Interdepartmental Decree No. 036/CAB/MIN/CA/2011 and No. 309/CAB/MIN/FINANCES/2011 of 22 December 2011 amending and supplementing the Interdepartmental Decree No. 016/CAB/MIN/CA/2008 and No. 277/CAB/MIN/FINANCES/2008 of 29 November 2008 establishing the rates of fees, taxes and royalties to be collected at the initiative of the Ministry

Minister of Culture and Arts and Minister of Finance;

In view of the Constitution, as amended by Act No. 11/002 of January 2011, specifically in its articles 91, paragraphs 6 and 93;

Having regard to the Ordinance-Law No. 87-013 of 03 April 1987, establishing the Cultural Promotion Fund, especially in its article 2;

Having regard to Act No. 004/015 of 16 July 2004 establishing the Nomenclature of Acts Générateurs des Recipes Administratives, Judiciaires, Domaniales et de Participations and their methods of perception, as amended and supplemented by Act No. 05/008 of 31 March 2005;

In light of Act No. 11/11 of 13 July 2011 on public finances;

In view of Decree No. 007/2002 of 02 February 2002 on the method of payment of debts to the State, as amended and supplemented speaks Decree No. 11/20 of 14 April 2011;

Having regard to Order No. 08/073 of 24 December 2008 on the organization and operation of the Government, practical modalities for collaboration between the President of the Republic and the Government and between the members of the Government;

Having regard to Order No. 08/074 of 24 December 2008 establishing the powers of the Ministries;

Having regard to Order No. 11/063 of 11 September 2011 appointing Deputy Prime Ministers, Ministers and Deputy Ministers;

Revued interdepartmental order No. 016/CAB/MIN/CA/2008 and No. 277/CAB/ MIN/FINANCES/2008 of 29 November 2008, setting fees, taxes and royalties to be collected at the initiative of the Ministry of Culture and Arts;

In view of the Ministerial Decree No. CAB/MIN/FINANCES/014 of 05 April 2011 establishing the Commission for the Implementation of the Government Action Plan for the Elimination of Frontier Perceptions;

Having regard to Circular No.002/CAB/MIN/FINANCES/2011 of 10 February 2011 on practical arrangements for the management by provinces of generators attached to their exclusive competences;

Considering the need;

ARRETENT:

Article 1^er:

The fees, taxes and royalties to be collected at the initiative of the Ministry of Culture and Arts are set out in Tables 1 and annexed to this Order.

Article 2:

The amounts collected in accordance with this Order are fully paid to the Treasury account.

Article 3:

The Secretary General for Culture and Arts, the Director General of the Cultural Promotion Fund and the Director General of the DG RAD are responsible, each with regard to it, for the execution of this Order.

Article 4:

Any earlier provisions contrary to this Order that come into force on the date of its signature are repealed.
