exemption for the teaching of subjects or courses that are included in the training (delmerit), if the school determines that the pupil's previous leader acquired skills contributes to the fulfillment of the concerned discipline or gradient goals, see. However, section 14. The pupil shall test in accordance with the rules of the concerned subjects.
(2). Given merit pursuant to paragraph 1, the school's leader can approve that sample by exam to be brought forward in relation to the times laid down in the rules on the training.
§ 6. The school's head may on application grant a student merit, which gives relief from teaching and test in a subject when the learner has previously completed a subject not covered by paragraph 3, at least upper secondary level, or a subject with another occupation or a course that after school's leader's discretion may be substituted for the subject (merit by substitution). The estimate shall be made on the basis of an assessment of whether the meritorious gradient equal contributes to fulfilling the purpose and nature of education.
(2). Merit in accordance with paragraph 1, for compulsory subjects and study retningsfag on A-and B-level in that training be given only if the professional aims and the main content of the meritorious course is comparable to the content and the objectives of the subjects given exemption from.
(3). When a student has gained merit by substitution of one profession on B-or C-level, see. (1), the school's head lay down restrictions on the pupil's possibilities for choosing the profession at a higher level.
§ 7. The school's head may on application grant a student advance approval of merit, which gives relief from teaching at the school for a continuous period of up to one year, if the pupil uses the period to complete upper secondary education abroad.
(2). It is a condition that the school looking for a concrete professional assessment approves subjects range, the goals, the core content and professional levels in the foreign studies. The assessment must take into account that at the end of the period must be given merit after §§ 3, 5 or 6 for the whole period.
(3). The school's leadership as a prerequisite for achieving merit can require that the student while the foreign training course follows the virtual teaching directed by the school in certain subjects and courses.
(4). If the pupil gets commitment to merit, and the school requires that the student follows the virtual teaching in certain subjects, the proportion of virtual teaching in these subjects may exceed the upper limit for virtual training, as laid down in the rules on the training.
§ 8. The school's leader can only derogate from its commitment to merit pursuant to section 7, if the pupil after school's estimate is not adequately has participated in both the teaching, which was a prerequisite for undertaking, and the virtual teaching, as the school has designated learner.
§ 9. The school's head may, on application, give a student who has completed mislaid teaching abroad in accordance with the rules of the education laws of stx, hf, hhx and htx, merit pursuant to section 6.
§ 10. For a pupil, during or in the immediate extension of the basic course in stx, hhx, htx, or switch to another of those courses, the school's leader give the student credit for the completed part of the basic curriculum.
(2). For students who change education and who are not covered by paragraph 1 shall be subject to this order rules, see. sections 3, 5 and 6, concerning the award of merit.
§ 11. Students who have satisfactorily completed a portion of their upper secondary education in one of the other Nordic countries, including self-rule areas covered by the agreement between the Nordic countries Nordic training community on the upper secondary level, have the right to merit pursuant to section 3. Requirement in § 3, paragraph 2, that the meritorious subjects level must be laid down or approved by the Ministry of education, does not apply to these subjects. The level determined on the basis of the school's academic assessment, unless the Ministry of education has approved the subject's level.
(2). The subjects from European Baccalauréat "(EB), International Baccalaureate (IB), Option International du Baccalauréat" (OIB), The Danish/French Baccalauréat "(DFB), Duborgskolen and A.P. Møller School, whose level is approved by the Ministry of education, provides the right to merit pursuant to section 3.
Chapter 2 Consequences of merit section 12. When a student has been approved merit pursuant to section 3 in one profession, have the student is not entitled to participate in the teaching profession, and the student can not as a part of the training to participate in the sample by exam in the subject again.
§ 13. The school's leader can organise special courses for a student who has received a merit, which means that the pupil's overall training time will be significantly shorter than a usual course.
§ 14. A student who has received credit in one or more subjects that are part of the General study preparation in stx-training, in a profession in the hf-programme or in the study area in the hhx-or htx-programme, shall be exempt from not to attend classes in these sequences, see. However, paragraphs 2 and 3.
(2). The student can be exempted from parts of the teaching in a profession or in the study area, if the teaching has single technical nature, or for parts of the teaching in the academic area of the hhx-programme, if the student has completed the international area or business case.
(3). A student who has received credit for all three subjects in a profession on the hf-programme, be exempted from teaching and test of the Faculty group.
Chapter 3 Procedure for the award of merit section 15. The student must seek School of merit by the start of training, see. However, (2) and § 7 and § 9. The student is entitled to a determination of whether and to what extent previously acquired professional qualifications giving merit.
(2). If special reasons for doing so, the school head can deal with an application for credit in the course of the training.
§ 16. The school's head may require that the student return the documentation for the course, which forms the basis for the application of merit, including certificate or proof of teaching, samples or anything else that can demonstrate the particular pupil's professional qualifications.
(2). The school's head may, in accordance with the specific assessment offers the student a test that is part of the basis for the decision on merit. If a student refuses the offer of a test, this is also included in the basis for the decision.
§ 17. A student who applies for credit for teaching and test in a subject where there has been more than 5 years, since the subject was completed with the sample or, in the alternative, by a final stop-point character (final grade), have no claim on merit under section 3. The school's head may, however, give merit after a concrete assessment.
(2). (1) 1. paragraph shall not apply to persons wishing to obtain a diploma of piecemeal try evidence of individual subjects, etc.
§ 18. The school leader's decision on merit must be communicated to the student in writing. If the Manager does not meet the pupil's application fully, must also be reasoned and contain a decision guidance document on the possibility of complaint pursuant to sections 28 and 29.
Chapter 4 Merit in the overall exam section 19. When given credit for one profession under section 3, applied to the pupil's diploma, both written and oral grades, respectively closing stop point grades and test scores according to the rules for the training, to the extent that they are available from the meritorious subjects. On the proof that nature is achieved through merit. Missing one of the subject's characters, is applied to the field of diploma: "Merit without character transfer".
(2). When a written and an oral nature should be transferred as a single character in the subject, transferred the average of the written and oral character, rounded after the ordinary rounding rules.
(3). Is there in accordance with the rules of the meritorious subjects not given sample characters, but only closing stop point grades, transferred these to the new training set, test grades, when the rules for training is provided, to the diploma comprises only the test characters.
§ 20. When given credit for one profession under section 6, the school head can decide that there can be carried over any characters from the meritorious subjects to student's diploma, without prejudice. section 19 of the basic regulation. However, section 21.
§ 21. There can be no character transfer from higher education or from foreign qualifications.
(2). When given merit without transfer of characters, is applied to the field of diploma: "Merit without character transfer".
§ 22. Whenever in the rules for a three-year education is intended, to the students in order to achieve a comprehensive exam must take a certain number of samples, counter samples from the meritorious subjects, see. § 3 and § 6, alone with in the provided sample number, if the student in accordance with the rules for that education, including rules relating to sample extraction, should have been to test in the subjects that have been remitted.
(2). For students who have received credit under section 5, and subsequently must audition in the subject, count the cast-off try alone with in the provided sample number, if the student in accordance with the rules for that education, including rules relating to sample extraction, should have been to test in the subject.
(3). There may be merit without character transfer to an extent corresponding to that diploma must contain characters for at least six courses, three of which must be the subjects from the mandatory fagrække, including any characters transferred by merit.
Chapter 5 Combined programmes § 23. Students who are admitted to the 2-year-old hf in combination with an agricultural education or a maritime education, after school's leader estimates get merit in accordance with the principles in section 6 for subjects on agricultural or maritime training, which can be included in hf as electives.
Chapter 6 upper secondary completion article 24. The school leader's competencies pursuant to this order is carried out in the secondary supplementary system of GS-Coordinator, see. GS-notice.
§ 25. Students at upper secondary supplementary courses (GSK), see. GS-notice, pursuant to section 5 on application, get relief from parts of the teaching in the individual subjects after GS-Coordinator's discretion.
section 26. Students on fagpakke hf (RF +) and on fagpakke hhx, see. GS-notice, pursuant to section 5 on application, get relief from parts of the teaching in the individual subjects after GS-Coordinator's discretion and/or pursuant to section 3 be relieved of teaching and test in a maximum of one of the subjects included in the qualification.
§ 27. Students who are admitted on secondary pathways for refugees and immigrants (GIF), see. GS-notice, the request can gain merit pursuant to section 5 of the individual subjects after GS-Coordinator's discretion and/or merit under section 3 for a maximum of two subjects.
Chapter 7 consumer complaint section 28. A student may refer the school leader's substantive decisions on merit for the qualification board in accordance with the law on the evaluation of foreign educational qualifications etc.
(2). The student can lodge a complaint against the school leader's decisions, see. (1) for the qualification board within 4 weeks after the student has been informed of the decision. The complaint must be in writing and reasoned.
(3). The complaint shall be addressed to the Qualifying Board and sent to the school, which has taken the decision. If the school maintains the decision, sending the complaint to the School Board with a statement of qualifications. The qualification board shall take the final administrative decision.
section 29. A student may appeal to the Ministry of justice issues relating to school the leader's decisions on merit within 2 weeks after the decision is communicated to the student.
(2). The complaint shall be submitted in writing to the school's leadership. If the school's leader insists the decision will forward your complaint to the Ministry of education of the school leader with a statement of the case. Before the complaint is forwarded to the school's leader, give the student the opportunity to within 1 week to comment on the school's leader's statement and submit any comments.
(3). Education Ministry's decision can go out on 1) refusal to further examine the complaint, 2) referral back decision on school, 3) that the complainant not dismissed, or 4) that the complainant gets fully or partially upheld.
Chapter 8 entry into force and repeal rules § 30. The notice shall enter into force on the 1. August 2008.
(2). At the same time repealed Executive Order No. 1458 of 11. December 2007 on merit in the secondary education (merit order).

July 2008 head Torben Christoffersen/Prtk Annex 1 Overview of level names With high school reform of 2003 are all subjects in the upper secondary education in Denmark provided with a level indication, which is used when a student gets credit. Level designation is one of the letters A, B and C, where A denotes the highest upper-secondary level.
The tables on the following pages must be used for the level of classification of subjects from previously existing schemes for secondary education to the extent that the subjects were no level indication.
Attention is drawn at the same time that high school reform is carried out with the following modification of the level descriptions for languages: beginner level start (C) carried out before high school reform gives merit as a beginner at level B, and beginner level B conducted before the high school reform gives merit as a beginner at level a.
When schemas are used in connection with the assessment of an application for credit from the students, who have a right to merit pursuant to section 3, aging requirement in § 17 apply simultaneously.
As an example of schema application, a student who has completed the subject Visual Arts as elective in single subject system in 2003, on application, be entitled to receive credit for the course on B-level in an upper secondary school education, as eleven re-recorded in 2008.
If the previously completed courses have been completed for more than five years ago, the schema can be used by the school's concrete indicative assessment as to whether there may be merit.
