amending Act No. 72/1994 Coll., on the sale and export of objects
cultural values, as amended by Act No. 121/2000 Coll.
Parliament has passed the following Act of the United States:
Article. (I)
Act No. 71/1994 Coll., on the sale and export of objects of cultural value, in
amended by Act No. 122/2000 is amended as follows:
1. In article 1 (1). 1, the words "or" be replaced by "science, science or
the technique ".
2. in article 1, paragraph 2 reads as follows:
"(2) this Act does not apply to the sale and export of cultural monuments and
national cultural monuments, ^ 1) registered collections of the Museum of the nature and
items, of which they are components, ^ 2) ^ 3 records)
the originals of works of living authors, and on items imported into the
The United States, which have been placed under the temporary importation procedure. '.
3. § 2 including the footnotes # 3a) and 3b):
"§ 2
(1) items of cultural value may be exported from the territory of the United States, only
If they are accompanied by an export certificate for a specified period or by a certificate to the
permanent export (hereinafter referred to as the "certificate"). The certificate cannot be replaced by a

(2) the certificate shall be issued on the basis of an application submitted by a natural or
a legal person who is the owner of the subject of cultural values (
"the owner"), museums, galleries, libraries and workplaces of the national
Heritage Institute (hereinafter referred to as "the Organization"), or
The Ministry of culture (hereinafter referred to as "the Ministry"). List of professional
organisations, indicating the fields in which they operate, and the definition of their
territorial jurisdiction is given in annex 2 to this Act.

Footnote 4) is repealed.
4. In paragraph 3, the words "before their sale" shall be replaced by "to permanent
exports "and the word" copies "are replaced by the words" original copies
marked (B), (C) and (D) ".
5. in paragraph 3 of the present text shall become paragraph 1 and the following
paragraph 2, which reads as follows:
"(2) an offer to sell in accordance with paragraph 1 and issue articles
in the public sales, auctions and collectors
markets. ".
6. section 4 reads as follows:
"§ 4
(1) an application for the issue of certificates for export for a certain period and request for
issue of the certificate of permanent export, specimens of which appear in the
Annexes 3 and 4 to this Act, the owner shall submit a professional
the Organization in four original copies, designated A, B, C and D.
(2) an application under paragraph 1 shall be submitted to industry and the competent local
professional organization according to the place of residence or seat of the owner.

7. in § 5 para. 1, the words "of one month" shall be replaced by "professional

8. in § 5 para. 2 the first sentence, the words "establishes that the subject of cultural
the value could be declared a cultural monument, ^ 5) ' is replaced by
"after examination of the subject of cultural values", the word "and" shall be replaced by a comma
and in the second sentence, the words "shall inform the applicant" shall be replaced by "at the same time
written notice to the owner ".
Footnote 5) is repealed.
9. in section 5, paragraph 3:
"(3) the Ministry within a period of 3 months from the receipt of the request of professional
the Organization shall issue to the owner of the certificate, or if the subject of the cultural
the values of the characters of the subject protected by special legal regulation ^ 1)
and if an application for the issue of certificates, certificate of permanent export
issued and will initiate proceedings under special legislation. ^ 1) certificate
issued also in the case that the subject of cultural value is subject to
protected under special legislation. ^ 3b) ".
10. in paragraph 5, the following paragraph 4 is added:
"(4) If an application for issue of the certificate of permanent export and
the certificate has not been issued on the grounds that it is a subject of cultural
the value that is listed in section XVII of annex 1 to this Act, it shall issue
about this Ministry within the time limit laid down in paragraph 3 of the decision. ".
11. In paragraph 6 (1). 1 the first sentence after the word "shall" is inserted after the word "owner",
the words "copies of the relevant parts of the form confirmation" shall be replaced by
the words "original copies marked (B), (C) and (D)", the second sentence is
be deleted and in the third sentence, the words "a copy of the issued
certificate "shall be replaced by" copy and marked ".
12. in section 6 paragraph 2 reads as follows:
"(2) the certificate shall be issued to the applicant for a fee of 500 CZK. This provision
does not apply to the issue of certificates in accordance with § 2 (2). 4, § 3 para. 1 and section 5
paragraph. 3. The beneficiary charge is organization. ".
13. In paragraph 6, the following paragraphs 3 and 4 are added:
"(3) a certificate for export of limited duration may be issued for a maximum period of 5
years of age.
(4) the certificate of permanent export is valid for 3 years from the date of its
issue. ".
14. section 7 reads as follows:
"section 7 of the
(1) a natural or legal person who is the subject of the cultural value of exports
(hereinafter referred to as "exporter") is required to submit copies of the marked (B), (C) and (D)

(3) the re-entry of the cultural values of the exported item for a specified period

(5) Professional Organization shall monitor compliance with the deadlines for export for a certain

end of the period. ".
15. in paragraph 7 the following new section 7a and 7b, which including the footnotes

"§ 7a
(1) in the event that the exporter shall submit a customs declaration at the Customs Office, which

shall be borne by the exporter, if it was proven a violation of this Act.

16. section 8 including the title reads as follows:
"The penalties
§ 8
(1) a natural person has committed the offence by
and exports or export the subject) cultural values without a certificate, or
(b)) in the sale will offer the subject of cultural value of archaeology
or the subject of the cultural values of the sacral and iconic nature without a certificate
permanent export.
(2) the owner is guilty of an offence by
and does not allow inspection of the subject) cultural values, or does not provide the professional
Organization, where appropriate, the necessary cooperation Ministry (section 4 (3)),

the time-limits for export for a specified period within a specified period (article 7, paragraph 5),

17. in paragraph 8, the following new section 8a, which including the footnotes # 6b)
and 6 c) is added:
"§ 8a
(1) in determining the amount of the fine on a legal person shall take account of the seriousness of the

consequences and the circumstances under which it was committed.
(2) liability of legal persons for offences expires
3 years from a criminal offence.
(3) for the infringements referred to in § 8 para. 1, § 8 para. 2 (a). a) and (c))

(4) Offences and offences of legal persons in accordance with this

entrepreneurial activities shall be assessed in accordance with the provisions of this Act on the

Article II
Transitional provisions
(1) certificates issued before the date of entry into force of this Act shall apply after the
period of 3 years from the date of their issue, but not later than 31 December 1998. December, 2004.
(2) if the request for the issue of certificates for export of the subject of cultural
the value submitted before the date of entry into force of this Act, subject to the
on the issue of the certificate and the placing of that cultural
values in the export procedure or the outward processing procedure
the existing legislation. The following certificates are valid for 1 year
from the date of their issue.
(3) the procedure for the imposition of fines, initiated before the date of entry into force of this
Act shall be completed according to the existing legislation.
