Order No. 11/023 of March 18, 2011, amending and supplementing Decree No. 04/029 17 March 2004 carrying creation and organization of the Programme National Multisectoriel de Lutte against AIDS, in abbreviation "MEKHERIS" the President of the Republic, having regard to the Constitution, as amended by Act No. 111002 20 January 20 it revision of certain articles of the Constitution of a Democratic Republic of the Congo of IS February 2006 , especially in its article 19;
Pursuant to law n ° 08/011 14 July 2008 on the protection of the rights of people living with HIV/AIDS and people infected, especially in its articles 5 and 6;
Whereas the declaration of commitment on AIDS made at I the 26th Special Session of the General Assembly of the United Nations, from 25 to 27 June 2001 devoted to the fight against HIV/AIDS;
Whereas the declarations of Abuja 1 and II on universal access to prevention, treatment, care and support services relating to the fight against AIDS.
Whereas the relevant audit recommendations institutional structures for coordination of the fight against HIV/AIDS to improve the effective and more efficient programme implementation;
Whereas the negative impact of HIV on all sectors of national life and its prevalent on populations of the Democratic Republic of the Congo;
Whereas the need for coordination at the highest level of ' State interventions by all partners in the fight against AIDS and to involve all sectors of national life in a multisectoral and multidisciplinary effort.
Having reviewed Decree No. 04/029 of 17 May 2004 on the establishment and organization of the multi National Programme against AIDS, acronym MEKHERIS;
Having regard to the urgency.
On a proposal from the Minister of health;
The Council of Ministers heard;
DIRECTS: Chapter 1: of General provisions 1 Article the National multisectoral Programme to combat AIDS (MEKHERIS) is a public institution responsible for the fight against AIDS in the Democratic Republic of the Congo.
It is placed under the high authority of the President of the Republic.
It has legal personality.
Article 2: It includes the organs and structures of the fight against AIDS. Its framework is defined in the National Strategic Plan.
Article 3: Organs and structures of the MEKHERIS are:-the multisectoral National Council to combat AIDS (CNMLS);
-The multi Provincial Council the struggle against AIDS (CPMLS);
-The Council Local Multisectoriel de Lutte against AIDS (CLMLS);
-The National Executive (SEN) Secretariat;
-The Executive Provincial (SEP) Secretariat;
-The Local (salt) Executive Secretariat;
-The sectoral committees of fight against AIDS;
-The different structures of implementation of operational plans.
They are defined according to three separate functions:-orientation and decision;
-The coordination and follow-up;
-The implementation.
Chapter II: Guidance and DECISION Article 4 bodies: the orientation and decision-making bodies are:-the multisectoral National Council to combat AIDS (CNMLS) at the national level;
-The multi Provincial Council the struggle against AIDS (CPMLS) at the provincial level;
-The multisectoral fight Local Council against AIDS (CLMLS) at the local level.
Section 1: National Council multisectoral fight against AIDS (CNMLS) Article 5: the multisectoral National Council to combat AIDS, in abbreviation "CNMLS", is the political body orientation and decision-making at the national level.
Article 6: Missions the CNMLS mission is to:-define national policies in the fight against AIDS;
-Mobilize national and international financial resources for the implementation of programmes and monitor their management;
-Provide advocacy and partnership at the highest level in the fight against AIDS;
-Ensure respect regulatory and ethics in the fight against AIDS;
-Ensure respect of the multisectoral approach and the effectiveness of the decentralization of the fight against AIDS;
-Ensure monitoring and compliance with the international commitments of the Republic Democratic of Congo fight against te AIDS.
Article 7: The CNMLS Composition is composed of:-President: the President of the Republic;
-1 St Vice-president: the Prime Minister;
-2nd Vice President: the Minister having health in its attributions;
-3rd Vice-Chair: representing civil society;
-Secretary: the CNMLS National Executive Secretary.
Are members:-1 representative of the Presidency of the Republic;
-1 representative of the Prime Minister;
-Sectoral ministers;
-1 representative of the Minister of the Plan;
-1 representative of the National Assembly;
-1 representative of the Senate;
-Provincial governors;
5 representatives of associations and non-governmental organizations which: 1 representative of the collectives and associations of young people;
1 representative of the collectives and women's associations;
1 representative of people with a disability;
-2 representatives of networks of people living with HIV including one woman;
-5 representatives of religious denominations;
-1 representative of the Armed Forces;
-1 representative of the Police;
-2 representatives of private (including one woman).
The representatives of non-profit associations and non-governmental organizations are nominated by their peers.
Members without voting - the Coordinator of the United Nations (1) system;

Article 8: Personalities recognized expertise and skills in the fight against AIDS may be invited to the sessions of the CNMLS and his Office.
Article 9: Operation and organization a rules of procedure fixes the functioning and organization of the CNMLS.
