DECREE

of 5 April 2004. August 2009

on the application of sediment on agricultural land

The Ministry of agriculture and the Ministry of the environment shall establish

According to § 9 para. 10 of the law No. 156/1998 Coll., on fertilisers, Assistant

soil substances, herbal preparations and auxiliary substrates and

agrochemical testing of agricultural soil (fertilizers Act), as amended by

Act No. 9/2009 Coll.:

§ 1

The subject of the edit

This Decree lays down the conditions and manner of use of the sediment on the

agricultural land, a way of keeping records on the use of the sediments, the limit

the values of the risk elements and hazardous substances in the sediment and soil, the

that is to be used, the requirements for the other physico-chemical and

biological characteristics of the sediment and the procedures of analysis of sediments and soils,

including sampling methods.

§ 2

The limit values of the risk elements and hazardous substances in the sediment and in

the soil on which it is to be used, and biological properties of sediment

(1) the limit values of the risk elements and hazardous substances in the sediment

are set out in annex 1 to this notice. The limit values are

set when you use procedures according to specific standards (§ 4 para. 1 and 2)

published in the journal of the Office for standards, metrology

and State testing. The specified standard means the Czech technical standard,

For more technical standard or technical document international, or

foreign organizations or other technical document containing

For more detailed technical requirements, designated and notified to this Decree

under the law on technical requirements for products "^ 1") (hereinafter referred to as "the designated

standard "). Compliance with limit values shall be determined by the results of

analyses of the sediment samples collected before and after its extraction and movement

leaf sampling of the sediment. The model Passport subscription form

sediment samples is given in annex 2 to this Decree.

(2) the limit values of the risk elements and hazardous substances in the soil, on the

that is to be used, the sediment are set out in annex 3 to this

the Decree. The limit values are set when you use the procedures referred to in

designated standards (§ 4 para. 1 and 2) published in the journal of the Office for

technical standardization, metrology and State testing. Compliance with the

the exposure limit values shall be determined by the results of the analysis of samples of soils

and the accompanying sheet of sampling the soil. Model form of the accompanying worksheet

soil sampling is given in annex 2 to this Decree.

(3) the limit values of risk elements in the soil are not identified for the soil

on substrates with extreme levels of certain contingent geogenně

risk elements. These soil sediment can be used only in the case that

the contents of the risk elements in sediment do not exceed the levels of risk

the elements in these soils, while paragraph 3 (b). and (b)))

do not apply.

(4) in cases where, due to the specific local conditions

suspected of being contaminated sediment in other risk elements, or

hazardous materials, other than those listed in annex 1 to this

the Decree, in concentrations that could result in damage to

physical, chemical or biological properties of agricultural land [§

9. 2 (a). (c) fertilisers) Act], proceed according to the law on

protection of agricultural land resources ^ 2). Biological properties of sediment

and soil and sediment contamination by pathogenic factors are determined

ekotoxikologickými tests and monitoring of indicator microorganisms

According to annex No 4 to this notice.

§ 3

The conditions and the way of using sediment on agricultural land

Can be used on agricultural land, sediments, if

and concentration of risk elements) and hazardous substances in them

contained does not exceed the limit values laid down in annex 1 to this

the Decree,

(b) the concentration of selected risk elements) and hazardous substances in the soil

do not exceed the limit values laid down in annex 3 to this notice;

concentrations of selected risk elements and hazardous substances in the soil will

do not detect in the case do not exceed the established levels of risk elements

and hazardous substances in the sediment limit values laid down in annex No. 3

This Decree,

(c)) the deterioration of the physical, chemical or biological

soil characteristics, which are excavated sediments used, and the amount of

the content of the skeleton in the sediment meets the limit values listed in annex No.

1 to this notice,

d) is complied with the maximum application rate of sediment laid down in the annex

# 5 of this Ordinance, subject to the condition that the sediment is dewatered, and

its use will not impair the soil water regime,

e) as determined by a batch of the land is used for sediment in one

agrotechnical and operation in a continuous time period under favorable

physical and humidity conditions, evenly over the surface of the land, in

the maximum height of the layer of sediment up to 10 cm used; in the case of smaller

depth profile orničního than 30 cm ratio used must be complied with

sediment to ornici 1:3; the depth of topsoil are evaluated according to the fifth

numeric character bonitovaných of soil and environmental units,

(f)) are ploughing the soil within 10 days of their spreading,

g) time since last use of sediment on the field is longer than 10

years of age,

h) time since last use nondefault sludge on the plot of land is longer

than 1 year,

I) ecotoxicological tests imposed by the Act on protection of agricultural

land resources ^ 2) show no evidence of sediment contamination, if these tests were

stored,

j) monitoring indicator micro-organism imposed under the law on

protection of agricultural land resources ^ 2) proven sediment contamination

pathogenic agents, if this monitoring was saved.

§ 4

How the analysis of sediments and soil and sediment sampling methods and

soil

(1) Analytical analyses of sediments and soil are carried out in accredited

laboratories or other professional workplaces, which are insubstantial additional

the quality system according to the specified standards ^ 3) to set the pointer. Apply

the procedures of analysis and testing of sediment and soil according to specific standards

or other authenticated and validated procedures.

(2) sampling of the sediment is carried out from the bottom of ponds, water

tanks, water flows and meziskládek sediments according to specific standards or

other verified and validated procedures. The subscriptions carried out by accredited

place of work or other professional workplaces, which are insubstantial additional system

the quality of the sample according to the specified standards involving ^ 3).

(3) sampling and detection of agrochemical properties of the soil, the

that is to be used, the sediment shall be carried out the procedure laid down

Decree on agrochemical testing of agricultural soils and discovery

soil properties of forest land ^ 4) or other validated and

validated procedures. Agrochemického testing results of agricultural land

must not be older than 6 years.

§ 5

Evidence of the use of the sediment

Form registration sheet on the use of sediment on agricultural land is

listed in annex 6 to this Ordinance. Records of the quantity, type and

the time of use of the sediments by land, crops, and years make up

registration sheet, cover sheet, cover sheet of the sediment sampling sampling

soil and logs on the subscriptions and analyses.
