on the adjustment of certain property relationships of monastic orders and congregations, and

the Archbishopric of Olomouc



change: 338/1991.



To correct the wrongs caused by religious orders and congregations in the 1950s

years, in particular the illegal detention of their immovable property shall be

The Federal Assembly of the Czech and Slovak Federative Republic resolved

to this Act:



§ 1



(1) Immovable property referred to in annex 1 of this Act declaring

to the effective date of this Act, under the ownership of individual orders and

congregations.



(2) real property referred to in annex 2 of this Act declaring

to the effective date of this Act for the possession of the Archbishopric

the Olomouc.



(3) real property referred to in annex 3 to this Act are hereby declares

on 1 January 2002. August 1991 under the ownership of individual orders and congregations.



(4) under the ownership of individual orders and congregations and the Archbishopric

the Olomouc to the effective date of this Act declares whether or not movable

the property, which was the date of 10.4.1950 located in real estate listed in the

Annexes 1 and 2 of law no 298/1990 Coll. and in annex 3 of this

the law, if it exists, and it is known where the movable property

located.



§ 2



Effective date of this Act cease to exist the relevant orders and claims

congregations and the Archbishopric of Olomouc to previous owners and

users of the assets referred to in section 1 of the compensation and unauthorized

assets, including claims for the payment of the rent, if incurred

in the period from the 1. January 1950 to the effective date of this Act.



§ 3



(1) Disputes from the application of this law, the courts decide.



(2) the minutes shall be carried out by the authorities of Geodesy changes ownership

§ 4



(1) the evacuation of immovable property referred to in section 1, if you are used to

the provision of health care or social services or for education

or cultural or educational activities, you can claim only after the previous

and the congregation with pre-existing users of real estate, who is used to

purposes referred to in paragraphs 1 and 2, the agreement. In the absence of this agreement,

religious laws arises and entitled to congregations eviction real estate

referred to in annexes 1 and 2 of law no 298/1990 Coll. and in annex No. 3

This law, which is used for the purposes referred to in paragraphs 1 and 2 of this

the law, after the expiry of 10 years from the effective date of this Act.

The conclusion of the agreement on the use of flats and non-residential premises governed by the

the provisions of the civil code, the law on lease and sublease of non-residential

space and related legislation. This obligation passes to all

other owners in that time.



(4) in the absence of agreement on the amount of rent and the conditions of its payment of between

existing users of real estate, who is used for the purposes referred to in

arcibiskupstvím Olomouc, shall decide on the amount of rent, the competent authority

the State administration under the generally applicable price laws.



§ 5



This Act shall take effect on the date of publication.
