Annex 3 The full text of the ordonnance on pesticide residues in certain foods (fish, baby food, etc.) 1)

Under section 5, paragraph 1, article 49, paragraph 1, § 50 and section 60, paragraph 3 and 4 of law No. 526 of 24. June 2005 on foods shall be determined:

Scope and definition

§ 1. The Ordinance sets maximum residue limits for the allowable content of some pesticide residues in food, as mentioned in the annexes, cf. § 3 (1) (8). 2 and 3.

(2). The notice also applies to foodstuffs referred to in paragraph 1 after incorporation into a compound food see. § 3, paragraph 2.

(3). Foods are referred to as products. The notice shall also apply to the products referred to in paragraph 1 after drying or processing within the meaning of. § 3, paragraph 2.

(4). The notice also includes the products referred to in paragraphs 1, 2 and 3, which are intended for export to countries outside the European Union. The Ordinance shall not apply to vegetable products, if it is established that:





1) country of destination requires that particular treatment in order to prevent the introduction of harmful organisms on its territory, or

2) processing is necessary in order to protect the products against harmful organisms during transport to the country of destination and during storage in this country.





Definition of pesticides and pesticide residues

§ 2. For the purposes of this Ordinance by pesticides active substances which are intended to:





1) protect plants or plant products against all harmful organisms or prevent the action of such attacks,

2) influence the life processes of plants, other than as a nutrient (URf.eks. growth regulators),

3) preserving plants or plant products, in so far as there are no specific provisions concerning the use of such substances as additives, etc.,

4) destroy undesirable plants,

5) destroy parts of plants, or

6) check or prevent undesired growth of plants.





(2). By pesticide residues means residues of the active substances that are subject to the provisions of paragraph 1, as well as active substances, metabolites, degradation and reaction products.

Residual content, etc.

§ 3. Whether the content is derived from a treatment or a pollution, it is forbidden to sell:





1) products that contain pesticide residues, if the content exceeds the in annexes 1 or 2 above are maximum residue levels.

2) products covered by the applicable at any time the Executive order on processed baby food for infants and young children, provided that they contain residues of pesticides in quantities exceeding 0.01 mg/kg, however, see. (3) and (4) of the product in question in the form,





(a)) which they offered ready to be consumed, or

(b)) as they are prepared according to the instructions from the manufacturer.





3) products covered by the applicable at any time the Executive order on infant formulae and follow-on formulae for infants and young children, provided that they contain residues of pesticides in quantities exceeding 0.01 mg/kg, however, see. (3) and (4) of the product in question in the form,





(a)) which they offered ready to be consumed, or

(b)) as they are prepared according to the instructions from the manufacturer.









(2). If there is no fixed a specific MRL for a product in dried or processed state or of a compound food, applies the specified MRL for their raw materials, taking into account the concentration or dilution of the levels of pesticide residues, as is due partly to the treatment and, on the other hand, the relative content of the individual ingredients.

(3). Regardless of the General limit in paragraph 1, no. 2) and 3) you will find in annex 2 specific maximum limits apply to respectively. baby foods and processed cereal-based foods foodstuffs as well as infant formula and follow-on formulae for infants and young children.

(4). Regardless of the General limit in paragraph 1, no. 2) and (3)) shall be subject to a ban on the use of the pesticides specified in annex 3 in agricultural products intended for the manufacture of baby foods and processed cereal-based foods and products manufacture of infant formulae and follow-on formulae for infants and young children.

Criminal and commencement provisions

§ 4. With fine punished anyone who violates § 3 (1) or (4).

(2). The penalty can rise to imprisonment for up to 2 years, if it knows the action or failure occurred violations are committed with intent or gross negligence, and there in the infringement is:





1) caused damage to the health or caused danger therefor, or

2) achieved or intentional obtained a financial benefit for the person himself or others.





(3). That can be imposed on companies, etc. (legal persons) criminal liability in accordance with the provisions of the criminal code 5. Chapter.

§ 5. The notice shall enter into force on the 1. September 2008.

(2). At the same time repealed Executive Order No. 186 of 19. March 2008 on pesticide residues in food.

1) pesticide residues listed in this annex, table 1, are considered not to have been used if their residues do not exceed 0.003 mg/kg. This value, which are considered to be of analytical methods limit of determination, be taken regularly reviewed in the light of technical progress.
