The DECREE

Ministry of the environment

of 17 December. October 2001

on the conditions of application of the adapted sludge on agricultural land

Change: 504/2004 Sb.

The Ministry of environment in cooperation with the Ministry of

of agriculture and the Ministry of health provides under section 33, paragraph. 4

Act No. 185/2001 Coll., on waste and on amendments to certain other laws,

(hereinafter referred to as "the Act"):

PART THE FIRST

THE CONDITIONS OF APPLICATION OF THE ADAPTED SLUDGE ON AGRICULTURAL LAND

§ 1

The technical conditions for the application of the adapted sludge on agricultural land

Modified sludge ^ 1) can be used on agricultural land use under the following

terms and conditions:

and) no later than 48 hours from the location of the sludge on agricultural land must be

zapraveny sludges to soil;

(b)) the need to supply nutrients to the soil on the property to the location of the sludge must

be accompanied by the results of the analyses of agro-chemical properties of the soils referred to in

registration sheet the use of sludge in agriculture, according to annex No 1;

(c)) shall not use more than 5 tonnes of dry sludge per hectare during the

3 consecutive years. This amount may be increased up to 10

tonnes of dry sludge during 5 consecutive years, if used

sludges contain less than half the limit the quantity of each of the monitored

the risk of substances and elements. The exact determination of the benefits of dry matter shall be calculated from the

the observed nitrogen content. The dose of nitrogen supplied in sludge must not

exceed 70% of the total quantity of nitrogen needed for hnojenou

the crop. Batch sludge (the amount and duration of use) shall be governed by and request

plants for nutrients with regard to accessible nutrients and organic

folder in the soil, as well as to the various site conditions;

(d)) under the conditions provided for the levy of the sludge referred to in paragraph (c)) is on the

land applied in one agro-operation and in one contiguous

the time period for the favorable physical and humidity conditions;

e) minimum dry matter content of sludge for pressure incorporation

radlicovými applicators is 5%, minimum dry matter content of the sludge application

mechanical rozmetadly of organic fertilizers is 18%.

§ 2

The limit values for the concentration of selected high-risk substances in soil and

the risk of substances which may be added to the agricultural land

(1) in the soil, which can be used, not to be exceeded

the limit values for the concentration of selected risk substances listed in

Annex No 2.

(2) the total allowable risk vnos substances into agricultural land use

the Lees during 10 consecutive years is defined the allowable

dose the sludge referred to in article 1 (a). (c)) and the concentration limit values

the risk of substances and substances referred to in annex 3.

§ 3

The limit values for the concentration of selected risk substances and elements in sludge and

microbiological criteria for the use of sludge on agricultural land

On the agricultural land may only be used, that meet

and the limit values of concentration) of selected risk substances and elements

referred to in annex 3, and

(b)) the microbiological criteria set out in annex 4.

§ 4

The sampling procedures and methods of analysis of the soil and sludge and soil

(1) the sampling and analysis of samples of the soil (hereinafter referred to as the "monitoring of the land") on the

the grounds for the use of sludge and subscriptions, and analysis of samples of sludge (

"the monitoring of sludge") provide the originators of the sludge. The proposal for the monitoring of soil and

monitoring sludge on land intended for the use of the sludge is part of

program to use sludge on agricultural land under section 5.

(2) Monitoring of the soil is carried out before the first use of the sludge and

regular 10-year intervals in accordance with the particular legal

Regulation ^ 2), and in the scope specified in annexes 1 and 2.

(3) the monitoring shall be carried out when the sludge sampling and chemical and microbiological

analysis of sludge in the range and frequency as specified in annexes 3, 4 and 5.

For monitoring the Lees shall these requirements:

and determination of organic halogens) adsorbovatelných (AOX) and

polychlorinated biphenyls in sediments shall be carried out before the first use

sludge;

(b)) sampling of sludge is done according to the ČSN EN ISO 5667; ^ 3)

(c) samples of the sludge) for microbiological examination must be removed so that the

avoid secondary contamination, their preservation and transport shall be carried out

According to ČSN ISO 10381. ^ 4)

(4) Monitoring of the soil performs the person responsible for Central control and

test Institute agricultural under special legislation ^ 5)

the procedures laid down in the specific legislation. ^ 6)

(5) the reference methods for the analysis of samples of sludge and soils are listed in the

Annex No 6.

(6) the results of the monitoring of the sludge and soil monitoring stated on registration

the use of sludge in agriculture worksheet according to annex No 1, which is part of the

program using the sludge referred to in § 5. The annexes to the report are filled

always carried out the monitoring reports on the monitoring of soil and sludge. This

the originator of the sludge report archives for 30 years.

§ 5

The content of the programme, the use of sludge on agricultural land

(1) the use of sludge treated by the originator of the sludge always contains

and evaluation of sludge from the viewpoint of) their use on agricultural land in the

accordance with annexes 3, 4 and 5;

(b)) the enumeration of selected plots of land intended for the use of sludge, including indicators for the

their assessment according to annex No 2;

c) hydrological conditions in the area use of sludge;

(d) the inclusion of the use of sludge to) rotation;

(e) monitoring of the Lees and) the proposal for the monitoring of the soil;

(f) the sampling plan);

g) measures on health protection while working with sludges.

(2) part of the use of sludge are also accounting leaves the use of sludge

in agriculture, according to annex No 1.

part of the agriculturally used land. Under the terms of common land we understand soils

the normal variability of the element, with the normal soil development in the various

the geomorphologic conditions in areas of different psamitických,

pelitických rocks of sedimentary, acidic, neutral, and

basis of rocks of igneous and metamorphic rocks. It is therefore a

the land, which the cast of the geogenně and the petrograficky anomalous rocks,

sand. In the case of the definition of these soils is required based on the

representation of fine particulate matter (10 microns), which consists of a maximum of 10

%. In soils of sandy on the sands, štěrkopíscích and štěrcích it is mainly in the

raw materials with normal levels of risk elements leads to the rapid

pollution of the groundwater and river water.

the value of the background is not. For the soil on the other geogenně

the extreme upper limits are not these rocks of the reference values of the elements

determined, because their value in these rocks are often considerably

outstanding and high, especially for Cr, Co, Ni, and throughout the soil

profile.
