GOVERNMENT REGULATION
of 7 November. December 2009,
for the purposes of the Criminal Code lays down that the plants, or
mushrooms are considered plants and mushrooms that contain narcotic or
psychotropic substance and what is their quantity is more than a little within the meaning of
of the criminal code

Government orders under section 289 paragraph. 3 of Act No. 40/2009 Coll., the criminal
code:
§ 1
For plants and fungi containing a narcotic or a psychotropic substance within the
meaning of section 285 of the Penal Code shall be treated as plants and fungi listed in
Annex 1 to this regulation.
§ 2
Values specifying the amount larger than a small plant and fungi containing
a narcotic or a psychotropic substance within the meaning of section 285 of the criminal code are
listed in annex 2 to this regulation.
§ 3
This Regulation shall enter into force on 1 January 2000. January 1, 2010.

List of plants and fungi, which, for the purposes of the criminal code are considered
plants and fungi containing narcotic or psychotropic substance
A. PLANTS
1. Plants of the hemp (Cannabis sp.)-all types and varieties
contain more than 0.3% of the substances from the Group of tetrahydrokanabinolů in the
flowering or plodonosném Cyme cannabis plant (except grains)
including worksheets,
2. Coca (Erythroxylum coca).
B. SPONGES
Mushrooms containing psilocybin and psilocin
Annex 2
Values specifying the quantity is greater than the small plants and fungi containing
a narcotic or psychotropic substance for the purposes of the criminal code
