laying down the requirements for tobacco products

The Ministry of agriculture shall be determined according to section 18 (a). and), (d),) (j)), k), (l)), and

m) Act No. 110/1997 Coll. on foodstuffs and tobacco products and

amendments to some related laws, as amended by Act No.

306/2000 Coll. and Act No. 146/2002 Coll. (hereinafter the "Act"), in accordance with the

the law of the European communities, "^ 1") for tobacco products:



§ 1



Basic concepts



For the purposes of this Ordinance, means the



and) tobacco product-product for smoking, sniffing, sucking or

chewing, if it is produced wholly or in part of tobacco, including tobacco

genetically modified,



(b)) cigarette-tobacco plug that



1. you can smoke as such and that is not a cigar according to subparagraph (c)), or

h) fine-cut tobacco for hand production of cigarette-smoking tobacco

containing more than 25% by weight of the tobacco particles have a width of less than 1 mm

of the total weight of the tobacco particles,

m) reconstituted tobacco-tobacco foil made by combining gently

fractured tobacco, tobacco refuse and tobacco dust,



n) raw tobacco-naturally or artificially dried tobacco leaves

plants of the species Nicotiana tabacum, as well as the other part thereof intended for

industrial processing,



about)-any substance or component part thereof, with the exception of tobacco

leaf and other natural or unprocessed tobacco plant parts,

used in the manufacture or preparation of a tobacco product and still present in the

§ 2



Types of tobacco products and their division into groups and subgroups



[To section 18 (b), (d)) of the Act]



Types of tobacco products and their division into groups and subgroups are

listed in annex 1.



The method of labelling of tobacco products



[To section 18 (a)) of the Act]



§ 3



Marking of packages of tobacco products



(1) in addition to the particulars provided for in the law and in a special legal regulation ^ 4)

There are additional requirements for the labelling of the packaging of tobacco products listed in

paragraphs 2 to 8 and sections 4 and 5.



(2) the tobacco product shall be designated by the name of.

tobacco product; This is without prejudice to the provisions of paragraph 4.



§ 4



The warnings on the packaging of tobacco products for smoking



(1) in the case of tobacco products for smoking on the packaging must be for

k) "smoking can slow the blood flow and causes infertility"



l) "smoking causes ageing of the skin",

n) "smoke contains benzene, nitrosamines, formaldehyde and hydrogen cyanide";

the warnings referred to in points (a) to (n))) be rotated so, in order to guarantee

their regular appearance.



§ 5



The warnings on the packaging of tobacco products that are not intended for smoking



For tobacco products which are not intended for smoking, must be on the

the packaging for the consumer stated warning: "this tobacco product can

damage your health and is addictive. "



§ 6



(1) every warning referred to in § 4 and 5 must be preceded with the text:

"The Ministry of health warns:".



(2) Introductory text referred to in paragraph 1 must be given beyond the edge

flanking the warnings referred to in § 4 and 5.



The technical requirements relating to the labelling of tobacco products



[To section 18 (b) j) of the Act]



§ 7



(1) general warning referred to in § 4, paragraph 4. 2 and the warnings referred to in § 5

printed on the most visible side of the unit packet, and on

any outer packaging ^ 5) intended for the consumer, with the exception of other

transparent wrappers that read the warnings on the package specified for


the consumer. The additional warnings referred to in § 4, paragraph 4. 3, the

cover at least 30% of the external area of the party unit pack

(4) the information referred to in section 3, paragraph 3. 4 shall be on the side of the packaging of the cigarettes specified

for the consumer, so that this information covers at least 10%

the area concerned.



(5) in the case of individually packaged cigarettes with the data according to § 3 (2). 4

indicate on the packaging for the consumer, so that this information

cover at least 10% of the total area of the packaging.



(6) in the case of individual packages intended for other tobacco products,

than cigarettes, the most visible surface of which exceeds 75 cm2,

must the warnings referred to in § 4 cover an area of at least 22.5 cm2 on each

the side of the unit packet of tobacco products, on which they are

printed.



(7) for tobacco products intended for the consumer on the packaging shall indicate the

traceability, the tobacco product.



§ 8



(1) the information referred to in § 3 (1). 4 and the warnings referred to in § 4 and 5 must be:

(b)) listed in lowercase, with the exception of the first letter and, where

required by grammar usage,

3 to 4 mm wide, which in no way interferes with the text of the warning

or the information referred to in section 3, paragraph 3. 4.



(2) the information referred to in § 3 (1). 4 and the warnings referred to in § 4 and 5:



and) shall be printed indelibly and indelibly,



(b)) may not be printed on the label of tobacco, ^ 6)



(c)) shall not be in any way be hidden, obscured or interrupted by other

written or pictorial communication, or by opening the package.



(3) in the case of tobacco products other than cigarettes, may be a warning

stickers will be unrecoverable.



Quality requirements for tobacco products and putting them into circulation



[To section 18 (b)), l) and (m)) of the Act]



§ 9



(1) the tar in cigarettes put into circulation must not be higher than 10

mg per cigarette.



(2) the content of nicotine in cigarettes put into circulation must not be higher than

1 mg per cigarette.



(3) the content of carbon monoxide in cigarettes put into circulation must not be

greater than 10 mg per cigarette.



(4) the content of tar, nicotine and carbon monoxide yields of cigarettes shall be determined and

the accuracy of the content of tar, nicotine and carbon monoxide yields referred to in

cigarette packaging is considered under special legislation. ^ 7)



§ 10



List of folders that is allowed to use in the production of tobacco

products, listed in annex 2.



§ 11



List of folders that is prohibited to use in the production of tobacco

the products listed in annex 3.



§ 12



Tobacco products must be used when placing into circulation, stored and transported in

dry, clean and well větratelných areas free of pests and

separately from substances with strong smells and fragrances.



Transitional provisions, the cancellation and final

Transitional provisions



(1) the Cigarettes that do not meet the requirements set out in this Decree, may

be offered for sale and sold until 1. May 2005 if

tar is not higher than 12 mg per cigarette.



(2) the Cigarettes intended for export, which do not meet the requirements referred to in § 9

paragraph. 1 to 3 can be produced within a maximum of 1. January 1, 2007.



(3) the tobacco products in addition to cigarettes, marked by

law may be put into circulation until 1. May 11, 2006.



§ 14



Regulation (EEC)



Repeals the Decree 325/1997 Coll., implementing section 18 (a). and)

(d)), j), k), (l)) and m) Act No. 110/1997 Coll. on foodstuffs and tobacco

products and amending and supplementing certain related laws, for

tobacco products.
