DECREE



of 21 June 1999. in March 2007,



laying down the details of the marking and colouring of the selected

mineral oils and tagging of certain other mineral oils

The Ministry of industry and trade shall be determined according to § 139 paragraph 2. 3 of Act No.

353/2003 SB., on the Excise Tax Act, as amended by Act No. 217/2005 Coll. and

law no 575/2006 Coll. (hereinafter the "Act") to implement section 134a para. 2,

§ 134 b of paragraph 2. 3, § 134e para. 3, para. 6 (a). (d)) and paragraph 2. 7, § 134l

paragraph. 2, § 134 m para. 3 and § 134p para. 3, para. 6 (a). (d)) and paragraph 2. 7

§ 1



This Decree was notified in accordance with the directive of the European Parliament

and Directive 98/34/EC of 22 December 2004. June 1998 on the procedure for the provision of information

in the field of technical standards and regulations and of rules on information

the company, as amended by Directive 98/34/EC.



§ 2



The kind of marker and dye



(1) The marking and colouring of mineral oils as referred to in § 134 b of paragraph 1.

1 of the liquid mixture is used to markup a substance, the chemical name

added N-ethyl-N-[2-(1-isobutoxy-ethoxy) ethyl]-4-(fenylazo) aniline with

identification colour SOLVENT YELLOW 124, and in particular

red dye Solvent Red 19. For the tagging is used at least 6

mg of marker per litre of mineral oil and such minimum

the amount of dye, which is colored mineral oil Red

and will be qualitatively detectable.



(2) The marking of mineral oils as referred to in § 134 m para. 1 (b).

b), c), (d)) and e) of the Act is used for marking a substance whose chemical

the name sounds N-ethyl-N-[2-(1-isobutoxy-ethoxy) ethyl]-4-(fenylazo) aniline

with the identification colour SOLVENT YELLOW 124. For tagging

is it at least 6 mg of marker per litre of mineral oil.



Method of sampling



§ 3



(1) a sample of the mineral oil referred to in § 2 (hereinafter referred to as "pattern") are

shall be entitled to remove the Customs authorities and the Customs Directorate, regional financial

authorities or the Czech trade inspection ^ 1) (hereinafter referred to as "the competent State

§ 4



(1) if the competent national authority for mineral oil that is not

allowed to tag and coloured according to § 134 b of paragraph 2. 2 of the Act, discoloration

(3) unless the competent national authority when checking for mineral

§ 5



(1) the minimum volume of sample taken is 210 cm3, in the case that

controlled person does not request a sample for your own use, it is the minimum

the controlled person at least 70 cm3.



(2) the competent national authority shall ensure that, in order to avoid destruction, confusion,

§ 6



(1) every time you sample the competent national authority shall draw up a protocol.



(2) the Protocol provides:

(3) the Protocol shall be drawn up in two copies. Both copies must be

signed by all interested parties. A copy of the Protocol, the

(4) if the sample is delivered to the person shall be accredited by the competent

§ 7



(1) the competent national authority shall deliver a sample after sampling the

§ 8



The method of keeping records



(1) natural persons and legal persons that manufacture, process,


transport, storing, purchase or otherwise acquire, sell or

consume the mineral oil listed in § 2 shall maintain a register and

be carried out weekly payments on the types, quantity and quality produced,

processed, imported, stored, reproduced, and published

mineral oils, including self-employed individuals and ^ 3)

the persons who supplied them with mineral oils, as well as the

legal entities and natural persons, which mineral oils shall be issued.



(2) the natural persons and legal entities that handle with mineral oil

referred to in section 2 shall keep a register of issued and received acknowledgments of

quality mineral oils.



(3) the manufacturer of the mixture of dye or marker and marker

shall maintain a register and shall carry out the weekly balance of the quantity, characteristics, and

the composition of the produced mixture marker and dye or marker

substances, on natural persons and legal entities, which blend

marker and dye or marker substance supplied. Users

a mixture of marker and dye or marking level shall keep a register of

the quantity, characteristics and composition, taken a mixture of marker and

(4) the register kept under paragraphs 1 and 3 shall be indicated on the legal

§ 9



(1) the list of mineral oils must not be tag your tracks and dyed (§

134 b of paragraph 2. 3 of the Act), for the reason that the tagging and coloring might be on

the failure to use them, is given in annex 3 to this notice.



(2) the list of mineral oils must not be tag your tracks (§ 134 m

paragraph. 3 of the Act), for the reason that the tagging may have been the fault of their

use, is set out in annex 4 to this notice.



§ 9a



(1) the list of technologies for which tagging and mineral coloring

oils on the failure of their use (section 11 of the Act 134e paragraph) is given in

Annex No. 5 to this Decree.



(2) the list of technologies for which tagging of mineral oils on

the failure to use them (paragraph 134p paragraph 11 of the law), is given in annex No.

6 to this Ordinance.



§ 10



Transitional provision



The competent national authorities shall, in dealing with a sample taken

before the date of entry into force of this order in accordance with this Ordinance.



§ 11



The effectiveness of the



This Decree shall take effect on the date of its publication.
