REGULATION OF THE GOVERNMENT
of 9 June. December 2002, laying down the technical requirements for
the effectiveness of the new hot-water boilers firing liquid or gaseous
fuel

The Government ordered pursuant to section 22 of Act No. 22/1997 Coll., on technical
requirements for products and amending and supplementing certain acts, as amended by
Law No 71/2000 Coll. and Act No. 205/2002 Coll. (hereinafter the "Act") to
the implementation of § 11 (1). 2, § 11a paragraph. 2 (a). (c)), section 12 paragraph. 1 and 3 and section 13
paragraph. 2 of the Act:
§ 1
Basic provisions
(1) this regulation incorporates the relevant provisions of the European
the community of ^ 1) and sets out the technical requirements for the effectiveness of the new
hot-water boilers firing liquid or gaseous fuels with a rated
exercise at least 4 kW and a maximum of 400 kW (hereinafter referred to as the "boiler") and on the
boiler components placed on the market separately (hereinafter referred to as "component").
(2) for the purposes of this regulation, the

§ 2
Conditions for the placing on the market of boilers and components and to the operation of the

§ 3
Conformity assessment procedures

§ 6
The conditions of the authorization

§ 8

180/1999 Coll., laying down technical requirements for the effectiveness of the
hot-water boilers firing liquid or gaseous fuels.
§ 9
This Regulation shall enter into force on the date of entry of the Treaty of accession of the Czech
Republic to the European Union.

Annex 1
TECHNICAL REQUIREMENTS ON THE EFFICIENCY OF BOILERS
The prescribed value of the efficiency of the boilers are listed in the following table
for operation at rated output Pn and at high water temperature in boiler
equal to 70 ° C, and also at partial power and laid down the Middle

The values of technical requirements must be
included the appropriate tolerance for the authentication method applied in the production
and measurement, which are listed in the harmonised Czech technical
standards relating to the technical requirements of this regulation.
Annex 2
EC type-examination (conformity assessment procedure (B))
1. Ec type-examination is the procedure by which a notified
ascertains and attests that a sample, representing the production envisaged,
complies with the relevant provisions of this regulation.
2. the application for EC type-examination shall submit to the manufacturer or his
authorized representative notified the person of their own choice.
The request contains
and manufacturer identification data) (for a natural person name and surname and
permanent residence or place of business, the name of the legal person, or
business name and registered office). If the application is submitted by the authorised
the representative also contains identification information,
(b)) a written declaration that the same application has not been submitted to any other

in part, and descriptions of the solutions adopted to meet the technical requirements for
the effectiveness of where these standards have not been applied,
(e) the results of the design calculations), or tests,
f) protocols for examination.
4. the notified body
4.1. Examine the technical documentation, verify that the type has been manufactured in the
accordance with that documentation, and identify the elements which have been designed
in accordance with the relevant provisions of harmonised technical standards, as well as
components which have been designed without applying the relevant provisions of those
standards.
4.2. Carry out or have carried out the necessary verifications and tests necessary for the

the relevant parts of the technical documentation. The copy remains stored for
notified persons.
If the notified person refuses the manufacturer or his authorised
representatives of the EC type-examination certificate shall inform the detailed
the reasons for the refusal and give him the possibility of the opposition against the refusal.
6. The applicant shall inform by the person who owns the technical
certified documentation of any modification to the approved boiler
or component that requires additional approval. Additional
approval is confirmed in the form of a supplement to the initial EC
type-examination.
7. the notified body shall communicate to all the competent notified persons
information on the EC type-examination certificates and their additions
released, or canceled.
8. the other notified the person concerned may obtain copies of certificates
EC type-examination and their amendments; attachments must be for
other notified the person kept available.
9. the manufacturer or his authorized representative shall keep with
the technical documentation a copy of the EC type-examination certificate and
their additions for at least 10 years after the last date of production
the relevant product.

1. Type conformity (conformity assessment procedure (C))

2. PRODUCTION QUALITY ASSURANCE (conformity assessment procedure (D))
2.1. Production quality assurance is the procedure whereby the manufacturer, complying with the
the provisions of point 2.2., persuades and declares that the boilers or
components are in conformity with the type as described in the EC type-examination certificate
type, and meet the requirements of this regulation. The manufacturer or his
the authorized representative must affix the CE marking to each product and shall draw up a
the written declaration of conformity. The CE marking must be accompanied by the
the identification number of the notified person, who carries out the supervision of
the quality system referred to in point 2.4.
2.2. The manufacturer shall apply the quality system approved production and control in accordance with
2.3. and is subject to surveillance as specified in point 2.4.
2.3. Quality System
2.3.1. the manufacturer shall submit the application for assessment of his quality system

authorities and their powers in relation to the quality of the boilers or components,

2.3.3. the notified body shall examine whether the quality system meets the

A competent team of assessors must have at least one Member
experience of assessing the relevant production technology.

2.3.4. the manufacturer of the boiler or the components ensures fulfilment of obligations,
arising from the quality system as approved and maintain it so that it was

2.4. monitoring under the responsibility of the notified persons
2.4.1. the purpose of surveillance is to ensure that the manufacturer duly fulfils the obligations
arising out of the approved quality system.
2.4.2. for the purposes of supervision, the manufacturer allows the notified person access to the
areas of production, inspection, testing and storage and provide it
the necessary supporting documents, in particular:

2.4.3. the notified body carries out periodic monitoring, including an assessment of the

3.1. Product quality assurance is the procedure whereby the manufacturer,
complying with the provisions of section 3.2. convinces and declares that the boilers or
components are in conformity with the type as described in the EC type-examination certificate
type, and meet the requirements of this regulation. The manufacturer or his
the authorized representative must affix each boiler or the CE marking to the component and
draw up a written declaration of conformity. The CE marking must be accompanied by the
the identification number of the notified person, who carries out the supervision referred to in
point 3.4.
3.2. the manufacturer applies the approved quality system inspection and testing
finished boilers or components in accordance with section 3.3. and is subject to the supervision
referred to in point 3.4.
3.3. Quality System
3.3.1. the manufacturer shall submit the application for assessment of his quality system for the

THE CONDITIONS OF THE AUTHORIZATION
1. Authorized person, its Director and the staff responsible for
