a Tripartite agreement between the Government of the Czechoslovak Socialist Republic,
The Austrian Federal Government and the Government of the Polish people's Republic to ensure

TRIPARTITE AGREEMENT
between the Government of the Czechoslovak Socialist Republic, the Austrian Federal

The Government of the Czechoslovak Socialist Republic, the Austrian Federal Government and the
the Government of the Polish people's Republic
considering the existing successful development of economic relations between the
three Contracting States,
resolved to fully implement the provisions of the final document of the Conference
on security and cooperation in Europe, signed at Helsinki on
1.8.1975,
being guided by the will to secure the further expansion of economic relations between the
three Contracting States on the basis of equality and mutual benefits,
taking into account the role they should play in the next dynamic
the development of mutual relations of close cooperation of the three Contracting States in
the field of electric power,
have agreed as follows:
Article 1
The Contracting Parties take note with satisfaction
-the contract of 23 February. May 1975 for the supply of electric power
enclosed between a business Centralâ Closing Zagranicznego Weglokoks,
Katowice Elektrizitätswirtschafts-AG and Österreichische
(Verbundgesellschaft), Vienna,
-the contract of 18 May. April 1977, relating to the transit of electrical
energy from the Polish people's Republic to the Republic of Austria, concluded between the
business Centralâ Closing Zagranicznego Weglokoks, Katowice and PZO
Metalimex, Prague,
-agreement of 31. August 1977, concerning joint financing and
the use of high voltage direct current substation, concluded between the
Österreichische Elektrizitätswirtschafts-AG (Verbundgesellschaft),
Vienna and the enterprise Polskie Towarzystwo Closing Elektrim, Warsaw.
Article 2
The Contracting Parties shall provide mutual waranty are based, in accordance with the
their legal systems, include appropriate measures ensuring the proper
the performance of the supply, transit and electricity supplied from the Polish
the people's Republic to the Republic of Austria through the territory of the Czechoslovak
Socialist Republic of Vietnam in the years 1983-1999, and confirm the following:
-the Government of the Republic of Poland shall ensure the release of the relevant export licences
into electrical energy in the quantities predicted for both side
the importing and transit for the duration of this agreement,
-the Government of the Czechoslovak Socialist Republic ensures transit
electricity from the Polish people's Republic for the duration of this
the agreement,
-The Federal Government of Austria shall ensure that after the period of validity of this agreement
undisturbed sampling of electricity supplied from the Polish people's Republic
as well as the free transfer of payments for this energy with the payment
arrangements in force between the two States.
The Contracting Parties in this area will create the best conditions
for the execution of this agreement.
Article 3
The Contracting Parties agree that, for supervising compliance with this agreement
the competent authorities of each Member State shall determine the Plenipotentiaries who
they will meet at the written request of one of the Contracting Parties
no later than 30 days from delivery of such a request, alternately in the Czechoslovak
the Socialist Republic, the Republic of Austria and the Polish people's Republic.
Article 4
1. This agreement shall enter into force on the date on which the conditions will be fulfilled for the
the entry into force provided for by the legislation of each of the three terms
of the parties and shall remain in force until 31 December 2006. August 1999.
2. The Contracting Parties agree that, no later than 3 years before the date of expiry of
the validity of this agreement, shall discuss the possibility of its extension.
Drawn up in Warsaw, Poland, on 31 May 2006. August 1977, in three original copies, each in the
Czech, English, German and Polish, with each of the three texts is
the same force.
