Amending Decree no. 352/2005 Coll., On details of waste
electrical equipment and electrical and detailed conditions of financing
handling (Decree on management of electrical equipment and electronic equipment
), as amended amended

Art. I
Decree no. 352/2005 Coll., On details of management of electrical equipment and electrical
and detailed conditions of financing handling
(Decree on the disposal of electrical equipment and electrical), as amended by Decree No.
. 65/2010 Coll., Decree no. 285/2010 Coll., Decree no. 158/2011
Coll., Decree no. 249/2012 Coll. and Decree no. 178/2013 Coll., is amended as follows
:
First In § 1 para. 1 introductory part, the words "European Community
^ 1)" is replaced by "European Union ^ 1)."
Footnote. 1 reads:
"1) Directive of the European Parliament and Council Directive 2012/19 / EU of 4 July 2012
Waste Electrical and Electronic Equipment (WEEE).".
Second In § 1 para. 1 point. a) the words "product list" is replaced
"subgroup of electrical equipment".
Third In § 1 para. 1 after letter c) the following point d) shall be added:
"D) the extent and manner of keeping records of collected flow
electrical equipment and separately collected electrical and electronic equipment".
Existing letters d) to i) are designated as letters e) to j).
Fourth In § 1, at the end of paragraph 1 is replaced by a comma and
letter k), which reads:
"K) the method of calculating the level of utilization of electric.".
Fifth In § 1, paragraph 3 shall be added:
"(3) This Decree also for cross-border shipments of used EEE provides
A) method of verification and functionality of the electrical,
B) the extent of documentation pursuant to § 37 R par. 4 Act and a list of other
documents enclosed cargo transported
used electrical appliances, including their appendices,
C) list of electrical equipment containing hazardous substances, which can not be transported as
used. ".
6th § 3, including the title reads:
"§ 3
Subgroups electrical
(1) Subgroups of electrical equipment, which fall into groups
specified in Annex no. 7 of Part I of the Act, are listed in Annex no. 1
Part I of this decree.
(2) Subgroups of electrical equipment, which fall into groups
specified in Annex no. 7 of Part II of the Act are set out in Annex no. 1
Part II of this Decree.
(3) In case of doubts about the inclusion of electrical components to
groups is crucial, for what purpose use electrical equipment manufacturer declare
or for what purpose is this or electrical usually determined
if the manufacturer has EEE does not exist or does not exist
accompanying documentation that provides the intended use of electrical equipment. ".
7th In § 5, paragraph 1 reads:
"(1) Producers of electrical equipment, who perform duties within
individual or a system based on solidarity, served on a proposal for registration
form, a model of which is shown in Annex no. 2 hereto.
Electrical manufacturers who fulfill their obligations through
operator of a collective system that is not yet registered in the List for the group
electrical, served an application for registration along with
this operator on a form whose specimen is given Annex no. 3
hereto. Manufacturer for the purposes of this provision means well
authorized representative under § 37q Act. ".
8th In § 5, paragraph 7 reads:
"(7) Writing operator of a collective system, which provides funding
management of historical electrical equipment, the List
is done the same way as the registration of the collective system operator,
which provides funding for management of electrical equipment originating || | of households, put on the market after 13 August 2005. ".
9th In § 5, paragraphs 8 and 9 are deleted.
Former paragraphs 10 and 11 are renumbered 8 and 9
10th Under § 5, the following § 5a is inserted:
"§ 5a
(1) Upon registration in the List operator receives collective
system manufacturers or authorized representatives, who perform their duties in
framework of an individual or a system based on solidarity, credentials
allowing remote access to the list.
Credentials are not part of the decision on registration in the list.
(2) In the event that the implementation of the changes, the procedure under § 37i paragraph. 5
Law Ministry of the Environment (hereinafter the "Ministry")
invite the person registered in the list of supporting documents proving that performance
its obligations is ensured, used by the person registered in the List for this purpose
form whose specimen is given in Annex no. 2 to this
decree, which fills only data that has changed. If this person
operator of a collective system, using the form, a specimen
is given in Annex no. 3 hereto, which fills only data that has changed
. ".
11th § 6 para. 2 point. b) the words "permanent address, place of business or registered office
" is replaced by "legal address."
12th Under § 6 the following § 7, including the heading reads:
"§ 7
Evidence taken back the flow of electrical equipment and separately collected e-waste
(1) the manufacturer or operator of a collective system keeps records of flow
taken back separately collected electrical and electro from
appropriate recycling or separate collection sites to processing,
recovery or disposal of electrical waste in this range:
) The date and number of entry in the register,
B) the name and surname of the person responsible for keeping records,
C) of electrical equipment according to Annex no. 7 of the Act at the back
taken separately collected electrical and electronic equipment,
D) the address of the place of return, address the separate collection or
address of the last seller, if the electrical
taken back last retailer or the name of a municipality, city
district or municipal area of a statutory city on
whose territory has been taken back or electrical
WEEE separately collected, unless indicate the address of one of those places
E) the total weight of EEE, which was retroactively revoked in place
or territories referred to in subparagraph d)
F) the total weight of WEEE that was collected separately at the site
or territories referred to in subparagraph d)
G) the total weight reused EEE
H) identification of the person that was passed taken back
electrical or separately collected WEEE in the scope
specified in Table no. 3 column 7 of Annex no. 4 hereto,
I) the total weight of collected EEE, which was passed
person referred to in subparagraph h) for the purpose of treatment, recovery or disposal of
,
J) the total weight of separately collected electrical and electronic equipment that was passed
person referred to in subparagraph h) for the purpose of treatment, recovery or removal
and
A) the total weight of electrical waste processed
individual processors within the range specified in the table no. 3 of Annex no. 4 to this Decree
.
(2) The records referred to in paragraph 1 shall result in the receipt of collected
electrical equipment from the place of return or the last
retailer or upon receipt of e-waste separate collection sites or from
originator and when you pass electrical or
electro person entitled to their treatment, recovery or disposal. Evidence
amount of electronic waste processed by each processor is kept in
monthly intervals. ".
13th In § 10 paragraph. 2, the word "remove" is replaced by "removed".
14th § 11 including the title reads:
"§ 11
Method of keeping continuous records and method of reporting electrical products
(1) Operators of facilities for the processing, use and disposal of electronic waste
keep continuous records of e-waste and other
waste and waste management methods for electrical and electronic equipment and other waste
own and electrical waste and other waste taken and under every
independent establishment and for each type of electrical waste and other waste

15th Under § 11 the following § 11a, including the heading reads:
"§ 11a
Method of calculating the level of utilization of electric
(1) The level of e-waste for the purpose of fulfilling the obligations set out in § 37 meters
paragraph. 3 of the Act for each group of electrical
calculated by dividing the weight of waste which after proper selective processing

16th In § 13, paragraph 1 shall be deleted and whilst repealing the designation of paragraph

17th For the third part, the following new Part Four, including the title and
footnotes. 17-21 reads:
"PART FOUR
CROSS-BORDER TRANSPORTATION OF USED ELECTRICAL
§ 14d
Method of verification and functionality of the electrical
(1) The functionality of EEE is verified by performing tests
functionality. Functional test must be conducted at least
verify the functionality of the main functions of EEE.
(2) Functional test must be performed by a person who is technically competent and
holds an appropriate license and certificate by
legislation governing state professional supervision of safety
work ^ 17) and the holder of a trade license to business in
"Installation, repair, inspection and testing of electrical equipment" and that
in accordance with the procedure laid down in Annex no. 11 hereto, if
is used in electrical equipment transported from the Czech Republic.
§ 14e
Documentation and other documents accompanying the cargo transported
used electrical
(1) Documentation according to § 37 R par. 4 Act constitutes a test report
functionality implemented in accordance with § 14d and proof of the content of hazardous substances in
transported electrical equipment.
(2) In the event that used electrical equipment is transported from another
state than the Czech Republic and functionality test was not performed according
§ 14d. 2, the documentation must contain a test report functionality made
under similar conditions in another Member State of the European
Union or another state of the European economic area.
(3) shall be shown
A) the name of the manufacturer of electrical equipment and, if known,
B) information about the group and subgroup of electrical equipment in accordance with Annex.
1 to this decree,
C) identification or type the item number, if any,
D) the year of manufacture, if known,
E) the name or names and surname or business name or name
person responsible for testing the functionality and address of the registered office of the
person
F) the result of performance tests carried out in accordance with § 14d, the type and date of its execution and
G) information about hazardous substances in electrical equipment.
(4) In the event that electrical equipment used is imported from outside
European Union or the European Economic Area must be
documentation attached documents proving compliance with the requirements set
regulation restricting the use of certain hazardous substances
in electrical and electronic equipment ^ 18).
(5) Each consignment shipped used EEE, which mainly consists
shipping container or truck, also accompanied
A) relevant transport document such as a bill of lading under the Convention on the Contract for the
International Carriage of Goods by Road (CMR) or
Convention concerning International Carriage by Rail (COTIF) ^ 19)
B) a list of transported EEE
C) list of hazardous substances in electrical equipment and transported
D) a declaration from the electrical equipment carried on his
responsibility for meeting obligations under § 37 R Law.
(6) When used electrical transported from the Czech Republic,
used for the preparation of documents and the documents referred to in paragraph 5
point. b) to d) form, specimens of which are given in Annex no. 12 to
hereto.
(7) Documentation must be securely but not permanently, attached either directly to the unpacked
electrical, or on the packaging so that
read without unpacking them. The documents referred to in paragraph 5
must be equipped with a driver of the vehicle, the driver of the train, the leader of a vessel or aircraft commander
throughout transport.
§ 14f
The ban on cross-border shipments of used electrical equipment containing certain hazardous substances

Legend
Act means the Act no. 185/2001 Coll., On waste and amending some
other laws, as amended.
Annex no. 2 apply to manufacturers and authorized representatives who fulfill their obligations under
Part Four, Title II, Title 8 of the Act within
individual or a system based on solidarity, as a form for filing
proposal for entry into list or if the manufacturer or an authorized representative
was invited by the Ministry to authenticate the documents proving that
performance of his duties is assured. In this case, the form
completed only data that has changed. The manufacturer is further understood
also authorized representative under § 37q Act.
Explanation for part I.
Identification data
Line 1 - to fill in the name, or names and surnames (only
individuals) or business name of manufacturer, as registered in the commercial register

electrical equipment according to Annex no. 7 of the Act.
In row 17 are filled in the data for the solar panels independently under the name
group 4b. 14 August 2018, the group applied
EEE listed in Part I of Annex no. 7 of the Act. From 15 August 2018
use of electrical equipment listed in Part II of Annex no. 7
Act (rows 20 to 23 do not apply).
Subgroup - in the group will bring the number of subgroups according to Annex.
First 14 August 2018 shall apply to subgroups listed in Part I of Annex.
1 and from 15 August 2018 shall apply to subgroups listed in Part II of Annex
no. 1st
Marketed quantity referred to in the preceding year and in submission -
columns indicating the amount of electrical equipment, which the manufacturer says on
market in the Czech Republic in the previous calendar year, and
amount of EEE which the producer put on the market in the Czech Republic
in the application for registration in the List. The information shall be given in tonnes to three decimal places
while specifying the amount in pieces.
Line 24 - in the Annex for each product (if they are labeled differently
) indicate how the products are labeled by date

Line 44 - agreement on fulfillment of solidarity must include:
- The subject of the contract
A. Accession to the second commitment,
B. liability for costs related to financing take-back
and waste electrical equipment originating from households as
separate collection and waste electrical and electronic equipment.
- Way guarantees will perform if the contractual obligation by one manufacturer or
cease to exist if one manufacturer.
If it remains just one manufacturer provides a guarantee under the individual
performance, or enters into a solidarity with the performance of another manufacturer, or
logs to the collective system, and everything including the assumption of liabilities
for previously acquired obligations of the original system based on solidarity.
Line 46 - The Treaty establishing the escrow bank account
must contain provisions that allow the Bank withdrawals from the account
thus established on the basis of a written decision on approval of the Ministry.
Submitted a copy of the account statement is a confirmation of the stored cash
resources according to the plan of security (see explanatory notes to line 25).
Line 47 - The agreement on the conclusion of insurance must contain provisions
transferring funds from insurance if the manufacturer changes the way
fulfilling their obligations under Part Four, Title II, Part 8

Signature may be replaced by a power of attorney given by the producer
operator of a collective system. Copies of powers of attorney are attached to its proposal (line 63).
List and description of electrical
It is reported details of electrical equipment, which the manufacturer places on the market in the Czech Republic
.
In lines 14-23 are filled in the data for each group
electrical equipment according to Annex no. 7 of the Act. In row 17 are filled
data for solar panels separately under the name of a group 4b. 14 August 2018
use of electrical equipment listed in Part I of Annex no. 7
Act. From August 15, 2018 shall apply to groups of electrical
listed in Part II of Annex no. 7 of the Act (lines 20 to 23 do not apply).
Subgroup - in the group will bring the number of subgroups according to Annex.
First 14 August 2018 shall apply to subgroups listed in Part I of Annex.
1 and from 15 August 2018 shall apply to subgroups listed in Part II of Annex
no. 1st
Marketed quantity referred to in the preceding year and in submission -
columns indicating the amount of electrical equipment, which the manufacturer says on
market in the Czech Republic in the previous calendar year, and
amount of EEE which the producer put on the market in the Czech Republic
in the application for registration in the List. The information shall be given in tonnes to three decimal places
while specifying the amount in pieces.
Line 24 - in the Annex for each product (if they are labeled differently
) indicate how the products are labeled by date
production, brand identification for the manufacturer signs for return
collection, eg. the attached copy of the symbol marks.

Part II. is filled once together for all manufacturers within
collective system.
Identification data operator of a collective system
In part II. Data to be completed by the operator of a collective system
ensuring compliance with the obligations of manufacturers under the collective system.
Line 25 - fills the Company of the collective
system as registered in the Commercial Register, or his name.
Line 26 - to fill in the legal form of the operator of a collective system.
Line 27 - to fill in the exact and complete address of the registered office of the operator
collective system - street, city, zip code.
Line 28 - to fill personal identification number (ICO)
tax identification number (TIN) if the operator of a collective system
allocated. If the operator of a collective system ID
less than eight digits, adding leading zeros to the total number of 8 seats.
Line 29 - to fill in the required contact information related to
exemption system operator.
Identification and contact information of the statutory body of the operator

In lines 30-34 to fill in required information relating to
statutory body of the operator of a collective system and signature
statutory body.
Line 35-50 - filled with the names of attachments to always prompt for the prescribed

can be filled into the joint annex with a breakdown according to the requirements

electrical and electronic equipment put on the market after 13 August 2005
including confirmation of the commitment for a certain period (eg. 1 year) to finance eg. || | form:
A. contribution to a collected and identified item (product) from
individual producer. It is similar to the historical contribution
electrical equipment and will be determined for producers who decide to solve
and electronic equipment of these facilities collective system.

Line 53 - Annex is a written authorization, on the basis of which was intended
representative.
Line 54 - the collective system operator shall list the groups and subgroups
electrical equipment, for which it will ensure compliance with the obligations
manufacturers.
Lines 58 and 59 - the collective system operator shall submit a list
contracted back points or separate collection, type
agreement with the competent bodies, the collection network development plan and ensure the appropriate collection containers
related to the specific type of electrical and electronic equipment.
Line 60 - the collective system operator submits contract
processing plants, processors list and description of the processing
e-waste in facilities so as to be able to assess the level
material recovery and reuse. The equipment must be able to handle the type of electro
given group of electrical equipment (to be described separately

In the case of sending an annual report for a system of solidarity in the table

all data relating to the producer who is responsible for drafting and sending
annual report for the solidarity system.

provides all the information relating to the exemption system operator.

Columns 1-8 are filled in the data for each group
electrical equipment, according to Annex no. 7 of Part I of the Act (lines 1-10)
in calendar year 2018 (inclusive) and in accordance with Annex. 7 of part II of the Act
(only lines 1-6) for the following calendar years.
In line 4a shall include information on electrical equipment belonging to the group 4
besides solar panels. In line 4b give separate figures for
solar panels.
In line 5 in calendar year 2018 (including) reported

electrical equipment originating from households. It is reported the total amount collected
electrical electrical products group, for which the table
no. 2 filling, in tonnes, and if possible, even in pieces.
The total amount is further broken down by detailed classification place where the
WEEE separately collected.
Method of waste electrical and electronic equipment - the total amount of electrical
tonnes and, if possible, even in pieces that were
reused.
Method of waste electrical and electronic equipment - the total amount of electrical and electronic equipment
tonnes and, if possible, and in pieces, with which it was handled
mentioned methods.
Notes:
- For export to European Union countries indicates the total amount of exported
electrical and electronic equipment regardless of the method of handling, ie. Re-use, recovery or disposal

specified by the manufacturer of electrical / operator of a collective system
on the first page; if the declarant ICO less than eight digits,
supplemented with leading zeros to a total of 8 seats.
Group EEE - to fill in the number and the name of the group
electrical equipment according to Annex no. 7 of the Act and the corresponding group for
which is filled in Table No. 2.
In column 1 - lists the serial number of the type of waste.
In column 2 - states the catalog number of waste pursuant to Decree no. 381/2001 Coll
. (Waste Catalogue). Catalog number is left blank in the case
reuse of WEEE.
In column 3 - indicates the category of waste pursuant to Decree no. 381/2001 Coll
. (Waste Catalogue). Category is left blank if re
use electrical equipment.
In column 4 - enter the name of waste according to Decree no. 381/2001 Coll.
(Waste Catalogue). Name of waste is left blank in the case
re-use of WEEE.
Column 5 - presents the codes dealing under the table waste management
. (Table 2 of Annex no. 8 of this Decree) by actually carried
various forms of waste management partner set out in column 7
.
In column 6 - the total amount of waste for each individual
catalog number of waste by type of waste
listed in column 5 and partners listed in column no. 7, which was a waste
passed. The quantity expressed in tonnes to three decimal places.
In column 7 - partner means a natural person authorized to carry
or legal person (including foreign entities), which was used
product or component thereof is passed for reuse or authorized
person who waste was forwarded for further management. It is reported ICO
partner, if assigned, and the name, address and ICZÚJ establishment

The sheet no. 2 - Reporting on the collection, treatment, recovery and disposal of electrical waste
including reports on production and waste management for the reporting year
Column 1 - lists the serial number of the type (code) waste
Column 2 - indicates the catalog number of waste pursuant to Decree no. 381/2001 Coll
. (Waste Catalogue).
Column 3 - presents the category of waste pursuant to Decree no. 381/2001 Coll.
(Waste Catalogue).
Column 4 - indicates the name of the type of waste pursuant to Decree no. 381/2001 Coll.
(Waste Catalogue). For waste ending with two digits "99 (
wastes not otherwise specified)" shall be given a more detailed description of the waste (eg.
Technical or commonly used name).
Column 5 - in calendar 2018 (inclusive) shall include designation of electrical
according to Table. 1, in which processed
electrical equipment belonging to or from which the type of waste reprocessing
obtained. Since calendar year 2019, lists a number of categories of EEE
according to Annex no. 7 of Part II of the Act. This column is included only in case
reception and processing of electrical and electronic equipment.
Column 6 - for each type of waste (Waste Code) must
figure for the total amount of production or takeover or the balance of waste in warehouse
entered in column 6 on a separate line. On a separate line
always given total amount:
A) one kind of waste produced by the plant operator, with
code A00 in column 8. In the waste produced is also considered
waste arising from processing or reprocessing of waste taken over, if there was another
kind of waste than was original
B) retransmission of one type of waste that was collected from one
originator or the beneficiary, with code B00 in column 8
C) one type of waste that was transferred from the warehouse
from the previous year, with code C00 column 8
D) retransmission taken back a product or backward electrical
collected from legal entities or natural persons
authorized to conduct business, which provides takeback under § 37k or
§ 38 of the Act, or the receipt of the waste from nonentrepreneurial individuals - citizens

02.02 Spare measurement procedure
Spare measurement procedure is established for electrical equipment, which, in order
