about how to determine the specific technical conditions for the purposes of the Act on the
public procurement
Ministry for regional development, establishes, pursuant to § 159 paragraph. 3 of Act No.
137/2006 Coll., on public procurement, as amended by Act No. 179/2010 Coll.
(hereinafter referred to as the "Act") to implement section 46a of the law:
§ 1
The subject of the edit
This decree governs the determination of the special technical
conditions, taking into account the operational energy and environmental impacts in
the case of public supply contracts, the object of which are the vehicle
category N1, N2, N3, M1, M2 and M3 ^ 1).
§ 2
The method of determining the specific technical conditions
(1) the contracting authority shall be laid down in the tender documents the specific technical
the terms of reference on the exhaust gas emission limits EURO. Vehicle
must meet at least the EURO emission limits specified in annex No. 1 to this
the Decree, if the contracting authority does not provide for a request to meet higher standards
emission limits EURO.
(2) the sponsor in the case of supplies of vehicles of category N1 and M1 also provides
in the contract documents the maximum fuel consumption ^ 2) for
combined ^ 3). Maximum fuel consumption in the case of
motor gasoline and diesel fuel provided by the contracting authority shall not
exceed the values specified in Appendix 2 to this Decree.
§ 3
Special purpose vehicles and vehicle vícepalivová
The maximum values listed in annex 2 to this Ordinance shall not apply in
the case of public supply contracts for vehicles of category N1 and M1, if
the subject are
and special purpose vehicles) ^ 4), or
(b)) vícepalivová vehicles on which at least one alternative fuel
matter are liquefied petroleum gas (LPG), compressed natural gas (CNG),
mixed motor fuel with bio-ethanol content of at least 50% or net
biofuel.
§ 4
Transitional provision
This Ordinance shall not apply to procurement proceedings initiated before the date of
entry into force of this Decree.
§ 5
The effectiveness of the
This Decree shall enter into force on the fifteenth day following the date of its publication.
