Dated 14 April 2004

On measures for prevention and control of African swine fever

Ministry of Agriculture, pursuant to § 78 of Act no. 166/1999 Coll., On
veterinary care and amending certain related laws (Veterinary
Act), as amended by Act no. 131/2003 Coll., (Hereinafter "the Act") to implement
§ 10 paragraph. 3 point. a) g) and § 51a paragraph. 3 of the Act:

§ 1
Subject Matter


This decree regulates in accordance with European Community ^ 1)

A) notification of the disease African swine fever contingency plan in case
outbreak of African swine fever (hereinafter "contingency plan")
animal sanitation program (hereinafter the "sanitation program") and || | vaccination

B) measures to control the disease African swine fever,

C) measures to sanitation animals from disease African swine fever.

§ 2


Definitions
For the purpose of this ordinance is meant

A) pig - any animal of the family, pigs (Suidae), including wild pigs
,

B) wild boar - a pig which is not kept or bred in a holding

C) the economy - any agricultural or other premises where
are permanently or temporarily reared or kept pigs;
this term does not include slaughterhouses, means of transport and disciplines ^ 2) in which they are held and
may be hunted wild pigs; These must be of such size and
arrangement that does not allow the application of the measures set out in § 5, paragraph
. 1

D) pig suspected of being infected with African swine fever -
any pig or pig flesh showing clinical symptoms,
mortem lesions or results of laboratory tests carried out in
accordance with the procedures established to ensure uniform handbook | || diagnosis of African swine fever (hereinafter "diagnostic manual")
issued by the State veterinary Service and the appropriate diagnostic manual
approved by the European Commission ( "Commission"), which indicate the possibility
African swine pigs

E) case of African swine fever or hog infected with African swine fever
- any pig or pig's body, with which he was
based on clinical symptoms or post-mortem lesions officially confirmed African swine fever
or where was based on laboratory tests
carried out in accordance with the diagnostic manual
officially confirmed incidence of the disease

F) an outbreak of African swine fever - the economy, which was detected
one or more cases of African swine fever,

G) the primary focus - the farm or other place where animals are assembled and where
been officially confirmed, one or more cases of the disease
not linked epidemiologically with the outbreak
previously identified in the same area or to the disease, which is
first occurrence of that disease in that area

H) an infested area - the area of ​​a Member State of the European Union (hereinafter
"Member State"), in which, after the confirmation of one or more cases
African swine fever in feral pigs in the control measures used
accordance with § 15 or § 16

I) the primary outbreak of African swine fever in feral pigs -
any case of African swine fever which is detected in feral pigs in the area in
which are not measures in accordance with § 15 or § 16

J) contact management - holding to which might be introduced
African swine fever, either as a result of the location or
due to the movement of persons, pigs or vehicles, or in any other
manner

K) breeder - any natural or legal person owning
pigs or pigs possession charge, both for consideration and without charge,

L) competent authority - the central authority of a Member State entitled to conduct
veterinary checks or any authority of the Member State to which it has delegated that competence
,

M) treatment - a method of processing high risk

N) the killing - killing pigs without bleeding in accordance with specific
legislation ^ 4)

O) defeat - killing a pig slaughter in order to use its products

In accordance with specific legislation, ^ 5)

§ 3

African swine fever notification

(1) African swine fever or suspected presence of African swine fever
is in accordance with § 11 and 12 of the Act compulsorily and immediately reported
Regional Veterinary Administration or Municipal Veterinary Administration in Prague
(hereinafter "the regional veterinary administration").

(2) Without prejudice to the provisions of special regulations on notification of outbreaks of animal diseases
, State Veterinary Administration, when the Czech Republic confirmed
African swine fever

A) in accordance with Annex no. 1 hereto shall report to the Commission and
contagion to other Member States and provide information about

First outbreaks of African swine fever which was confirmed in
holdings

Second cases of African swine fever have been confirmed in a slaughterhouse
or means of transport,

Third primary outbreaks of African swine fever which was confirmed by
wild boars,

Fourth the results of the epidemiological investigation carried out in accordance with § 8

B) in accordance with § 16 para. 3 point. a) and § 16 para. 4
provide the Commission and other Member States on the further cases confirmed in feral pigs
in areas contaminated with African swine fever.

§ 4

Measures in cases of suspected presence of African swine fever in the economy


(1) Where a holding one or more pigs suspected of being infected
African swine fever virus, regional veterinary authority in
accordance with § 13 and § 49 para. 1 point. d) of the Act and in accordance with the procedures laid down in the
diagnostic manual immediately take measures to
confirm or rule out the presence of the disease.
Official veterinarian will check whether the pigs on the farm marked by

(2) Unless the economy can rule out the presence of African swine fever
launch regional veterinary authority in accordance with § 13 and § 49 para. 1 point.

pigs, feed, tools, materials or wastes through which
can transmit African swine fever virus; pork meat and products from
this meat, sperm, egg cells or embryos of pigs shall not be taken away from
economy for the purpose of trafficking within the European
Community

F) the movement of persons to or from the holding was subject to written consent
regional health authorities issued in accordance with § 13 and § 49 paragraph
. 1 point. d) of the Act,

G) the movement of vehicles to or from the holding
subject to the written consent of the regional health authorities
issued in accordance with § 13 and § 49 para. 1 point. d) of the Act,

H) at the building entrance and exits from the buildings in which they are housed

(3) Where required by the epidemiological situation, the regional veterinary administration

§ 5

Measures in case of confirmation of African swine fever in the economy


(1) In cases when it was officially confirmed the presence of African swine fever in
economy, the competent authority in accordance with § 15 of the Act, except
protective and control measures referred to in § 4 para. 2 to | ||
A) all the pigs on the farm under official supervision immediately killed
way as to prevent risk of the spread of African swine fever virus during transport or
spending,

B) in accordance with the diagnostic manual was removed when pigs are killed

under the supervision of an official veterinarian

G) the buildings used for housing pigs, the vehicles used to transport pigs or
their bodies, equipment, bedding, manure and slurry
that may be contaminated are cleaned after removal of pigs, possibly
freed from insects and disinfected in accordance with § 12

H) in the case of a primary outbreak, the virus isolate in order to determine the genetic type

I) in accordance with § 8, an epidemiological investigation.

(2) In cases where an outbreak has been confirmed in the breeding of animals,
zoo, game preserve, game or book a fenced area where
pigs are kept for scientific purposes or for the purpose of conservation of the species || | or rare breeds, the State veterinary Administration may decide to
exception of paragraph 1 point. a) and e) provided that they are not adversely affected

§ 6

Measures in case of confirmation of African swine fever in
holdings consisting of different epidemiological units

(1) Where the presence of African swine fever is confirmed in holdings,

§ 7

Measures in contact holdings

(1) Holdings are recognized as contact holdings where the official veterinarian finds

holding referred to in § 4 and § 5, or from the holding referred to in

§ 8
Epidemiological investigation


(1) The Regional Veterinary Administration in accordance with § 13 para. 1 point. d) and § 49 paragraph
. 1 point. d) of the Act conducted an epidemiological investigation to determine
suspected cases or outbreaks of African swine fever
through questionnaires prepared within the framework of contingency plans
specified in § 21 of

(2) the epidemiological investigation deals with at least

occurring in the economy prior to the announcement of infection or suspected infection

B) the possible origin of African swine fever in the economy and finding
other holdings in which pigs may have become infected from the same source

(3) If the results of this inquiry suggest that African swine fever
could spread from farm or farms which are located in
other Member States, the State Veterinary Administration shall promptly inform this fact
the Commission and the Member States concerned.

§ 9

Establishment of protection and surveillance zones

(1) Immediately after official confirmation of African swine fever in pigs in
holding, the regional veterinary administration in accordance with § 15 and § 49 paragraph
. 1 point. d) of the Act protection zone with a minimum radius of three kilometers around the outbreak

(3) Regional Veterinary Administration shall take all necessary measures, including the use

protection zone and supervision of the restrictions in accordance with § 10 and

§ 10

Measures in the established protection zone

(1) The Regional Veterinary Administration in accordance with § 15 and § 49 para. 1 point. d)
f) of the Act shall ensure that in the protection zone was implemented following measures


A) as soon as possible a census of all the holdings;
official veterinarian within seven days after establishment of a protection zone
makes the economy clinical examination of pigs and control
labeling and registration of pigs under a special legal regulation, 5)

holdings located in the protection zone,

(2) Where the prohibitions set out in paragraph 1 are maintained beyond 40 days because of further outbreaks
infection may regional veterinary authority
with respect to the protection and welfare of animals or because of other problems associated with breeding
pigs under the conditions described in paragraph 3 on the basis

protection zone for direct transport

A) a slaughterhouse designated regional veterinary administration, located
if possible, in the protection zone and the surveillance zone for immediate slaughter,


B) a processing plant or a suitable place where the pigs are
immediately killed and their carcasses are processed under official supervision
veterinarian

C) under exceptional circumstances, to other premises located in the protection zone

Standing Veterinary Committee.

(3) If stipulated by the provisions of this Decree, the regional veterinary administration
authorize removal of pigs from the holding concerned, on condition that


A) an official veterinarian has carried out in accordance with the procedures laid down in the diagnostic manual
clinical examination of the pigs in the economy, especially
those pigs to be removed from the holding, including

pigs under a special legal regulation, 5)

C) the pigs are transported in vehicles sealed

transporting cleaned and disinfected in accordance with § 12

E) if the pigs are to be slaughtered or killed, taken from them
sufficient number of samples in accordance with the diagnostic manual in order
confirm or exclude the presence of African swine fever virus in these holdings

F) if the pigs are to be transported to the slaughterhouse,

§ 11

Measures in the established surveillance zone

(1) The Regional Veterinary Administration in accordance with § 15 and § 49 para. 1 point. d)

A) a census of all pig holdings,

B) the movement and transport of pigs on the road, in case
needs with the exception of tertiary roads of holdings, or

without unloading or stopping, or to slaughter pigs,

pigs, subject to the conditions specified in § 10 paragraph. 3, based on a reasoned request

A) a slaughterhouse designated regional veterinary administration, located
if possible, in the protection zone and the surveillance zone for immediate slaughter,

B) to decontamination enterprise or a suitable place where the pigs are
immediately killed and their carcasses are processed under official supervision
veterinarian or

C) under exceptional circumstances, to other premises located in the
protection or surveillance zone; The State Veterinary Administration in case
use of this provision shall immediately inform the Commission
Standing Veterinary Committee.

(3) The measures applied in the surveillance zone must be maintained at least until
until

A) in the infected holdings have performed cleaning, disinfection, disinfestation

B) pigs on all holdings undergo clinical and laboratory
tests carried out in accordance with the diagnostic manual in order

(4) Notwithstanding the provisions of paragraph 1 point. f) and the provisions of paragraphs 2 and 3

§ 12


Cleaning, disinfecting

Cleaning, disinfection and disinfestation imposed in accordance with § 13 para. 1
point. c) and § 49 para. 1 point. d) of the Act are implemented

A) approved disinfectant and insecticide resources and
concentrations approved by the Regional Veterinary Administration

B) under official supervision in accordance with the instructions of the official veterinarian
and in accordance with the principles and procedures laid down in Annex no. 2 to this Decree
.

§ 13

Restocking in pig holdings

(1) To re-housed pigs to holdings referred to in § 5
may occur in accordance with paragraphs 2-5 earlier than 40 days after completion of the cleaning, disinfection
or disinfestation in the economy concerned.

(2) Re-housing pigs responsible farming method used by the concerned
economy and one of the procedures set out in paragraphs 3 and
fourth

(3) In the case of holdings where the occurrence of disease has not been linked to vectors,
the following procedure is applied

§ 14

Measures in cases where African swine fever or
confirmation of African swine fever in a slaughterhouse or means of transport

(1) If there is a suspicion of African swine fever in a slaughterhouse or
vehicle, regional veterinary authority in accordance with § 15 and § 49 paragraph
. 1 point. d) of the Act shall, in accordance with the procedures laid down in

Diagnostic manual to make arrangements to confirm or rule out the presence
that disease.

(2) If it is detected case of African swine fever in a slaughterhouse or means of transport
ensure regional veterinary authority in accordance with §
15 and § 49 para. 1 point. d) of the Act that

A) all susceptible animals in the slaughterhouse or means of transport were killed
without delay,

B) of the body, offal and animal waste originating from animals that could be infected
they have been processed under the supervision of the official veterinary
doctor

C) cleaning, disinfection or disinfestation plant and equipment, including means of transport
carried out under the supervision of the official veterinary

§ 15

Measures in cases where African swine fever or
confirmation of African swine fever in feral pigs

(1) If the regional veterinary administration in accordance with § 15 and § 49 para. 1
point. d) of the Act shall be informed that the wild pigs are suspected of being infected,
take all appropriate measures to confirm or rule out the presence of infection
inform pig farmers and users of hunting ground ^ 9) and performs
examination of all captured or dead pigs wild, including
laboratory tests.

(2) The Regional Veterinary Administration in accordance with § 15 and § 49 para. 1 point. d)
Act immediately after the confirmation of a primary case of African swine fever in feral pigs

processed under the supervision of an official veterinarian

D) ensure that isolate African swine fever virus was in order

(3) In the event that the African swine fever has occurred in feral pigs in the area
located on the territory of the Czech Republic close to the territory of another Member State

§ 16

Plans for the eradication of African swine fever in the feral pig population

(1) Without prejudice to the measures provided for in § 15, the State Veterinary Administration

O) of paragraph 2 of the Law Commission and the other Member States. If these changes
concern other provisions of the plan, the State Veterinary Administration
submitted in accordance with § 10 paragraph. 2 and § 48 para. 1 point. a) point 2 of the Act
amended plan to the Commission for review and possible approval.

(2) Upon approval of the measures provided for in the plan mentioned in paragraph 1
replace those measures from the date specified in the granting approval default
measures set out in § 15.

(3) The plan referred to in paragraph 1 shall contain information about

A) the results of the epidemiological investigations and controls carried out in accordance with § 15
and information on the geographic distribution of the disease,

B) definition of the infected area within the territory of the Czech Republic;
when defining the infected area of ​​the State Veterinary Administration will take into account

First the results of the epidemiological investigations and the geographical distribution

Third the existence of major natural or artificial obstacles to movements of feral pigs

E) procedures to determine the extent of the infection in the population of wild boars
through examination of wild boars hunted by hunters or
dead and laboratory tests, including epidemiological investigation

F) requirements to be observed by hunters to prevent the spread of disease

G) the method of disposal of dead or hunted wild pigs
, which is based on

First processing under official veterinary supervision or

Second inspection by an official veterinarian and laboratory examinations
laid down in the diagnostic manual;
positive carcasses of animals are processed under official veterinary supervision;
If the examinations for African swine fever negative, are applied

Third the person who found the animal or caught,

Fourth age and sex of the pig,

Fifth in the case of a pig caught on symptoms before killing,

6th in the case of a dead pig on the state of the carcase,

7th results of laboratory tests

I) the control of animal health and conservation measures applicable
holdings located within the infected area or
in its surroundings, including the transport and movement of animals in this area, from

(5) The decision of the European Union institutions may be established

§ 17

Measures to prevent the spread of African swine fever virus by means of vectors


(1) If there is a possibility of occurrence of vectors or if there
suspected presence of vectors in the economy, which has been confirmed
African swine fever, the regional veterinary administration in accordance with § 15 and § 49 paragraph
. 1 point. d) of the Act shall ensure that

A) the infected building and its surroundings were checked for the presence of vectors
physical inspection or sampling odchycením vectors in accordance with Annex
no. 3 hereto,

B) if the incidence of vector borne,

First It was made necessary laboratory tests to confirm or rule out the presence
African swine fever virus in the vectors,

Second in the economy and in the area around the economy performed more

(3) The decision of the European Union institutions may be established
further measures for monitoring and control of vectors and prevention of African swine fever.

§ 18

Diagnostic procedures and biosecurity requirements

(1) Diagnostic methods, sampling and laboratory testing to detect the presence
African swine fever diagnostic manual controls.

(2) The National Reference Laboratory for African swine fever is responsible for
coordinating standards and diagnostic methods in accordance with Annex no. 4 to
hereto and cooperates with the European Reference Laboratory

Community as set out in Annex no. 5 hereto.

(3) To ensure adequate bio-security conditions
protecting animal health can to manipulate the African swine fever virus, its
genome, antigens and vaccines for research, diagnosis or manufacture or use these applications
only in places, businesses and
laboratories approved by the State veterinary administration. The State Veterinary Administration
presented in accordance with § 10 paragraph. 2 and § 48 para. 1 point. o)
point 2 of the Law Commission of the list of approved places, businesses and laboratories starting
2004 and update this list.

(4) The data specified in Annexes Nos. 4 and 5 hereto and in the diagnostic manual
be supplemented or amended in accordance with the decision
institutions of the European Union.

§ 19

Use, manufacture and sale of vaccines against African swine fever

(1) Vaccination against African swine fever is prohibited.

(2) production, storage, supply, distribution and sale of substances
vaccines against African swine fever may occur only under state
veterinary supervision.

§ 20

Checks the European Communities

Where the Commission implements its experts on-site inspection in the Czech Republic
order to ensure uniform application of the European Communities,

§ 21
Contingency plans


(1) The State Veterinary Administration in accordance with § 10 paragraph. 1 and § 48 para. 1
point. c) of the Act drawing up a contingency plan specifying the national
measures to be implemented in the case of African swine fever
. This plan takes into account local factors that may affect
spread of African swine fever, as the density of pigs,
same time must allow access to facilities, equipment, personnel and all other appropriate

(2) In drawing up the contingency plan shall be applied
criteria and requirements set out in Annex no. 6 to this Decree;
those criteria and requirements may be amended or supplemented
decisions by the institutions of the European Union, taking into account the special characteristics of African swine fever and

(3) The State Veterinary Administration updated contingency plan every five years
and submit it for approval to the Commission. The Commission will review this plan,
to determine whether it permits the desired objective, and
propose any amendments required in particular to ensure the compatibility of

§ 22

Disease control centers and the expert group

(1) In the event of outbreaks of African swine fever in connection with
extraordinary veterinary measures in accordance with § 15 of the Act shall
established within the State Veterinary Administration

(2) The National Crisis Management Centre of Disease control manages and monitors the activities of the regional crisis
disease control centers referred to in paragraph 3;

transmissible from animals to humans.

Fourth The State Veterinary Administration ensure that the information to be
provided in accordance with paragraphs 1-3, and concern
outbreak or case of African swine fever in a holding, slaughterhouse or means of transport
were as soon as possible by a written report
to the Commission and other Member States, stating at least

A) the date on which the pigs in the holding, slaughterhouse or means of transport
killed and their carcases processed

B) the results of laboratory tests of samples taken after killing
pigs

C) in the case of the exceptions set out in § 6 para. 1, the number of culled pigs
and processed and the number of pigs to be slaughtered later,

PRINCIPLES AND PROCEDURES FOR CLEANING, disinfection and disinfestation

First General principles and procedures:

A) the cleaning, disinfection or insect and rodent control using
officially approved funds must be carried out under official supervision and in accordance with the instructions
official veterinarian

B) the disinfectants to be used and their
concentrations must be officially approved by the competent authority to
ensure destruction of African swine fever virus,

C) the efficacy of disinfectants must be regularly checked before use
because the efficacy of certain disinfectants is
long storage decreases

D) the choice of disinfectants, insecticides and of procedures for disinfection and disinfestation
must match the type of premises, vehicles and objects
to be treated,

E) conditions for the use of detergents, disinfectants and insecticides
must ensure not to reduce their
efficiency; in particular, they must be respected
technical parameters indicated by the manufacturer, such as pressure, minimum temperature and required contact time,

F) irrespective of the kind used disinfectant must be applied
following general rules

First thorough soaking of bedding and faeces disinfectant

Second washing and cleaning floors, ramps and walls thorough scrubbing, if possible
after the removal or dismantling of equipment or wiring that could
reduce the effectiveness of cleaning and disinfection

Third subsequent re-use disinfectant for at least
action specified in the manufacturer's recommendations

Fourth Water used for cleaning must be in accordance with the instructions of the official veterinarian
disposed so as to prevent the risk of spreading the virus
,

G) where washing is carried out by fluid under pressure must be prevented

A) preliminary cleansing and disinfection

First when killing animals must be taken all necessary measures
prevent or reduce the spread of African swine fever virus;
these measures include inter alia the establishment of temporary disinfection equipment, providing
protective clothing, showers, decontamination of used equipment, instruments and equipment
and interruption of power supply to the ventilation

Second carcases of killed animals must be sprayed with disinfectant

INSTRUCTIONS vector search

First This must be done to find vectors in the living quarters and rest
pigs and around these places. Vectors can generally be found in
old buildings in shaded areas with favorable temperature and humidity
. The best results are obtained when the vector search
takes place in late spring, summer and early autumn, a period when
vectors are most active.

Fifth organize periodic comparative tests of diagnostic procedures

6th collects and evaluates data and information used
diagnostic methods and the results of tests performed,

7th classifies virus isolates latest methods available to
better understanding of the epidemiology of African swine fever,

8th monitors developments in the area of ​​surveillance, epizootiology and prevention

viruses to enable rapid differential diagnosis

B) organizing training and retraining of experts in laboratory diagnosis
with a view to harmonizing diagnostic techniques

E) draw up a technical report on procedures to verify the efficiency

CRITERIA AND REQUIREMENTS RELATING TO STAND PLANS

Contingency plans must meet at least the following criteria and requirements
:

A) the adoption of measures to ensure the existence of statutory powers
needed to implement contingency plans and the ability to make quick and effective
overcoming the disease

B) the adoption of measures to ensure access to funds for special events
, budgetary means and financial resources in order to cover the costs of overcoming
outbreak of African swine fever

C) establishment of a management structure to ensure rapid and effective decision-making
case of an outbreak; if necessary, to the management structure
subject to central authority responsible for managing all
strategies for fighting disease; Central Director of the State Veterinary Administration must
member of the Central Commission for Infectious and must act as a link connecting
this commission with the national emergency disease control center provided for in
§ 22

D) the adoption of measures to ensure the availability of resources for rapid and
effective campaign, including laboratory staff, equipment and infrastructure
,

E) providing instruction manuals containing complete and detailed description
all the procedures, instructions and measures to be used in case
African swine fever,

F) laboratory staff must regularly attend

First training programs dealing with clinical symptoms
African swine fever, epidemiological surveys and the damping of the disease,

Second alert exercises organized at least twice a year,

Third Training dealing with methods of communication within the organization
information campaign aimed at competent authorities, farmers and veterinarians
in connection with the occurrence of the disease.
