Order-Law No. 13/009 of 23 February 2013 amending and supplementing certain provisions of Legislative Order No. 90-046 of 8 August 1990 regulating the Small Trade

President of the Republic,

In view of the Constitution, as amended by Act No. 11/002 of 20 January 2011 on the revision of certain articles of the Constitution of the Democratic Republic of the Congo, especially in its articles 129 and 221;

Having regard to Act No. 13/007 of 22 January 2013 empowering the Government;

Revu l’Ordonnance-loi n° 90-046 du 8 août 1990 portant regulation du Petit commerce ;

Revu l’Ordonnance-loi n° 002/2012 du 21 septembre 2012 modifié et compléter certaines dispositions de l’Ordonnance-loi n° 90-046 du 8 août 1990 portant Règlementation du Petit Commerce ;

On the proposal of the Government deliberated in the Council of Ministers,

ORDIN:

Article 1:

Article 1 of the Ordinance-Law No. 90-046 of 8 August 1990 concerning the regulation of Small Business is amended and supplemented as follows:

“Article 1:

By derogation from the provisions of the Decree of 6 March 1951 establishing the register of trade, the exercise of the Small Business is subject only to the detention of a patent.

For the purposes of this Act, an annual administrative authorization to practise the Small Business must be heard by "patent".

Subject to the requirements set out below, the exercise of the Small Trade is not subject to the obligation to hold all trade books provided for in the Decree of 31 July 1912 on trade books. »

Article 2:

Article 12 of the Ordinance-Law No. 90-046 of 8 August 1990 concerning the regulation of Small Business is deleted.

Article 3:

Any earlier provisions contrary to this Order shall be repealed.

Article 4:

This Ordinance comes into force as soon as it is published in the Official Gazette and applies as of January 1, 2013.
