DECREE



of 3 July 2003. November 2011,



amending Decree No. 352/2004 Coll., on operational and technical

the connectedness of the European railway system, as amended by Decree No.

377/2006 Sb.



The Department of transportation shall determine pursuant to section 66 paragraph 1. 1 Act No. 266/1994 Coll.

on rail, as amended by law No 23/2000 Coll., Act No. 103/2004 Coll.

Act No. 182/2006 Coll., Act No. 191/2006 Coll. and Act No. 134/2011

Article. (I)



Decree No. 352/2004 Coll., on operational and technical interconnection

the European railway system, as amended by Decree No 377/2006 Coll.,

be amended as follows:



1. In paragraph 1, the words "this Ordinance in accordance with the law of the European

Community ^ 1) sets out the technical requirements for the elements and components

the European rail system "shall be replaced by the words" This Ordinance

incorporates the relevant provisions of the European Union ^ 1) and laying down technical

component interoperability requirements ".

"§ 2



The track and rolling stock of the conventional rail system



(1) the conventional rail system shall comprise the following types of pathways and

their structural components:



and intended for personal) transport,



(b)) of the runway intended for freight,



(c)) of the runway intended for mixed traffic (passengers and freight),



d) stations and terminals, passenger transport,



(e)) including freight terminals terminals among species

transport and



(f)) of the track linking the above types of railway track connecting to each other and

the above types of railways stations and terminals, passenger and freight

transport.



(2) the rolling stock of the conventional rail system includes rolling stock

vehicles that are capable of running on conventional rail systems

the railway system, in particular the



and motor or electric cars) and self-propelled units,



b) motor or electric locomotives,



(c)) special vehicles designed for the maintenance, repair and reconstruction

railways or for the control of the State Railways and the removal of consequences of extraordinary

events



(d) passenger transport and cars)



(e) freight including cars) rolling stock designed for

transport of road vehicles.



(3) each of the types of rolling stock in accordance with paragraph 2 shall be further divided

on



and) rolling stock for international railway transport and



(b)) rolling stock for national rail transport.



§ 3



The track and rolling stock of the high-speed rail system



(1) high-speed rail system consists of:



and the track built for the operation), reaching a speed of at least 250 km/h,



(b)) of the track upgraded for operation reaching speeds greater than 200

km/h and



c) upgraded runway facilities connected to the runway under subparagraphs) and (b)), to which the

traffic does not reach the speed of 200 km/h, in particular due to technical, operational

and geographic reasons, including connecting lines between lanes

high-speed and conventional rail system, transits

stations and access to the terminals.



(2) the rolling stock of the high-speed rail system includes

and with a speed in excess of 300) km/h if they are constructed for the operation of the

7. in section 4, paragraph 4. 1 introductory provisions read as follows: "the technical documentation

construction of the track, the technical conditions of technological equipment transport

the path of the track or the technical conditions of the rolling stock shall be defined by the base

the parameters of the interoperability constituent. If it does not provide technical specifications

interoperability ^ 15), basic parameters for achieving

the interoperability constituents are: ".



8. the footnote No 3, including links to it in section 4, paragraph 4. 1 and § 15

paragraph. 1 repealed.



9. in section 4, paragraph 4. 2 the word "elements" is replaced by "part of the

interoperability ".



10. in § 5 para. 1, the first sentence shall be deleted.



11. in § 5 para. 2 the words "elements of the part of the track and rolling stock,

on which it depends, directly or indirectly, interoperability of the European

rail system (hereinafter referred to as "component interoperability"), "are replaced by

the words "component of interoperability '.



12. in section 5, paragraph 3, including footnote # 4 be deleted.



13. in section 6 (1). 1 (b). and) points 3 and 4 are added:



"3. the control-command trackside Assembly,



4. the onboard control and security ".



14. in section 6 (1). 1 (b). (b)) the following new item 1, which reads as follows:



"1. the operation and organisation of the rail transport".



Points 1 and 2 shall be renumbered 2 and 3.



15. in section 6 (1). 2, the words ' the annex to this order "shall be replaced by

"the European Union's legislation governing technical specifications

interoperability ^ 15) ".



16. in section 7 (2). 1 (b). and), the word "artificial" is deleted.



17. in paragraph 7 (2). 1 (b)):



"(b)) energy containing electrical power supply equipment including overhead

leadership and the track part of the measurement of electric energy consumption,

the conditions of the supply systems and the supply of electricity and other

energies ".



18. In article 7 (2). 1, at the beginning of subparagraph (c)) the following the word "line" and

the word "all" is added after the word "stable".



19. in paragraph 7 (2). 1 letter d) is added:



"(d)), i.e., management and security. all of the devices on rolling stock

the vehicles necessary to ensure the security, management and control of movement

vehicles authorised to travel along the path, ".



20. In paragraph 7 (2). 1 (b). e), the words "the structure of rolling"

shall be replaced by "design".



21. in section 7 (2). 1 (b). (e)), after the words "rolling stock,"

the words "current collectors," and after the words "energy conversion", the words "onboard

equipment for the measurement of electric energy consumption, ".



22. in section 7 (2). 2 (a). and), after the words "to ensure" the words

"operability and".



23. in paragraph 7 (2). 2, the following new subparagraph (a)), which read as follows:



"and the track and organize) the operation of railway transport, that

subsystem consists of two elements:



1. the procedures and the equipment used to enable continuous

the emergency operation of the system, particularly in the planning, organization, and

traffic management,

Subparagraph a) and b) shall become point (b)), and (c)).



24. In § 8 para. 1, the reference to footnote 4 is replaced by

footnote # 15.



25. In section 8 paragraph 1. 2 the words "track circuits" are replaced by the words

"security device".



26. in section 8 shall at the end of paragraph 2 the following sentence "the parameters of the brake

the device must be capable of stopping the train in the fixed length of the braking

distance ^ 16) even at the maximum authorised speed. ".



Footnote No. 16 reads as follows:



"16) section 8 and § 37 para. 8 Decree No. 173/1995 Coll., which is issued to

transport regulations, as amended by Decree No. 242/1996 Coll. and Decree No.

174/2000 Coll. ".



27. in § 13 para. 4, after the words "in the tunnels," the words "and on the

bridges ".



28. in article 18, the following paragraph 6 is added:



"(6) an overview of the technical operating requirements for design

rolling stock included in the technical specifications

interoperability, as stipulated in annex to this Ordinance. ".



29. In the title of part four, after the words "PART of", the words

"TRACKS AND ROLLING STOCK SUBSYSTEMS".



30. in paragraph 21 of the paragraph. 2, the words "and registers" are replaced by the words

"part of the subsystems of the tracks and".



31. in article 21, paragraph 3, including footnote # 17:



"(3) the register of rolling stock used on the national or

regional is kept in the manner prescribed by the decisions of the European Union

governing the common specifications of the national vehicle registry ^ 17) and

contains the information contained in them.

Paragraphs 1 to 3 shall become paragraphs 2 to 4.



34. In paragraph 22 of the paragraph. 2 the term "railway" is replaced by "rolling".



35. In paragraph 22 of the paragraph. 3, the second sentence is replaced by the phrase "components

the interoperability constituents and the subsystems of the European railway system

in accordance with the provisions of the technical specifications of interoperability ^ 15)

on the dates provided for therein. ".



36. In section 22, paragraph 4, including footnote # 18:



"(4) by the time the effectiveness of the technical specifications of interoperability

setting out the information that must be included in the registers of a part of the

subsystems railways ^ 18) and rolling stock ^ 17), in the part of the registry

subsystems railways shall indicate the information relating to the parameters of the transport route

the track in accordance with § 4 para. 1 and to the register of rolling stock details according to §

21, art. 3.

bumpers, transition jumpers), strength of construction vehicles and equipment

(for example, seats), load capacity, passive safety (including internal and

external resistance to impact).



3. Interaction with the rails and rolling stock outline



Mechanical interface to the infrastructure (including static and

dynamic behavior, will and save, breaking up and running gear).



4. The braking equipment



Items related to the braking system (including the WSP,

brake control and efficiency in the operation of the brakes, emergency and parking

modes).



5. Items concerning passenger



Facilities for passengers and the environment for the passengers (including doors and Windows


for passengers, air conditioning, sanitary equipment and requirements

relating to persons with reduced mobility).



6. Environmental and aerodynamic effects



The influence of the environment on the rolling stock and the influence of the vehicle on the surrounding

environment (including the aerodynamic conditions and how the interface between the vehicle

and parts of the rail system, the interface between the vehicle and the

the surrounding environment).



7. requirements for outdoor information systems, functions and

the integrity of the software



Outdoor information panels, labels, the integrity of the software and features

with the impact of safety related to the operation of the train, including the

the communication system of the train.



8. The on-board power supply and control systems



On-board propulsion, power and control systems, including the interface between the

rail vehicle and power supply infrastructure and all aspects of the

electromagnetic compatibility.



9. Devices, interfaces and environment for employees



The on-board equipment, interface, working conditions and environment for

employees (including the engine driver's cabs and the interface between an engine driver and

the machine).



10. Fire safety and evacuation



11. On-board device and interface for services (including information

equipment, air conditioning and audiovisual techniques)

Article. (II)



Transitional provisions



(1) information about the rolling stock put into service before the date of the acquisition of

the effectiveness of this Ordinance shall be in the registry of vehicles shall be kept in the range

pursuant to § 21 para. 3 Decree No. 352/2004 Coll., in the version in force from the date of

entry into force of this Decree, no later than from 1. January 2012.



(2) approval of the rolling stock, which was initiated prior to the date of acquisition

the effectiveness of this Ordinance, shall be completed according to the existing legislation.
