of 7 November. December 2012
about the elements of the request for grant, amendment, renewal and cancellation
authorization for the construction of selected gas devices, including model
of applications and the conditions for the examination of these requests
The Ministry of industry and trade shall be determined according to section 98, para. 1 (b). (d))
Act No. 458/2000 Coll., on conditions for business and public administration
in the energy sectors and on amendments to certain acts (the energy
Act), as amended by Act No. 211/2007 Coll. and Act No. 165/2012:
§ 1
The subject of the edit
This Decree sets out the particulars of applications for grant, amendment, extension of the
and revoke authorization for the construction of selected gas devices (hereinafter referred to as
"authorization"), including patterns of applications and the conditions for the examination of these
of the applications.
§ 2
Application for the grant, extension and revocation of authorization
(1) an application for an authorization shall be filed for each of the selected gas
the device separately.
(2) an application for an authorization is given to all new selected
gas equipment, and also in cases of reconstruction of the existing selected
gas devices, if the replacement of the device to improve their
capacity, with the exception of shifting of selected gas devices.
(3) the application for an authorization Pattern on the construction of a direct gas pipeline is
listed in annex 1 to this notice, model application for the grant of
authorization for the construction of the stack gas is given in annex 2 to this
the Decree, the application for an authorization pattern on the construction of a gas pipeline
connecting the gas system with foreign gas
systems is given in annex 3 to this Decree, a model application for
the granting of authorization for the construction of a gas pipeline on the pressure level higher than 0.4
MPA is given in annex 4 to this Decree, a model application for the grant of
authorization for the construction of the gas plant, producing gas and biometan ^ 1) ^ 2)
is given in annex 5 to this Decree.
(4) an application for renewal of authorization, the holder of the authorization and shall be served in the
it granted the authorization number required for the extension of the
authorization and the cause of its extension.
(5) a request for cancellation of the authorization, the holder of the authorization and shall be served in it
the number of the granted authorisation and the reason for its cancellation.
§ 3
Examination of applications
When deciding on the application for an authorization referred to in section 2 of the Ministry of

and construction of selected gas) whether the device is in accordance with State
energy concepts,
(b) whether the construction of the selected) the gas equipment is in accordance with the territorial
energy concepts,
(c)) the effectiveness, efficiency and cost effectiveness of the proposed construction of the selected
gas equipment,
(d) the financial standing of the applicant to) construction of selected gas
the device,
(e) the importance of the construction of selected gas) device for added security
and dependability of the operation of the gas system and supplies to customers,
(f) the construction of selected gas) whether the equipment complies with the protection
environment, where so provided by another law ^ 3),
g) in stations biomethane, whether their construction is in accordance with the national
action plan for energy from renewable sources.
§ 4
Regulation (EEC)
Shall be repealed:
1. Decree No 245/2001 Coll., on details of the granting State
authorization for the construction of selected gas devices, its changes,
renewal or cancellation.
2. Decree No. 118/2005 Coll., amending Decree No 245/2001 Coll., on the
details of the award of State authorization for the construction of the selected
gas devices, its amendment, extension or cancellation.
3. Decree No. 52/2010 Coll., amending Decree No 245/2001 Coll., on the
details of the award of State authorization for the construction of the selected
gas devices, its changes, cancellation, or extension, as amended by
Decree No. 118/2005 Sb.
§ 5
The effectiveness of the
This Decree shall enter into force on 1 January 2000. January 1, 2013.

Annex 1
An application for an authorization PATTERN on the construction of a direct gas pipeline
Part A-information on the applicant
I. information on the applicant who is a natural person-entrepreneur:
1. First and last name, where appropriate, the Appendix distinguishing person entrepreneur
or kind of business related to that person, or operated by the
the type of business.
2. the identification number of the person.
3. the address registered in the commercial register or other statutory
register as a place of business.
4. where applicable, any other delivery address, if different from the business address.
5. date of birth, social security number (if one has been assigned).
6. connection to the applicant or other person empowered to act on his behalf
(phone, fax, e-mail).
II. Information on the applicant which is a legal person:
1. the name or business name.
2. the identification number of the person.
3. the address of the registered office.
4. where appropriate, the address for service, if different from the address of the registered office.
5. Link to the person authorized to act on behalf of the applicant (phone, fax,
email).
III. In the event that the applicant does not finance the pipeline, the data shall also be
about the investor, and
that
1. in the case of the investor that is entrepreneurial natural person, shall be
the information in the scope of paragraph (I),
2. in the case of an investor, which is a legal person, the business
details in the scope of paragraph (II).
In these cases, the application connects also the proposal of the rental agreement
gas equipment, if it is closed.
Part B-information about the direct pipeline
1. the expected location of the gas pipeline-County, municipality, district,
which will be a direct gas pipeline located and situational sketch of pipeline to the
image maps in the scale 1:25, 000.
2. the Purpose of the construction of a direct gas pipeline.
3. Date envisaged for the commencement and completion of construction and term
the expected launch of a direct pipeline to the operation.
4. the period of validity of the authorization Required.
5. basic data on the direct pipeline
-length (km)
-diameter gas pipeline (in mm),
-max. and min. operating pressure at the connection point (in MPa),
-the projected max. performance (000 m3/hour),
-transport capacity (million m3/year),
-the projected annual usage of a projected capacity (in%),
-the place of connection to the transmission system on the territory of the Czech Republic or to the
foreign natural gas system,

Part A-information on the applicant

Foreign gas systems

the cadastral area of the village, on which the pipeline will be located, and situational

2. characteristics of the pipeline-including technological and construction
objects that are a part of it with a detailed justification of the purpose of the construction
and its transport function.
3. Estimated date for the start and end of construction and expected
term of putting into operation of the pipeline.

5. Basic information on gas pipeline

-operating pressures on input and output (in MPa),

regulations, is:

under another law ^ 3), if so this regulation provides.
2) contract for connection to a foreign transmission system or to
Foreign distribution system, to which the pipeline is connected. In
If the operator and the applicant is one and the same natural person or
a legal entity, this contract is replaced by the expression operators
justification the link and an assessment of the impact on the existing gas
the system of the United States.
3) documents proving the applicant's financial projections for the construction
the gas pipeline.
4) in case the link transmission system, documents proving the

system or tank of gas in the event that the applicant for the authorization of the

gas production in full its projected maximum performance.
