on measures for the control of foot and mouth disease and its prevention, and
amending Decree No. 299/2003 Coll., on measures for the prevention and
control of diseases and diseases transmissible from animals to humans, as amended by
Decree No. 356/2004 Sb.

The Ministry of agriculture lays down pursuant to § 78 of Act No. 167/1999 Coll., on the
veterinary care and amending certain related laws (health
Act), as amended by Act No. 131/2003 Coll. and Act No. 316/2004 Coll. (hereinafter referred to
"the Act") to implement section 10, paragraph 1. 3 (b). a) and g) and § 51a para. 3
the law:
PART THE FIRST
MEASURES FOR THE CONTROL OF FOOT AND MOUTH DISEASE AND ITS PREVENTION
TITLE I OF THE
INTRODUCTORY PROVISIONS
§ 1
The subject of the edit
This Decree in accordance with the law of the European Union "^ 1") governs
and) measures to control foot and mouth disease, applicable in cases
of an outbreak of that disease of whatever type of virus,
(b)) animal health requirements for animals and animal products originating in
the protection zone and the surveillance zone and restricted zone, as well as to the treatment of

(c)) the animal health conditions for emergency vaccination against foot-and-mouth disease,
(d)) the animal health measures to prevent foot-and-mouth disease, followers
in particular, to ensure effective protection against that disease and increase
preparedness of the competent authorities and people on its incidence.
§ 2
Definition of terms
For the purposes of this Ordinance, means the
a) animal of susceptible species-any of the animal, the animal in the

referred to in annex 1 to this notice, on the basis of clinical

with annex 13 to this Decree,

TITLE II
CONTROL OF FOOT-AND-MOUTH
Part 1
Reports of foot and mouth disease
§ 3
(1) the breeders and people who treat animals accompany them during

Part 2
Measures for the control of foot-and-mouth
Section 1
Measures in case of suspicion of an outbreak of foot and mouth disease
§ 5
Protective and control measures in case of suspicion of an outbreak of
foot and mouth disease
(1) if the holding contains one or more animals suspected of being infected
or suspected of being contaminated, regional Veterinary Administration will launch
without delay and to be carried out in the exercise of State veterinary supervision
investigation to confirm or exclude the presence of foot-and-mouth

§ 7
Extension of measures on other holdings
(1) Safeguard and control measures referred to in paragraph 5 and 6 can be applied
in relation to another holding, whose position, design and
arrangement, or contacts with animals from the holding referred to in paragraph 5 of the
reason to suspect possible contamination.
(2) the regional Veterinary Administration shall apply the protective and control measures
referred to in section 5 and section 6 (1). 1 also on the premises or means of transport

§ 8
The temporary surveillance zone
(1) the regional veterinary services may, in accordance with § 13 and § 49 paragraph 1. 1
(a). (d)), or (b). (c)) of the Act define the temporary surveillance zone
where required by the epidemiological situation, in particular in cases of high
the concentration of animals of susceptible species, intensive movement of animals
or movement of persons in contact with animals of susceptible species, the delayed

§ 9

(1) the regional Veterinary Administration may, on the basis of the epidemiological

Protective and control measures in case of confirmation of an outbreak of foot and
mouth disease
(1) if in an officially confirmed an outbreak of foot and

§ 12
Cleaning and disinfection

protective and control measures provided for in this Decree shall be

§ 14
An epidemiological inquiry
(1) an epidemiological inquiry relating to outbreaks of foot-and-mouth
especially for this purpose shall be carried out by trained official veterinary surgeons on
the basis of questionnaires, prepared within the framework of the national contingency
the plans of action for maintaining a high level of awareness and preparedness
the presence of foot-and-mouth, as well as environmental protection (hereinafter
"a contingency plan") referred to in section 68, so as to ensure

§ 15
Additional measures in case of confirmation of an outbreak of foot-and-mouth
(1) the regional veterinary services may, in accordance with section 15 and section 49 paragraph 2. 1
(a). (d)) of the Act require that, besides the animals of susceptible species have been killed
also animals of species not susceptible to foot-and-mouth disease, which are
present on the holding where an outbreak of foot and was confirmed

Measures in special cases

§ 17

§ 25
Measures concerning meat products produced in the protection zone
(1) into circulation cannot be exposed meat products derived from animals of susceptible
species originating in the protection zone.

the protection zone
(1) into circulation cannot be animal products, not listed in § 24 to 30,
derived from animals of susceptible species originating in the protection zone.
(2) on the basis of the authorization (section 33), however, the ban on the marketing of other livestock
products referred to in paragraph 1 shall not apply to the products listed in
paragraph 1, which
a) were produced at least 21 days before the date considered to be the beginning
the disease on the holding referred to in article 11 (1) 1 and have been stored and
transported separately from products produced after that day,
(b)) have been treated in accordance with point 4 of part A of annex 7 to this
the Decree,
(c)), in the case of special products, the conditions laid down in points
5 to 9 of part A of annex # 7 to this Decree,
(d)) are a mixture of products that are not subject to further treatment and contain
other animal products that have been subjected to treatment having
the destruction of possible foot-and-virus or come
animals which are not subject to protective and zdolávacím measures pursuant to

(e)) are packed and intended for use as in-vitro diagnostic reagent
or as a laboratory reagent.
§ 32
Measures relating to animal feed, bulk feed, hay and straw originating in the

animals of susceptible species are kept, if this roughage and straw
comply with the requirements referred to in point 1 of part B of annex 7 to this
the Decree.
§ 33
Authorization of derogations and additional certification
(1) derogations from the prohibitions referred to in section 23 to 32 permits regional
animal health management in accordance with § 49 paragraph 1. 1 (b). g) of the Act by a decision of

Measures in holdings in the surveillance zone
(1) the regional veterinary services in accordance with section 15 and section 49 paragraph 2. 1 (b).
(d)), or (b). (c)) of the Act shall ensure that in the surveillance zone
applied protective and control measures referred to in section 21 para. 1.
(2) the regional veterinary services may, however, in accordance with § 49 paragraph 1. 1 (b).
g) of the Act permit the transport of animals of susceptible species from holdings in
the surveillance zone for the purpose of slaughter directly to a slaughterhouse located outside the
the surveillance zone, where the capacity for the slaughter of animals in the surveillance zone

(3) the authorisation for the transport of animals to the slaughterhouse referred to in paragraph 2 may be given

§ 37
The movement of animals of susceptible species within the surveillance zone
(1) animals of susceptible species may leave the holding within the zone
supervision.
(2) the regional veterinary services may, however, in accordance with § 49 paragraph 1. 1 (b).
g) of the Act allow
and expulsion of animals without) their contact with animals of susceptible species from the
other holdings to pasture situated within the surveillance zone, but not
less than 15 days after the last outbreak of foot-and-mouth
in the protection zone,
(b)) the transport of animals for slaughter to a slaughterhouse located directly in
the same zone, and under the supervision of the official veterinarian,
(c)) the transport of animals in accordance with § 36 odst. 2 and 3,
(d)) the transport of animals in accordance with § 23 para. 2 (a). a) and (b)).
(3) the transfer of the animals referred to
and in paragraph 2 (a)). and), however, can only be enabled when
the basis of examination of all the animals of susceptible species present in
the economy, carried out by an official veterinarian including
examination of samples taken in accordance with section 2.2. Annex No. 3 to this
the Decree, can be ruled out the presence of animals suspected of being infected or
suspected of contamination,
(b) in paragraph 2 (a)). (b)), however, can only be enabled when they are with
satisfactory implemented protection and control measures referred to in
§ 36 odst. 3 (b). a) and (b)).
(4) the regional veterinary services shall ensure the traceability of the animals as soon as possible

§ 38
Measures concerning the fresh meat of animals of susceptible species
originating in the surveillance zone and of meat products produced from such meat
(1) into circulation cannot be
and) fresh meat, minced meat and meat preparations obtained from animals
susceptible species originating in the surveillance zone and of meat products produced
out of such meat,
(b)) fresh meat, minced meat, meat preparations and meat products obtained
from animals of susceptible species produced in the enterprise located in the zone
supervision.
(2) the regional veterinary services may, however, in accordance with § 49 paragraph 1. 1 (b).
g) of the Act may decide to ban the marketing of fresh meat, minced meat
and meat preparations into circulation referred to in paragraph 1 (b). and)
does not apply to
and) fresh meat, minced meat and meat preparations with the date of manufacture, at least
21 days before the date of the beginning of the disease considered holding
located in the corresponding protection zone, from the date of manufacture and storage
transported separately from such meats produced after that date. This meat must
be readily distinguished from meats not eligible for dispatch from the zone
supervision, and by using a clear indication by the special legal
prescription ^ 13);
(b)) fresh meat, minced meat and meat preparations derived from animals
transported to the slaughterhouse under conditions at least as strict as
are the conditions referred to in § 36 odst. 3 (b). a) to (e)), and provided
the meat is subjected to the measures referred to in paragraph 3 (b). and);
c) meat products derived from fresh meat from animals
susceptible species out of the surveillance zone, which bears the health
certificate in accordance with special legislation ^ 12) and which is
transported under the supervision of the official veterinarian until the undertaking
intended for its treatment in accordance with point 1 of part A of annex 7 to this
the Decree.
(3) the regional veterinary services may, however, in accordance with § 49 paragraph 1. 1 (b).
g) of the Act may decide to ban the marketing of fresh meat, minced meat,
meat preparations and meat products referred to in paragraph 1 (b). (b))
does not apply to
and) fresh meat, minced meat and meat preparations which come from
the company, situated in the surveillance zone in which these are true
terms and conditions:
1. the undertaking is under strict veterinary control carried out within
the State veterinary supervision,
2. the undertaking shall only be processed fresh meat, minced meat and meat
semi-finished products referred to in paragraph 2 (a). (b)) and subject to the additional terms and conditions
referred to in part (B) of Annex 8 to this Ordinance, or fresh meat,
minced meat and meat preparations obtained from animals reared and slaughtered
outside the surveillance zone or from animals transported to the enterprise in accordance with §
23 para. 2 (a). (b)),
3. all such fresh meat, minced meat and meat preparations are
bear the health mark referred to in the Special
^ 14) legislation,
4. all such fresh meat, minced meat and meat preparations are
during the whole process of production laid down in a way clearly indicated and
are stored and transported separately from meat, minced meat and meat
preparations which are not eligible under this Ordinance to be sent from
the surveillance zone
(b) meat products produced in the) company located in the surveillance zone
that correspond to the requirements of paragraph 2 (a). (c)), or are made of
meat meeting the requirements of subparagraph (a)).
(4) If fresh meat, minced meat and meat preparations intended for
trading, the health certificate must certify also
compliance with the conditions referred to in paragraph 3. The State Veterinary Administration
accordance with § 48 para. 1 (b). of paragraph 2 of the law) shall transmit to the Commission and the other
Member States a list of the firms approved for certification purposes in
these cases.
(5) the procedure referred to in paragraph 2 may be subject to, in particular as regards
the health marking of meat produced from animals of susceptible
species originating in the surveillance zone, lasting for a period of more than 30 days,
specific conditions laid down by the institutions of the European Union.
§ 39
Measures concerning milk and milk products from animals of susceptible
species produced in the surveillance zone
(1) into circulation cannot be
and) milk derived from animals of susceptible species originating in the surveillance zone
and milk products produced from such milk,
b) milk and milk products derived from animals of susceptible species produced in the
undertaking situated in the surveillance zone.
(2) the regional veterinary services may, however, in accordance with § 49 paragraph 1. 1 (b).
g) of the Act may decide to ban the marketing of milk and milk products to
circulation as referred to in paragraph 1 (b). and) shall not apply to milk derived from
animals of susceptible species originating in the surveillance zone and milk products
made from such milk
and with the date of production) at least 21 days before the date considered to be the beginning
infection on a holding in the corresponding protection zone,
from the date of manufacture stored and transported separately from milk and milk
products produced after that date;
(b) having undergone one of the treatments) listed in part A or B of Annex # 9
This Decree, depending on the further use of milk and milk
products. This treatment shall be carried out in an undertaking situated in the zone
surveillance under the conditions laid down in paragraph 3, or, if no
such an undertaking in the surveillance zone designated by the County in the company-health
the Administration and outside the protection zone and outside the surveillance zone.
(3) the regional veterinary services may, however, in accordance with § 49 paragraph 1. 1 (b).
g) of the Act may decide to ban the marketing of milk and milk products to
circulation as referred to in paragraph 1 (b). (b)) does not apply to milk and milk
products produced on the holding in the surveillance zone in which there are
subject to the following conditions:
and) under strict veterinary control carried out within
the State veterinary supervision,
b) all milk used in the enterprise meets the requirements of paragraph 2 (a).
(b)) or of raw milk obtained from animals outside
the protection zone or surveillance zone
c) milk production during the whole process is set out in a manner clearly
marked and shall be stored and transported separately from milk and milk
products which are not destined for dispatch outside the surveillance zone,
d) raw milk from holdings situated outside the protection zone
outside the surveillance zone and transported to the means of transport
before the shipment has been cleaned and disinfected and then
they do not have any contact with holdings in the protection zone and the zone
surveillance, in which animals of susceptible species are kept.
(4) if the milk intended for trade, the certificate of health
certificate to certify also the conditions referred to in paragraph 3.
The State Veterinary Administration in accordance with § 48 para. 1 (b). about point 2)
the Act shall send the Commission and the other Member States the list of enterprises
approved for certification purposes in these cases.
(5) in the transport of raw milk from holdings situated within the zone
surveillance in a company situated outside the protection zone and the out of band
surveillance and in the processing of that milk shall be subject to the following conditions:
and the processing of raw milk) obtained from animals of susceptible species
they are kept within the surveillance zone, in a business that is outside of the trade
zone and outside the surveillance zone, has enabled the regional Veterinary Administration;

(6) the collection and transport of samples of raw milk obtained from animals
susceptible species from holdings situated in the surveillance zone to
the laboratory, with the exception of veterinary diagnostic laboratory approved
for the diagnosis of foot-and-mouth, and the processing of the milk in such
the laboratory shall be subject to the consent of the regional veterinary service and measures to
avoid any possible spread of foot and
mouth disease.
section 40
Transport and distribution of dung and manure of animals
susceptible species produced in the surveillance zone
(1) both inside and outside the surveillance zone cannot be transported and spreading manure and
spray liquid manure and manure from holdings and of areas referred to in §
17, which are situated in the surveillance zone and in which the animals are kept
susceptible species.
(2) the regional veterinary services may, however, in accordance with § 49 paragraph 1. 1 (b).
g) of the Act in exceptional circumstances authorise the transport of dung and

§ 41
Measures concerning other animal products produced in
the surveillance zone
Other animal products other than those referred to in sections 38 to 40, may
be marketed if they comply with the conditions set out in section 27, 29, 30 and
31.
§ 42
Additional measures applied in the surveillance zone
(1) the veterinary authorities may, in accordance with section 15 and section 48 para. 1
(a). (c)) or § 49 paragraph 1. 1 (b). (d)), or (b). (c)) of the Act, and when
taking into account the particular epidemiological, zootechnical,
commercial and social conditions in the affected area to receive the infected

§ 43
Repeal of the measures in the surveillance zone
(1) Safeguard and control measures applied in the surveillance zone shall be
observed up to the time when
and since the killing of all) animals of susceptible species and the destruction of
their carcasses in the holding referred to in article 11 (1) 1, and from their
cleaning and disinfection of the holding carried out pursuant to § 12 have passed
at least 30 days,
(b)) in the protection zone have met the requirements referred to in § 35 para. 1,
(c)) it was examined with negative results.
(2) the investigation referred to in paragraph 1 (b). (c)) shall be carried out in accordance with point 1 of the annex
No. 3 to this Decree and includes the measures referred to in point 2.4. Annex No.
3 to that Ordinance in the light of the criteria set out in point 2.1. Annex
No. 3 to this notice.
Section 6
Regionalization, the marking of animals of susceptible species and their control

§ 44
Regionalization
(1) if the spread of foot and mouth disease of large dimensions,

legislation on veterinary checks when dealing with animals ^ 16).
§ 45
Measures in the restricted zone
(1) were introduced to the regionalisation must be taken within the restricted zone

restrictions;

restrictions, as well as their labelling laid down by a specific legislative
regulations ^ 17);
(c)) special certification of animals of susceptible species and products derived from
such animals and products fit for human consumption, which
are eligible for dispatch outside the restricted zone and meet the conditions
required for such a dispatch, the health mark
the manner provided for by specific legislation ^ 17);
d) tracing of animals of susceptible species that has been sent out of band with the
restrictions to other Member States in the period between the probable date
the introduction of foot and mouth disease virus and the date regionalisation. This
the animals shall be isolated under official veterinary supervision
until the official exclusion of the possibility of being infected or contaminated.
(2) Dohledané fresh meat obtained from animals of susceptible species in the zone with the
limitations in the period between the probable date of introduction of FMD virus
and on the day of the introduction of regionalization, must be treated in accordance with point 1
part A of annex 7 to this Decree. Dohledané raw milk and raw
milk products derived from animals of susceptible species and produced in the zone of
limitations in the period between the probable date of introduction of FMD virus
and on the day of the introduction of regionalization, must be treated in accordance with part A of the
or (B) of Annex 9 to this Decree, depending on their further
use, or suspended until such time as the official exclusion of possible
foot and mouth disease virus contamination.
(3) the health marking of the products that have been produced from
animals or from animals of susceptible species originating in the restricted zone
and which are not intended to be put into circulation outside the restricted zone, it must
match any specific measures that have been taken by the authorities

§ 46
The marking of animals of susceptible species
(1) in the event of an outbreak of foot and mouth disease, the animals
susceptible species from the holding in which they are kept only for
provided that they are permanently and indelibly marked in such a way
the authorities of the State veterinary supervision can quickly determine their
the movement and holding of origin, or the holding of any other
which these animals are coming. In the specific cases referred to in section 16 of the

§ 47
Control the movement of animals in the event of an outbreak of foot-and-
mouth disease
(1) the regional veterinary services in accordance with section 15 and section 49 paragraph 2. 1 (b). (c))
the Act will ensure that in the restricted zone
and provide the authorities of the State keepers) veterinary supervision at the
their request with information on the animals that came into their
economy, or is abandoned. In the case of animals of susceptible species are
such information, in particular, the information required in section 17a of the Act;
(b)) the carrier who transported the animals, to provide the authorities of the State

1. place and date of loading of the animals, first and last name, or. business
the company, in the case of a natural person, business name or the name if it is a
legal person, and address of the holding or Assembly Centre,
where the animals are picked up;
2. place and date of the delivery of the animals, first and last name, or. business name,
and place of residence (place of business, if different from the Permanent
stay), in the case of a natural person, business name or the name and address,
in the case of a legal person, the recipient (s);
3. the species and number of animals being transported;
4. the date and place of the cleaning and disinfection of means of transport;
5. the details of the accompanying documents (including their numeric or
another designation);
(c)) to provide authorities with animals traders national veterinary
surveillance at their request, information relating to animals of susceptible species,
which they trade. Such information shall, in particular:
1. first and last name, or. business name, and place of permanent residence
(place of business, if different from place of residence), if the
a natural person, business name or the name and address, in the case of legal
person, breeder, place of origin, date of purchase, categories, number and
designation of bovine animals or registration number of the holding of origin or of the herd
the origin of the pigs;
2. the registration number of the transporter or the truck's license number

3. first and last name, or. business name, and place of permanent residence
(place of business, if different from place of residence), if the
a natural person, business name or the name and address, in the case of legal
person, the purchaser and the destination of the animals;

(2) protective and control measures referred to in paragraph 1 may be
extended to a part or to the whole of zone free of the disease.
Section 7
Vaccination
§ 48
Use, manufacture, sale and control of vaccines and
mouth disease
(1) the manufacture, storage, supply, distribution and sale of vaccines
substances against foot and mouth disease, as well as trading with them shall be subject to
review of the Veterinary Administration under a special legal
prescription ^ 19).
(2) the use of vaccines against foot-and-mouth disease for another purpose
than to induce active immunity in animals of susceptible species, notably in the
the laboratory examination, scientific research or testing
vaccines, is subject to the authorisation of the Veterinary Administration
under special legislation ^ 19) and must be performed under the conditions
biological safety.
(3) unless otherwise provided for in this Decree, is the use of vaccines
substances against foot and mouth disease and hyperimmune sera against
foot-and-mouth disease is prohibited.
§ 49
The decision to introduce emergency vaccination
(1) emergency vaccination may be introduced, taking into account the criteria
referred to in annex 10 to this Decree and provided that it is
at least one of the following conditions is true:
an outbreak has been confirmed) foot and mouth disease and threatens to become an extension
(b)) in connection with the reported outbreaks of foot and mouth disease in the territory of
The United States is taking into account geographical circumstances or
the prevailing climatic conditions threatened by other Member States,
(c)) for reasons of epidemiological contacts between holdings, in which
animals of susceptible species are kept and which are situated on the territory of the United
Republic, where there are outbreaks of foot-and-mouth, and holdings
on the territory of other Member States, are vulnerable to these Member States,
d) Czech Republic is taking account of geographical conditions or
the prevailing climatic conditions threatened by a country that is not a Member
State of the European Union, on whose territory an outbreak of foot and
mouth disease.
(2) the Czech Republic may ask the institutions of the European Union on the decision of the
the introduction of emergency vaccination.
(3) in accordance with section 15 and section 48 para. 1 (b). (c)) of the Act and with this Decree
State Veterinary Administration may introduce emergency vaccination without decision
institutions of the European Union, upon written notification to the Commission, containing
the information referred to in section 50.
§ 50
The conditions for emergency vaccination
(1) in the decision to introduce emergency vaccination shall be specified
conditions for the implementation of this vaccination, in particular:
and the establishment of the zone), pursuant to section 44, in which vaccination is carried out,
(b)) types and age of the animals to be vaccinated,
(c)) the duration of the vaccination,
d) prohibition on the movement of vaccinated and non-vaccinated animals of susceptible species
and their products,
e) special, additional and permanent marking and special registration
the vaccinated animals pursuant to § 46 para. 1,
f) other facts related with extreme health situations.
(2) the purpose of setting the conditions referred to in paragraph 1 is to ensure that
emergency vaccination has been carried out in accordance with section 51, regardless of whether the
the vaccinated animals are subsequently slaughtered or stay alive.
(3) the State Veterinary Administration informs the public about the health
the safety of meat, milk and milk-based products originating from vaccinated
animals intended for human consumption.
§ 51
Protective vaccination
(1) if done in accordance with § 49 and 50 protective vaccination must
and be subject to the vaccination) regionalization under section 44, if necessary
made in cooperation with neighbouring Member States,
b) vaccination to take place quickly and in compliance with the rules of hygiene and
biological safety in order to prevent the spread of the FMD virus
mouth disease,
c) any conservation and control measures in the vaccination zone to be
implemented without prejudice to the provisions of section 6,
d) in the case that the vaccination zone includes part of or the entire protection
or the surveillance zone, be protective and control measures in the protection zone
or the surveillance zone applied in the corresponding part of the vaccination zone
to their cancellation pursuant to § 35 or § 43, and safeguard and control measures
as provided for under section 53 to 57 remain in force even after the abolition of the safeguard and
the disease control measures applied in the protection zone and the surveillance zone.
(2) the vaccination zone is surrounded by a surveillance zone, shall be not less than 10
km, measured from the perimeter of the vaccination area, up to the time of recovery
status free from foot and mouth disease. In the surveillance zone
and) must not be carried out vaccination,
(b)) is intensively done state veterinary supervision,
(c)) shall be subject to the movement of animals of susceptible species, the control of the authorities of the State
veterinary supervision.
§ 52
Suppressive vaccination
(1) if done in accordance with § 49 and 50 suppressive vaccination is carried out
only
and) within the protection zone;
(b)) in the holdings, which are precisely defined and subject to protective
and zdolávacím measures referred to in article 11 (1) 1, in particular under the letter
and the killing of all) animals of susceptible species from the holding, however, such
may be delayed for reasons of logistical problems, or for the purpose of
compliance with § 11 para. 1 (b). (c)), a special legal regulation ^ 20) and
European Union legislation ^ 21).
(2) the State Veterinary Administration in accordance with § 48 para. 1 (b). about point 2)

§ 53
Measures in the vaccination zone during a period starting from the beginning

the laboratory shall be prohibited.
(6) the collection of semen for the purposes of artificial insemination of animals of susceptible species
kept in semen collection centres situated within the vaccination zone
shall be suspended. The regional veterinary services may, however, in accordance with section 49
paragraph. 1 (b). g) of the Act allow the collection of semen at semen collection centre in
the vaccination zone for the production of frozen semen, subject to the
provided that it is ensured that the semen collected during the period
referred to in paragraph 1 is stored separately for at least 30 days, and
that prior to the dispatch of semen from the donor animal

§ 54
Measures in the vaccination zone during the period between emergency vaccination, and
at the end of the investigation and classification of holdings (phase 2)

days from the completion of emergency vaccination and ends at the end of the imposition of measures
referred to in sections 55 and 56, the protective and control measures:

animals before slaughter inspection (ante mortem), particularly of the cavity

(b)) fresh meat, excluding offal, obtained in the course of that period of
vaccinated large and small ruminants may be put into circulation
within the vaccination area and outside this zone only when the following

Clinical and serological survey in the vaccination zone (phase 2-A)
(1) during the period that begins at the earliest 30 days after the end of
emergency vaccination and ends by performing the investigation referred to in paragraphs 2
and (3) shall be carried out clinical and serological survey.
(2) clinical investigation which is carried out in order to identify herds of animals

§ 56
Classification of holdings in the vaccination zone (phase 2-B)

officially ruled out in accordance with § 55 para. 3, can be subject to protective and

§ 57
Measures in the vaccination zone after the completion of the investigation and classification of
the economy until the recovery of status free from foot and mouth disease
(phase 3)
(1) in the vaccination zone during the period from the end of the protective and disease control

non-vaccinated seropositive offspring of vaccinated breeding cows who exist, slaughtered in

conditions for the marketing of the meat into the circulation in its territory or on its

(9) the dispatch of fresh meat obtained from vaccinated pigs and
produced after the end of the period referred to in paragraph 7 and until the
status free from foot and mouth disease pursuant to section 60 of the vaccination
zone shall be governed by the rules laid down by the authorities of the European Union.
(10) when the fresh meat referred to in paragraphs 4 and 6, as appropriate, in
paragraph 8 is intended for trading, certificate health certificate must

the laboratory, with the exception of veterinary diagnostic laboratory approved
for the diagnosis of foot-and-mouth, and the processing of the milk in such
the laboratory shall be subject to the consent of the regional veterinary service and measures to
to prevent any potential spread of foot and mouth disease virus.
(13) other products of animal origin other than those referred to in paragraphs 4
up to 9, 11 and 12, may be put into circulation unless they meet the conditions
referred to in section 29, 30, 31 and 41.

§ 61

PREVENTIVE MEASURES
Part 1
Handling of foot and mouth disease virus
§ 64
The laboratories and establishments authorized to manipulate foot and
mouth disease
(1) to handle live foot-and-mouth virus

laboratories listed in the list of national laboratories in the Member States
authorized to handle live foot-and-mouth virus, published on the

§ 65

§ 66

§ 67
Diagnosis of foot and mouth disease

The contingency plan and the center of disease control
§ 68
The contingency plan

d) transmission of information to the Commission and competent authorities of other Member
States,

f) organising an emergency vaccination and defining vaccination zones
g) connection and cooperation with diagnostic laboratories,
h) coordination of activities with the competent authorities of environmental protection
in the area of the State veterinary supervision and protection of the environment,
I) links with the police and other enforcement authorities in order to ensure
the proper implementation of the necessary measures,
j) connection with the media.
§ 72
The national disease control centre shall be adequately
staffed and materially equipped to manage an efficient eradication campaign.

Part 3
Antigen and vaccine banks
§ 75
National Antigen and vaccine bank
(1) in the framework of the contingency plan can be set up and operated in such a

for storage of stocks of antigens and vaccines for emergency vaccination,
registered under special legislation ^ 19).

§ 76

§ 77

FINAL PROVISIONS
§ 78
If it is found in the implementation of conservation and control measures under this

§ 79

THE CRITERIA FOR PUBLICATION OF AN OUTBREAK OF FOOT-AND-MOUTH

4. State Veterinary Administration shall ensure that the information provided on the
outbreaks or cases of foot and mouth disease in a holding, slaughterhouse
or means of transport in accordance with points 1, 2 and 3 as soon as possible
supplemented by a written report to the Commission and the other Member States, which
at least includes:
and the date of the killing) animals of susceptible species on the holding, slaughterhouse or
means of transport and handling their carcasses;
(b)) the results of the tests carried out on samples taken after the killing of animals
susceptible species;
(c)) in application of the derogation provided for in § 18 of this order, the number of killed and
processed animals of susceptible species and, where appropriate, the number of animals of susceptible
species which are to be slaughtered at a later time, and the time limit specified for their
the losers;
(d)) all information on the possible origin of the disease or the confirmation;
(e)) in the case of a primary outbreak or case of foot-and-mouth on
the slaughterhouse or means of transport, the genetic type of virus which is
the cause of the outbreak or the case;
(f)) in cases where animals of susceptible species have been killed in contact
holdings or in holdings containing animals of susceptible species
suspected of being infected with foot-and-mouth, information on:
I) the date of killing and the number of animals of susceptible species in all categories
killed in each holding and in cases where animals of susceptible
species in contact holdings were not killed, must be provided
information about the reasons for that decision;
II) the epidemiological link between the outbreak or case of foot-and-
mouth disease and each contact holding or the reasons for the
suspicion of foot and mouth disease in each suspected
holdings;
(iii) the results of the laboratory examinations) samples taken from the animals
susceptible species on holdings and in their killing.
5. If the animal disease notification system for any reason is temporarily
functional, use other means of communication.

The INVESTIGATION
1.
Clinical examination
1.1. All animals of susceptible species on holdings must be clinically
examined for signs or symptoms of foot and mouth disease.
1.2. Special emphasis is placed on the animals, which could be a high
likely to be exposed to the virus of foot and mouth disease, in particular animals
transported from risky holdings or animals in close contact with
persons or equipment, which has been in close contact with risk
holdings.
1.3. The clinical examination must take into account the transmission of foot-and-mouth
including the incubation period under section 2 (b). (f)) of this order, and the farming method

1.4. The relevant records kept on the holding must be in detail
reviewed, in particular with regard to data for the purposes of animal health
required by the legislation in accordance with the law of the European Union and
where appropriate, information on morbidity, mortality and abortion, clinical
examinations, changes in productivity and feed intake, purchase or sale
of animals, visits of persons who may be contaminated, and other
important information from the perspective of history.
2.
Sampling procedures
2.1. General provisions
2.1.1. serological sampling shall be carried out:
2.1.1.1. According to the recommendations of the epidemiological team established within
the Group of experts referred to in § 74 of this order, and
2.1.1.2. in support of tracing and-also with regard to the definition in

launched 21 days after removal of the animals of susceptible species from the

disinfection, unless otherwise provided for in this annex.

1.

Part (B)
The plans for the eradication of foot and mouth disease in wild animals
1. without prejudice to the measures referred to in section A, Member States shall submit to the

living animals, hunters, hunting organisations, the institutions of protection
wild animals and veterinary services (animal and public health);
d) information campaign to increase hunters for the adoption of
measures in the framework of the eradication plan;
e) specific efforts made to determine the number of places to stay and groups freely
wild animals with limited contacts with other groups of wild
animals in and around the infected area;
f) approximate number of groups of wild animals referred to in point (e)), and
their size in and around the infected area;
g) specific efforts made to determine the extent of the disease in wild
animals on the basis of examination of wild animals that have been caught
the hunters or found dead, and by laboratory testing, including
epidemiological investigations, broken down by age categories;
h) measures to limit the spread of the disease when the movement of wild
animals and/or contact between the groups of wild animals; This
measures may include prohibition of hunting;
I) measures for the reduction of wild animals, and in particular
young animals of susceptible species in herds of wild animals;
j) requirements, which must comply with the hunters in order to avoid
the spread of the disease;
k) deleting of wild animals that have been found
dead or was caught, that is based on:
I) processing under official supervision, or
II) examination by the official veterinarian and laboratory tests
in accordance with annex 13 to this Decree. The carcasses of all wild
animals found positive as regards foot-and are handled under the
official supervision. If they have these examinations for foot and mouth disease
the negative results, the measures referred to in section 30 paragraph 2. 4 second sentence

l) epidemiological investigation of all wild animals susceptible
species that has been caught or found dead. As part of this investigation
is to fill in a questionnaire which supplies information about:
I) geographical area where the animal was found dead or caught;
(ii)), the date on which the animal was found dead or caught;
(iii)) to the person who found or caught the animal;
IV) age and sex of the animal;
in) when caught: symptoms before hunting;
(vi)) when you find: the State of the carcase;
VII) laboratory findings;
m) monitoring and preventive measures for the economy
animals of susceptible species situated in the defined infected area, and
or in its surroundings, including the transport and movement of animals of susceptible species
inside, out of the zone and to this zone; These measures include
at the very least a ban on the movement of animals of susceptible species, their
semen, embryos or egg cells from the infected area for the purpose of
trade within the European Union;
n) other criteria for lifting the measures taken to eradicate
of the disease in the defined area and the measures applied to holdings in the zone;
about) surveillance and coordinating authority in the execution of the services, which are
responsible for the implementation of the plan;
p) system, which the expert group compiled in accordance with subparagraph (a). (b))
point 1 of part and regularly evaluate the results of the eradication
the plan;
q) measures for the purpose of monitoring the disease, which are conducted
first 12 months after the last confirmed case of foot and
mouth disease in wild animals in the defined infected area; This
measures for the purpose of monitoring shall be carried out for at least 12 months, and
shall at least include the measures that are already in use in accordance with the
letters g), k) and (l)).
5. Every six months, the Commission and the other Member States passed a message
on the epidemiological situation in the defined area and the results of the eradication

6. More detailed rules for drawing up the plans for the eradication of foot-and-
