GOVERNMENT REGULATION



of 8 March. March 2017



establishing certain conditions for the granting of aid for the supply of

fruits, vegetables, milk and products made from them into schools and amending certain

related government regulations



The Government ordered pursuant to section 2b, paragraph 1. 2 of law No 249/1997 Coll., on

Agriculture, as amended by Act No. 128/2003 Coll., Act No. 441/2005 Coll. and

Act No. 291/2009 Coll., and pursuant to section 1 (1). 3 of Act No. 256/2000 SB., about

The State agricultural intervention fund and amending certain other

laws (the law on the State agricultural intervention fund), as amended by

Act No. 128/2003 Coll., Act No. 441/2005 Coll. and Act No. 179/2014

Coll.:



PART THE FIRST



Determination of some of the conditions for the granting of aid for the supply of fruit,

vegetables, milk and products made from them in schools



§ 1



The subject of the edit



This regulation lays down further to the directly applicable provisions

The European Union ^ 1) conditions for the grant of



and) the supply of fruit, vegetables and products from fruit and vegetables to pupils

primary schools, including preparatory classes of primary schools or

the preparatory grade of primary schools special ^ 2) (hereinafter referred to as "project

Fruit and vegetables to schools "),



(b)) and the supply of milk to milk products to pupils in primary and secondary schools,

including preparatory classes of primary schools or preparatory degree

elementary school special ^ 2) (hereinafter referred to as "the school milk project") and



(c)) the accompanying training measures,



(hereinafter referred to as "school project").



§ 2



Purpose of the aid



(1) the aid referred to in paragraph 1 shall be granted for the following products:



a) fresh fruit and vegetables, packaged fresh fruit and vegetables or

cut fresh fruit and vegetables, which are listed in sections IX and

XI of annex I to regulation of the European Parliament and of the Council (EU) no 1308/2013, in

as amended,



b) packaged fruit and vegetable juices and fruit purees that are

listed in part X of annex I to regulation of the European Parliament and of the Council (EU)

No 1308/2013, as amended, if it does not contain preservatives,



c) drinking milk and its variants with reduced lactose content,



d) unflavoured milk products referred to in article 3(1). 23 para. 4 (b). (b)) of regulation

The European Parliament and of the Council (EU) no 1308/2013, as amended, that

may contain added substances referred to in article. 23 para. 6 the second subparagraph

European Parliament and Council Regulation (EU) no 1308/2013, as

amended, and in accordance with the limits for salt and fats referred to in the Decree No.

282/2016 Coll., on requirements for food, for which it is permissible

advertising and which can be offered for sale and sold in schools and educational

devices, and the quantity of added sugar is equal to zero, and



e) flavored milk products referred to in annex V to the regulation of the European

Parliament and of the Council (EU) no 1308/2013, as amended, which may

contain added substances referred to in article. 23 para. 6 the second subparagraph

European Parliament and Council Regulation (EU) no 1308/2013, as

amended, and in accordance with the limits for salt, fats and sugars as referred to in

Decree No 282/2016 Sb.



(2) the aid is in addition to the products referred to in paragraph 1 shall be provided in

the scope of a directly applicable regulation the European Union ^ 3) on this

accompanying training measures:



a) great for fruit and vegetables, fruit and vegetable products and tastings

milk and milk products,



b) excursion to the agricultural and horticultural businesses, farms and businesses

aimed at production, distribution, processing or selling of fruits,

vegetables or milk,



(c)) training and educational materials about products marketed in

school project ' ^ 4), about healthy eating habits and

environmental protection relating to the production, distribution and consumption

fruit and vegetables or milk and dairy products, with the exception of the establishment and

operation of Internet presentations,



d) school competitions that promote the consumption of fruit, vegetables

or milk,



(e) support for school facilities of the land), in particular the acquisition of tools,

kompostérů or the seedlings, which relates to the activities of the pupils at the school

land, and support small horticultural activities or



f) occasional deliveries of other agricultural products ^ 5), such as honey,

dry nuts, including coconut, dried fruit and vegetables,

performed only when accompanying training measures under point (a)

and).



(3) upon delivery of the products referred to in paragraph 1 (b). a) and b), or

the implementation of the accompanying training measures referred to in paragraph 2 (a). and)

to d) can be used, printed educational materials with information about the

the products; their use for other purposes is not permitted.



(4) the products referred to in paragraph 1 (b). a) to (d)) are in school

the project delivered free of charge. Accompanying training measures according to the

paragraph 2 are within the school project also performed free of charge.



(5) the Flavored milk product referred to in paragraph 1 (b). e) must be sold

the pupils of schools in accordance with price regulation applied under the law on

prices.



§ 3



National support



Czech Republic contributes on a school project for the execution of the aid referred to in

section 2 of the national aid referred to in article. 23A para. 6 regulation of the European

Parliament and of the Council (EU) no 1308/2013, as amended, from budget

Chapter of the Ministry of agriculture through the State budget

agricultural intervention fund (hereinafter referred to as "the Fund").



§ 4



Transfer funds between projects



The Ministry of agriculture may determine the amount of funds

that converts between the projects fruit and vegetables to schools, and Milk to

schools, and up to 20% allocated to preliminary allocations for

each project according to the article. 23A para. 4 (b). a) or b) of the regulation

§ 5



Support the delivery of the products



(1) the amount of aid that could be granted to the



a) 1 piece of fruit or vegetables of a minimum weight 100 g



(b) the number of units) corresponding to the fruit or vegetables with a total minimum

weight 100 g



(c) fruit puree or) packaging the packaging of cut fresh fruit

or vegetables on the minimum weight 100 g



d) Pack of fruit or vegetable juices with a minimum volume of 200 ml,



e) packing of liquid milk with a minimum volume of 200 ml,



f) packing of milk product based on fermented milk with a minimum volume

200 ml



g) Pack of yogurt on the minimum weight 150 g



h) package cottage cheese or fresh cheese with a minimum weight of 80 g or

(hereinafter referred to as "portions"), shall not exceed the amounts indicated in annex No. 1 to

3, to this regulation.



(2) the applicant shall include in the supply of fresh fruit and vegetables or

drinking milk and non-flavoured milk products referred to in article 3(1). 23 para. 4

(a). b) European Parliament and Council Regulation (EU) no 1308/2013, in

(3) the share portions of packaged fruit and vegetable juice and fruit

extrusions may not exceed 25% of the total servings of products

referred to in § 2 (2). 1 (b). a) and b) delivered to the each base

§ 6



The application for approval of an applicant for support



(1) an application for the approval of the applicant for aid (hereinafter referred to as "request

§ 7



Approved by the applicant

§ 8



Establishing limits



(1) the preliminary monthly limit on products to one pupil, and until the

schools ^ 4) after deduction of related costs, including costs for accompanying

training ^ 8), and the total number of pupils in schools in

the previous school year, divided by ten. The Fund by 1.

§ 9



The application for the grant of aid to products

§ 10



The application for the grant of aid for accompanying training measures

payment of invoices for the accompanying training measures referred to in subparagraph (b)).



§ 11



Promotion



(1) the Fund shall ensure that poster printing ^ 14) and forward it to an approved applicant.



(2) the approved applicants shall ensure that each school, with which it has concluded

a contract for the supply of products, use the poster "European Union School

project "in accordance with the directly applicable European Union law ^ 14).



§ 12



Withdrawal of approval



In addition to the suspension and withdrawal of the approval pursuant to article 4(1). 7 Commission Regulation in the

delegated (EU) 2017/40 Fund shall withdraw approval an applicant who

PART TWO



Changing government regulations establishing certain conditions for the granting of

aid for fruit and vegetables and products made from fruits, vegetables and bananas to children

in educational establishments



§ 14



In the Government Regulation No 478/2009 Coll., laying down certain conditions for the

providing support for the fruit and vegetables and products made from fruits, vegetables and

bananas for children in educational establishments, as amended by Decree-Law No.

157/2014 Coll. and Decree-Law No 166/2016 Coll., section 5 of the following new section

5A, which including the title reads as follows:



"§ 5a



Special provisions



The request pursuant to § 3 (2). 2, § 4 and § 4a para. 1 the Fund cannot be made for

the period beginning the school year 2017/2018. ".



PART THREE



The amendment of the Government, establishing the common organisation of the market in

milk and milk products provides more detailed conditions for the granting of aid and the

national support the consumption of milk and milk products to pupils who fulfils the

compulsory school attendance in the schools included in the school network



§ 15



In Government Decree No. 209/2004 Coll., amending the common organisation of

of the market in milk and milk products shall lay down the detailed conditions for the granting

aid and national aid consumption of milk and milk products to pupils who

compulsory school attendance in the schools included in the school network in

amended by Decree-Law No. 127/2005 Coll., regulation of the Government No. 371/2005 Coll.

Decree-Law No 339/2006 Coll., regulation of the Government No. 211/2007 Coll.

Decree-Law No. 319/2008 Coll. and Decree-Law No. 238/2009 Coll.,

§ 4 paragraph 4a shall be inserted, which including the title reads as follows:



"§ 4a



Special provisions



The request pursuant to § 3 (2). 1 and 5, and section 4, paragraph 4. 1 the Fund cannot be made for

the period beginning the school year 2017/2018. ".

educational establishments, as amended by Decree-Law No 157/2014 Sb.



4. Government Regulation No. 204/2004 Coll., amending, in the framework of the common

organisation of the market in milk and milk products provides more conditions

the granting of aid and national aid the consumption of milk and milk products sector

students who undertake compulsory school attendance in the schools included in the network

schools.



5. Government Regulation No. 127/2005 Coll., amending Decree-Law No.

205/2004 Coll., amending the common organisation of the market in milk and

dairy products, lays down more detailed conditions for the granting of aid and the national

promoting consumption of milk and milk products to pupils subject to compulsory

school attendance in schools included in the school network.



6. Decree-Law No. 371/2005 Coll., amending Decree-Law No.

205/2004 Coll., amending the common organisation of the market in milk and

dairy products, lays down more detailed conditions for the granting of aid and the national

promoting consumption of milk and milk products to pupils subject to compulsory

school attendance in schools included in the school network, as amended by regulation

No 128/2005 Sb.



7. Decree-Law No 339/2006 Coll., amending Decree-Law No.


205/2004 Coll., amending the common organisation of the market in milk and

dairy products, lays down more detailed conditions for the granting of aid and the national

promoting consumption of milk and milk products to pupils subject to compulsory

school attendance in schools included in the school network, as amended

regulations.



8. Decree-Law No. 211/2007 Coll., amending Decree-Law No.

205/2004 Coll., amending the common organisation of the market in milk and

dairy products, lays down more detailed conditions for the granting of aid and the national

promoting consumption of milk and milk products to pupils subject to compulsory

school attendance in schools included in the school network, as amended

regulations.



9. Government Regulation No. 319/2008 Coll., amending Decree-Law No.

205/2004 Coll., amending the common organisation of the market in milk and

dairy products, lays down more detailed conditions for the granting of aid and the national

promoting consumption of milk and milk products to pupils subject to compulsory

school attendance in schools included in the school network, as amended

regulations.



10. Decree-Law No. 238/2009 Coll., amending Decree-Law No.

205/2004 Coll., amending the common organisation of the market in milk and

dairy products, lays down more detailed conditions for the granting of aid and the national

promoting consumption of milk and milk products to pupils subject to compulsory

school attendance in schools included in the school network, as amended

regulations.
