On technical requirements for machinery

Government directs pursuant to § 22 Act no. 22/1997 Coll., On technical
requirements for products and amending and supplementing certain acts, as amended
Act no. 205/2002 Coll., (Hereinafter " Act ") to implement § 7 para. 8, §
11 paragraph. 2, § 11 paragraph. 2 point. c) § 12 para. 1 and 3, § 13:

§ 1
Basic provisions


(1) This regulation implements the relevant regulations of the European Union ^ 1) and
regulates technical requirements

A) Machinery,

B) interchangeable equipment,

C) safety components

D) lifting accessories

E) chains, ropes and webbing

F) removable mechanical transmission devices

G) partly completed machinery.

(2) specified products under this Regulation, within the meaning of § 12 para. 1
point. a) of all the goods specified in paragraph 1. a) to g).

(3) The provisions of § 3-9 and Annexes to the Regulation concerning
machinery also apply to products referred to in paragraph 1
point. b) to f).

(4) This regulation does not apply to

A) safety components intended to be used as spare parts
to replace identical components and supplied by the manufacturer of the original
machinery

B) specific equipment for use in fairgrounds or
lunaparcích,

C) machinery specially designed for nuclear, or which
to be put into operation in nuclear installations
whose failure could cause leakage of radioactivity

D) weapons, including firearms

E) means of transport which are

First agricultural and forestry tractors for the risks listed in Annex no. 1
hereto are already contained in the relevant legislation of the European Union
^ 2) the exclusion of machinery mounted on these vehicles
,

Second motor vehicles and their trailers covered
relevant European legislation, 3) except machinery
mounted on these vehicles,

Third vehicles covered by the relevant legislation of the European Union
^ 4) the exclusion of machinery mounted on these vehicles,

Fourth motor vehicles exclusively intended for competition, and

Fifth vehicles for the transportation of air or water or
transport by railways, except machinery mounted on these vehicles
,

F) seagoing vessels, mobile offshore equipment and machinery
installed on board such vessels or facilities

G) machinery specially designed and constructed for military or police purposes
,

H) machinery specially designed and constructed for research purposes
for temporary use in laboratories,

I) mine winding equipment,

J) machinery stage equipment intended to move performers during
performances

K) electrical and electronic products these groups, if the
covered by government decree no. 17/2003 Coll., Laying down technical
requirements for low voltage electrical equipment, which are

First household appliances intended for use in the home environment,

Second audio and video equipment,

Third information technology equipment,

Fourth ordinary office machinery,

Fifth low-voltage switchgear and control units

6th Electric,

L) high-voltage electrical equipment, which are

First switching and control equipment,

Second Transformers.

§ 2
Basic concepts


For the purposes of this Regulation

A) machinery

First file, which is fitted with or intended to be fitted with a drive system
directly applied human or animal effort, consisting of
parts or components, at least one of which is movable, mutually
together for a specific application;

Second file referred to in paragraph 1, missing only the components to
connect it on site or to sources of energy and motion,

Third file referred to in paragraph 1 or 2, which is capable of functioning after
mounted on a vehicle or installed in a building or a structure
,


Fourth assemblies of machinery referred to in point 1, 2 or 3, or file
partly completed machinery, which is to achieve the same
arranged and controlled so that they function as an integrated whole
or

Fifth file consisting of linked parts or components, at least one of which is
moves, joined together for lifting loads and whose
only power source is directly applied human effort,

B) interchangeable equipment is a device that after putting
machinery or tractor is in operation to the machinery
equipment or tractor operator connected in order to change its
functions or add new features, not- If this equipment tool

C) safety components such part of the machinery

this Regulation

D) lifting accessory component or device that without
was attached to the lifting machinery, allows mounting
proof and which are located between the machinery and the load or on a separate
burden, or which is intended to constitute an integral part
load and which are marketed separately; for accessories for
also regarded as lifting slings and their components

E) chains, ropes and webbing such chains, ropes and webbing
designed and constructed for lifting purposes as part of the machine or
lifting accessories

F) removable mechanical transmission device detachable part
transferring energy from the machinery, self-propelled or

If placed on the market with the guard it shall be regarded as one product

G) partly completed machinery file, which itself can perform a function
. Partly completed machinery is only intended to be incorporated
into other machinery or other partly completed machinery or equipment
or assembled with them, thus forming machinery
equipment covered by this Regulation; A drive system is partly completed machinery
,

H) the basic requirements for health and safety such
requirements for the design and construction of products covered
this regulation, which are intended to ensure a high level of health protection and safety of persons
where appropriate, domestic animals and property, as well as
environment.

§ 3
Basic requirements


(1) Basic requirements that machinery must satisfy are
listed in Annex no. 1 to this nařízení.Základní protection requirements

(2) If the machinery fulfills the relevant provisions

A) harmonized European standards to which it is published in the Official Journal of the European Union

B) harmonized Czech technical standards, which incorporates the standard by
letter a), or

C) international technical standards in the European Union Member State which adopts the norm
pursuant to subparagraph a)

Which is related to the fundamental requirement, it is understood that
this basic requirement is met. This does not apply if the reference from the Official Journal of the European Union
withdrawn.

(3) The requirements set for the machinery in special legal regulations
^ 5) non-respect of the risks referred to in Annex no. 1 to
this regulation affected by this Regulation.

§ 4

Placing on the market or put into service

(1) Machinery can be placed on the market or put into service if

A) the requirements referred to in paragraph 3 and

B) is carried out so that the assumption that it is properly installed, maintained and used
for the purpose for which it is intended and under conditions
which can reasonably be foreseen, does not endanger the health and safety of persons and

Or domestic animals and property and, if so provided in this Regulation, nor
environment.

(2) to the market or put into service shall not be placed in machinery referred to in Annex
no. 12 hereto ^ 11).

(3) Before placing machinery on the market or put into service
manufacturer or his authorized representative shall perform conformity assessment according to § 5, while


A) ensures that the technical documentation referred to in Section A
Annex no. 7 to this Regulation

B) provides the machinery necessary information, including instructions

C) issue the EC declaration of conformity in accordance with Part 1 of Section A of the Annex no. 2 to
this regulation and ensure that it accompanies the
machinery,

D) provides machinery CE marking under § 8

(4) partly completed machinery can be placed on the market if the manufacturer
or his authorized representative shall ensure that the procedure under § 6

(5) for placing on the market shall be considered as machinery manufactured or imported
for its own operational needs in business.

(6) If you can not identify the person who machinery or incomplete
machinery for placing on the market, manufactured or designed and
sought his own name or trademark, the provisions of this Regulation
regarding the manufacturer, apply to a person who
machinery or partly completed machinery on the market or put into service.

(7) machinery and partly completed machinery which does not satisfy the requirements of this regulation
may be exhibited at fairs,
exhibitions, demonstrations, and similar events, provided that
visible sign clearly indicates that the machinery does not
in accordance with the requirements of this Regulation and is not marketed or
into service until it has been made to comply with the requirements of this regulation
. During demonstrations of such machinery or incomplete
machinery must be adequate security
measures to ensure the safety of persons.

§ 5

Conformity assessment procedures

(1) To assess the conformity of machinery with this Regulation applies
manufacturer or his authorized representative of one of the conformity assessment procedures
pursuant to paragraphs 2 to 4

(2) Unless the machinery specified in Annex no. 4 to this Regulation,
the manufacturer or his authorized representative conformity assessment procedure
internal checks on the manufacture of machinery provided for in Annex no. 8 to the || | regulation.

(3) Where the machinery is specified in Annex no. 4 hereto and
is manufactured in accordance with harmonized standards referred to in § 3 para. 2 and
if those standards cover all relevant essential requirements
on health and safety, the manufacturer or his authorized representative procedure


A) conformity assessment of internal production control machinery by
Annex no. 8 of this regulation,

B) EC type examination in accordance with Annex no. 9 hereto and internal
the manufacture of machinery according to section 3 of Annex no. 8 to the
regulation or

C) full quality assurance according to Annex no. 10 to this Regulation
.

(4) Where the machinery is specified in Annex no. 4 hereto and
not been manufactured in accordance with the harmonized standards referred to in § 3 para. 2, or
been constructed according to these standards only partially, or not include
harmonized standards all relevant essential requirements
health and safety, or for the machinery in question
equipment, there are no harmonized standards, the manufacturer or his authorized representative shall apply
procedure | ||
A) EC type examination in accordance with Annex no. 9 of this regulation and conformity assessment
internal checks on the manufacture of machinery provided
point 3 of Annex no. 8 of this Regulation or

B) full quality assurance according to Annex no. 10 to this Regulation
.

(5) In order to ensure that the procedures referred to in paragraphs 2 to 4 must be
manufacturer or his authorized representative shall have the necessary means to
ensure that machinery meets the essential requirements
health and safety set out in Annex no. 1 to this
regulation.

§ 6

Procedure for partly completed machinery

(1) For the partly completed machinery must be before it is placed on the market


A) the relevant technical documentation described in Annex no.
7 to this Regulation

B) the instruction for assembly in accordance with Annex no. 6 hereto and

C) of the declaration of incorporation described in Part 1, Section B of Annex.
2 hereto.

(2) Assembly and the declaration of incorporation shall accompany the partly completed
machinery until it is incorporated into the final machinery
device, and then become part of the technical documentation of this
machinery.

§ 7
Reducing the validity of documents


(1) If the notified body finds a product in which participated
conformity assessment that the manufacturer failed to meet or no longer meets the relevant requirements of this Regulation
or that should not be issued a certificate EC-type examination

(2) If the suspension or limitation

§ 8
CE


(1) Machinery must be visibly, legibly and indelibly
CE marked. CE marking according to this Regulation shall be provided only
specified products according to § 1 para. 1 point. a) to f).

(2) The graphics of the CE marking (§ 13 para. 3 of the Act) is determined
special legal regulation 6). Additional requirements to perform
CE marking are set out in Annex no. 3 to this Order. If
legal regulations that apply to machinery and in which the CE marking
prescribe or allow for a transitional period, they allow
manufacturer or his authorized representative must choose which provisions will govern
, CE marking indicates conformity to the provisions only of those
legislation, which the manufacturer or his authorized representative
used. The EC declaration of conformity shall be given details concerning the
laws or provisions, which the manufacturer or his authorized representative
used.

§ 9

Notice of imposition of safeguard measures

(1) Machinery, which bears the CE marking and is accompanied
accompanied by the EC declaration of conformity, the content of which is set out in Part 1
Annex no. 2 to this Order shall be deemed
meeting the requirements of this Regulation.

(2) In the event that it was for machinery referred to in paragraph 1
ordered protective measures under a special legal regulation 7)
indicate in the notice under § 7 para. 8 of the Act, whether non-compliance with requirements under §
4, paragraph. 1 point. b) was caused

A) failure to satisfy the requirements specified in § 3 para. 1

B) incorrect application of the harmonized standards referred to in paragraph 3 §
. 2, or

C) shortcomings in the harmonized technical standards set forth in § 3
paragraph. second

§ 10

Authorization and notification

(1) With the authorization of legal entities to carry out activities under this Regulation
the conditions laid down in Annex no. 11 hereto.
Legal entities that meet the assessment criteria laid down in
relevant harmonized European standards, the references of which
published in the Official Journal of the European Union, are considered persons
meeting the criteria in Annex no. 11 to this regulation, which is
such standards relate.

(2) If the notified person become an authorized person
procedure according to § 11 para. 7 point. b) of the Act uses the identification number of the Notified Body
allocated under its authorization.

§ 11


Transitional provisions
Portable cartridge-operated fixing and other impact machinery
meeting the requirements of the existing regulations may be marketed and
operation until 29 June 2011.

§ 12
Repealing provisions


Decree no. 24/2003 Coll., Laying down technical requirements
machinery is repealed.

§ 13
Efficiency


This regulation comes into force on 29 December 2009.

Appendix 1


ESSENTIAL HEALTH AND SAFETY REQUIREMENTS RELATING TO
DESIGN AND CONSTRUCTION MACHINERY


GENERAL PRINCIPLES
First The manufacturer of machinery or his authorized representative shall
risk assessment with the aim of reducing and specifies requirements for protection
health and safety, which apply to the machinery.
Machinery must be designed and constructed taking into account the results
risk assessment.

In the above iterative process of assessing and reducing risks
manufacturer or his authorized representative

) Defines the designation of the machinery, which include the intended
use and any reasonably foreseeable misuse,

B) determine the hazards that can be generated by the machinery and the associated hazardous situations

C) estimates of risk, taking into account the severity of the possible injury or
damage to health and the probability of their occurrence,

D) evaluate the risks to determine whether it is consistent with the objective of this Regulation must

E) provides safeguards to eliminate hazards or reduce the risks
associated with these hazards in the order specified in section 1.1.2. point.
B).

Second Basic requirements for health and safety requirements apply only
if there is a corresponding danger for the machinery concerned
device if it is used under the conditions foreseen by the manufacturer or his authorized representative
, or in exceptional
predictable situations. Always the principles of safety
mentioned in paragraph 1.1.2. and obligations concerning marking of machinery and equipment
instruction manual mentioned in paragraphs 1.7.3. and 1.7.4.

Third Basic requirements for health and safety requirements set out in this
Annex are mandatory, except in cases where the objectives set by these requirements can not be
considering the current state of the art to achieve;
in these cases, the machinery must be designed and constructed
to these goals as closely as possible.

Fourth When designing machinery must be based on the results
risk assessment in accordance with point 1 of these general principles to take into account, besides
basic requirements for health and safety requirements set out in Part 1
and the requirements of one or more specific parts 2 to 6 of this Annex.
Basic requirements for health and safety related
environmental protection apply only to the machinery
referred to in Chapter 2.4.

First ESSENTIAL HEALTH AND SAFETY
1.1.Obecné
remarks

1.1.1. definition

For the purposes of this Annex

A) the hazard potential source of injury or damage to health,

B) danger zone any zone within or around machinery
device in which a person is exposed to a risk to their health or safety

adjusting, maintaining, cleaning, repairing or transporting machinery,

E) risk combination of the probability and severity of injury or damage
to health that can arise in a hazardous situation

F) cover part of the machinery used specifically to provide protection
using physical barriers

G) protective device device (other than a guard) which reduces
risk, either alone or in conjunction with the guard

H) the anticipated use of the use of machinery in accordance with
information provided in the instruction manual

I) reasonably foreseeable misuse
use of machinery in a way not intended in the instructions for use, but which
may result from readily predictable human behavior.

1.1.2. Principles of safety

A) Machinery must be designed and constructed so as to perform its function
and can be operated, adjusted and maintained without
persons at risk when these operations are carried out under the anticipated
conditions, but also taking into account any
reasonably foreseeable misuse.


Aim of measures taken must be to eliminate any risk throughout
foreseeable lifetime of the machinery including the phases of transport,
installation, dismantling, decommissioning and scrapping.

B) In selecting the most appropriate solutions, the manufacturer or his authorized representative
apply the following principles in the following order:

- Eliminate or minimize the risk of safe design and construction
machinery

- Take the necessary protective measures in relation to risks that can not be
excluded

- Inform users of the residual risks due to any shortcomings
protective measures adopted, indicate
any particular training is required and specify any need
personal protective equipment.

C) When designing and constructing machinery and when drafting
instructions for use, the manufacturer or his authorized representative
take into account not only the intended use of the machinery but also
any reasonably foreseeable misuse.
Machinery must be designed and constructed so as to prevent abnormal
use if such use would engender a risk. Instructions for use
must remind the user or wrong ways to use
machinery that may occur by the experience.

D) Machinery must be designed and constructed to take into account
constraints to which the operator is subject
the necessary or foreseeable use of personal protective equipment.

E) Machinery must be supplied with all the special equipment and
accessories to enable adjustment, maintenance and use of machinery
without risk.

1.1.3. Materials and products

Materials for the manufacture of machinery or products used or created
machinery during use must not endanger the health or safety of persons
. In particular, where fluids are used, they must be
machinery designed and constructed to prevent risks
due to filling, use, recovery or draining.

1.1.4. lighting

Machinery must be supplied with integral lighting suitable for the operations
if it is likely that the lack of light, and
despite ambient lighting of normal intensity to cause a risk.

Machinery must be designed and constructed so that there are no areas
disturbing shadows or annoying glare,
there are no dangerous stroboscopic effects on moving parts due to the lighting
.

Internal parts requiring frequent inspection and adjustment, and for
maintenance must be provided with appropriate lighting.

1.1.5. Design of machinery to facilitate its handling

Machinery or each component part thereof must

A) allow safe handling and transportation,

B) be packaged or designed so that it can be stored safely and without damage
.

During the transportation of the machinery or its parts must exist
possibility of sudden movements or of hazards due
stability if the machinery or its parts are handled
in accordance with the instructions for use.

If the weight, size or shape of machinery or its various component parts prevents
hand, the machinery or each of its components must


A) either be fitted with attachments for lifting gear, or

B) they are designed to be fitted with such attachments, or

C) have such a shape that it can be easily connected to a regular
lifting gear.

Where machinery or one of its parts moved by hand, must be


) Is easily moveable, or

B) equipped for picking up and moving safely.

For the handling of tools or machinery parts, even
if lightweight, could be hazardous, it shall be taken
appropriate measures.

1.1.6. ergonomics

Under the intended conditions of use shall be discomfort, fatigue and physical and psychological

1.1.7. Operator Station

The operating position must be designed and constructed so as to avoid
any health risk due to exhaust fumes or lack of oxygen
.

If the machinery is intended for use in hazardous environments
posed a risk to the health and safety of the operator or if the machinery itself
creates a dangerous environment should be provided
appropriate means of achieving good
working conditions for the operator and is protected against any foreseeable hazards.

02.01 Control systems

1.2.1. Safety and reliability of control systems

Control systems must be designed and constructed so as to avoid
dangerous situations. In particular it must be designed and constructed so as to


A) to withstand the load of normal use and withstand external influences

B) fault in the hardware or software of the control system
does not lead to hazardous situations,

C) errors in the control system logic do not lead to hazardous situations

D) reasonably foreseeable human error during operation does not lead to hazardous situations
.

Particular, it must ensure that

A) machinery must not start unexpectedly,

B) the parameters of the machinery must not change in an uncontrolled way when
such change may lead to hazardous situations,

C) not be prevented from stopping the machine, unless it has already been issued
command

D) no moving part of the machinery or piece that is
held in the machinery must fall or be ejected,

E) may be prevented automatic or manual stopping
any moving parts,

F) protective devices must remain fully effective or give a command
stop

G) of the control system related to safety must remain on
whole set of machinery or partly completed machinery
coherently.

The remote control must be activated automatically stop if
not received proper control signals, including the case of loss
connection.

1.2.2. Control devices

Control devices must be

A) clearly visible and identifiable, if necessary, using
pictograms

B) positioned so as to be safely operated without
loss of time and without ambiguity,

C) designed so that the movement of the control is consistent with its
effect

D) located outside the danger zones, except for certain controls
device, if necessary, such as emergency stop devices
or manual control panel

E) positioned so that their operation can not cause additional risk,

F) designed or protected so that the desired effect, it may cause

Danger, not a deliberate action,

G) made so as to withstand foreseeable forces;
special attention must be paid to emergency stop devices which may
be subjected to considerable stress.

If the control device is designed and constructed to allow
several different actions, namely where there is no consistency between
direction and sense of control and its effect must act to be performed, | || clearly displayed and possibly even being acknowledged.

Control devices must be so arranged that their layout, travel and
resistance to operation are compatible with the action to be performed,
taking account of ergonomic principles.

The safe functioning of the machinery must be fitted with indicators,
which must be visible and legible from the operator.

From each control position the operator must be able to ensure that the hazardous area
nobody, or the control system must be
designed and constructed so that starting when the dangerous
space is one.

If this is not possible, it must be before the machinery starts, issued
audible or visual warning signal. Vulnerable people must be able
in time to leave the danger zone or prevent the machinery starting
devices.

If necessary, it must be ensured that the machinery can be
controlled only from control positions located in one or more pre
designated areas or locations.

If there is more than one control position, the control system must be

must be provided with all the required control devices without

1.2.3. Starting

Machinery may be triggered only by deliberate action on the control
device that is provided for the purpose.

A) when restarting the machinery after a stoppage
any cause

B) when effecting a significant change in operating conditions.

Restarting of the machinery or a change in operating conditions
may be effected by voluntary action on other than the control
device that is provided for the purpose, if it does not lead to a dangerous situation
.

For machinery functioning in automatic mode can be
startup, restarting after a stoppage, or a change in operating conditions
possible without intervention, provided this does not lead to a hazardous situation.

If machinery has several starting controls and
operators can therefore put each other in danger, it must be
rule out such risks other devices.
If safety requires that starting and stopping was done in a certain order

1.2.4. stopping

1.2.4.4. File machinery

4.1.2.8.3. Risks due to contact with the moving carrier

- Pressure anchoring or supports (soil) and the characteristics of the tracks,

- Or the data on ballast and the means of

B) the contents of the logbook, if not supplied with the machine

C) instructions for use, particularly to offset the lack of direct vision of the load
operator,

D) where appropriate, a test report describing the static and dynamic

Tests conducted by the manufacturer or his authorized representative,

E) the necessary instructions for performing the tests set out in paragraph 4.1.3
before first putting into service of machinery, unless Machinery

Fifth ESSENTIAL HEALTH AND SAFETY REQUIREMENTS FOR MACHINERY
INTENDED FOR UNDERGROUND WORK

Machinery intended for underground work must satisfy pursuant to Section 4
Guidelines all the essential health and safety
described in this chapter.

05.01 Risks resulting from insufficient stability

Powered roof supports must be designed and constructed so that when moving

6th ESSENTIAL HEALTH AND SAFETY FOR MACHINERY EQUIPMENT
PARTICULAR HAZARDS DUE TO THE LIFTING OF PERSONS

Machinery presenting hazards due to the lifting of persons must meet
accordance with section 4 of the Guidelines
all relevant essential requirements to protect health and safety requirements described in this chapter.

06.01 generally
6.1.1 Mechanical strength


The carrier, including any trapdoors, must be designed and constructed
so that the space and strength corresponding to the maximum allowable
number of persons and the maximum working load.

Coefficients for components set out in paragraphs 4.1.2.4 and 4.1.2.5
are for machinery intended for the lifting of persons and must
generally be doubled. Machinery intended for lifting persons
or persons and goods must be fitted with a suspension or supporting system
carrier designed and constructed in such a way as to ensure
adequate level of safety and to prevent the risk of the carrier falling.

Where to suspend the carrier used ropes or chains must be
least two independent ropes or two chains, each with a separate
anchorage.

6.1.2. Loading control for machinery moved by power other than human strength


The requirements of section 4.2.2 apply regardless of the maximum working
load and overturning moment, unless the manufacturer can demonstrate that there
risk of overloading or overturning.

06.02 Control devices

Where safety requirements do not impose other solutions, the carrier must be fundamentally
designed and constructed so that persons inside
available devices to control the movement up and down, or to
other movements of the carrier .

6.3.3. Risk due to objects falling on the carrier

If there is a risk of objects falling on the carrier and endangering persons, the carrier must
be equipped with a protective roof.

06.04 Machinery serving fixed landings

6.4.1. Risks to persons in or on the carrier it

The carrier must be designed and constructed to prevent risks due to contact
persons or objects in or on the carrier it

6.4.2. Control devices on platforms

This declaration relates exclusively to the machinery in the state in
which it was placed on the market, and excludes components that were
subsequently added to the end user, or carried out subsequently by the final user

(within the meaning of the penultimate paragraph of Part B
Annex no. 7 to this Regulation), who must be established in
Member State of the European Union,

Third description and identification of the partly completed machinery including generic
denomination, function, model, type, serial number and commercial name

Fourth a sentence declaring which essential requirements of the European Union regulation
^ 1) are applied and fulfilled and that they were prepared
relevant technical documentation according to Annex no. 7 to this Regulation and
if applicable , a sentence declaring the conformity of the partly completed machinery
with other relevant předpisy.Evropských
community, and must go on regulations published in the Official Journal of the European Union
,

Fifth a commitment to pass on a reasoned request by the national authorities
relevant information on the partly completed machinery. This commitment
include the method of transmission and shall be without prejudice to the rights of intellectual property

Second CUSTODY The

Manufacturer of machinery or his authorized representative shall keep
original EC declaration of conformity for at least ten years from the last date of manufacture
machinery.

Manufacturer of partly completed machinery or his authorized representative
keep the original declaration of incorporation for a period of at least ten years
from the last date of manufacture of the partly completed machinery.
Appendix 3

MARKING


(1) The various components of the CE marking must have the same vertical dimension, which
shall not be less than 5 mm. This minimum dimension may be waived for small-scale machinery

(2) The CE marking must be affixed in the immediate vicinity of the name
manufacturer or his authorized representative, using the same technique.


(3) When using a full quality assurance procedure referred to in paragraph 5 §

European Union, which is acceptable to the manufacturer of the machinery in
which the partly completed machinery will be assembled, or to his authorized representative

TECHNICAL DOCUMENTATION
A. TECHNICAL FILE FOR MACHINERY

This section describes the procedure for compiling a technical file.
The technical documentation must demonstrate that the machinery complies with the requirements of this regulation
. It must cover the design, manufacture and operation of the machinery to the extent necessary for
assessment. The documentation must be
compiled in one or more official languages ​​of the Member States of the European Union
except for the instructions for use of the machine for which it pays
special provisions of paragraph 1.7.4.1 of the Annex no. 1 hereto.

First Technical documentation includes

A) the design and manufacturing documentation containing

- A general description of the machinery,

- The overall drawing of the machinery and drawings of the control circuits and
pertinent descriptions and explanations necessary for understanding the operation of machinery
device

- Detailed drawings or accompanied by any calculation notes, test results, certificates, etc.
., Which are necessary for checking the conformity of the machinery
equipment with the essential health and safety,

- The risk assessment documentation showing the procedure followed, including:

- The list of basic requirements for health and safety that
apply to machinery

- Description of the protective measures implemented to eliminate identified
hazards or to reduce risks and possibly putting

- The standards and other technical specifications used, indicating the essential
requirements for health and safety that these standards

C) relevant reports or evaluations of the results of tests performed by the manufacturer

Machinery that are necessary to determine whether the machinery
equipment as designed and constructed, can be safely
assembled and put into operation.

Second The technical documentation referred to in paragraph 1 shall be available
national authorities for at least 10 years from the date of manufacture of

European Union, nor does it have to be permanently available in material form.
It must be possible for the person designated in the EC declaration of conformity could

A) the design and manufacturing documentation containing

- The overall drawing of the partly completed machinery and drawings of the control circuits
,

- Detailed drawings or accompanied by any calculation notes, test results, certificates
etc., that are necessary for checking the conformity of the partly completed machinery
with the essential requirements for health and safety
,

- The risk assessment documentation indicating the assessment process, including

Relevant technical documentation must be available for at least 10
years from date of manufacture of the partly completed machinery or, in the case
serial production of the last unit and on request presented
competent national authorities. It does not have
located on the territory of a Member State of the European Union, nor does it have to be permanently
available in physical form. The person mentioned in the declaration of incorporation
partly completed machinery must be able to complete it and submit
competent authority.

Failure to submit documentation to a duly reasoned request by the competent national authorities
may be sufficient grounds for doubting the presumption of conformity
partly completed machinery with the essential requirements
health and safety requirements applied and attested.
Appendix 8


ASSESSMENT OF CONFORMITY WITH INTERNAL CHECKS ON THE MANUFACTURE OF MACHINERY

EC TYPE-EXAMINATION
EC type-examination is the procedure whereby a notified body ascertains and
certifies that a representative model of machinery referred to in Annex no. 4 to this
Regulation (hereinafter the "type") satisfies the requirements of this regulation.

First The manufacturer or his authorized representative shall draw for each type
technical documentation referred to in Part A of Annex no. 7 to this Regulation
.

Second The application for EC type-examination submitted by the manufacturer or his authorized representative
for each type with a notified body of his choice.

The application must include

2.1 The name and address of the manufacturer and of his authorized representative
2.2
written declaration that the application has not been lodged with any other notified
person

2.3 technical documentation.

In addition, the applicant shall be notified body a specimen type.

Third Notified Body

03.01 examine the technical documentation, checks whether the type was manufactured
in accordance with this documentation, and identify the elements which have been designed in
accordance with the relevant provisions of the standards referred to in § 3 para. 3, and
elements whose proposal to the relevant provisions of those standards does not constitute
;

03.02 carry out or have carried out appropriate inspections, measurements and tests
to ascertain whether the solutions adopted to meet the essential requirements
health and safety referred to in this government regulation have not
the standards listed in § 3 paragraph. 2;

03.03 if used harmonized standards referred to in § 3 para. 2
carry out or have carried out appropriate inspections, measurements and tests to
verify that those standards were actually applied;

04.03 agree with the applicant on the place where the check that was
type manufactured in accordance with the examined technical file and the necessary
inspections, measurements and tests.

Fourth If the type satisfies the provisions of this Regulation shall
person notified the applicant EC type examination certificate.
The certificate contains the name and address of the manufacturer and its authorized representative
data necessary to identify the approved type, the conclusions of the examination and the conditions
force. Manufacturer and Notified Body
keep a copy of the certificate, the technical file and all relevant documents for a period of 15 years from the issuance of the certificate
.

Fifth Does not meet the provisions of this type of regulation, refuses notified
person must issue an EC type examination certificate, stating the reasons
this decision. Notify the applicant, the other notified bodies and
Member State which notified body announced. There must be
appeal procedure.

6th The applicant shall inform the notified body which retains the technical
documentation concerning the EC type examination certificate,
of all modifications to the approved type. The Notified Body shall examine these modifications and either confirm the validity of the existing
certificate of EC type examination or
issue a new certificate if the changes are such that they could invalidate
conformity with the essential health and safety or
suitability for the intended operating conditions of the type.

7th The Commission, Member States and the other notified bodies may, on request
receive a copy of the EC type examination certificate.
Upon reasoned request, the Commission and the Member States may obtain a copy of the technical documentation
and the results of the examination, which conducted the Notified Body.

8th Documentation and correspondence relating to the procedures for the examination
type must be in an official language or languages ​​of the Member State
where the notified body is established or in a language acceptable
.

9th Validity of EC type examination certificate

9.1 Body must continuously ensure that an EC type examination
valid. Notify the manufacturer of any major changes
which could affect the validity of the certificate.
Notified body shall withdraw certificates which are no longer valid.


9.2 Manufacturer of machinery concerned has the ongoing responsibility of ensuring that
said machinery meets the corresponding state of the art.

9.3 Every five years the manufacturer requests a Notified Body for review
validity of the EC type examination certificate.

If the notified body finds that the certificate is taking into account the state of the art
remains valid, renew the certificate for a further five years.

Manufacturer and notified body shall keep a copy of this certificate,
technical documentation and all relevant documents for a period of 15 years from the date of issue of the certificate
.

9.4 Unless the validity of the EC type not renewed, the manufacturer
placing the machinery on the market.
Annex 10

FULL QUALITY ASSURANCE


This Annex describes the conformity assessment of machinery referred to in Annex
no. 4 of this regulation, whose production system is used
a full quality assurance and procedure whereby
notified body assesses and approves the system
quality assurance and monitors its application.

First Manufacturer applies the approved quality assurance system for design, manufacture
final inspection and testing as specified in section 2, and subject to supervision under 3.


Second Quality assurance system

2.1 application for assessment of the quality assurance system
submitted by the manufacturer or his authorized representative with a notified body of your choice

The application must include

2.1.1 name and address of the manufacturer and of his authorized representative
2.1.2
places of design, manufacture, inspection, testing and storage
machinery

2.1.3 technical documentation as described in Part A of Annex no. 7 to this Regulation
for one model of each category of machinery
listed in Annex no. 4 to this Regulation, which it intends to produce,

2.1.4 quality assurance system documentation,

2.1.5 written declaration that the application has not been lodged with any other notified
person.

2.2 The quality assurance system must ensure conformity of the machinery
with the provisions of this Regulation. All the elements, requirements and provisions
manufacturer must be documented in a systematic and orderly
in the form of written policies, procedures and instructions.
Documentation of quality assurance must permit uniform interpretation of the procedural and
quality assurance, such as quality programs, plans, manuals and
records.

It must include in particular an adequate description

2.2.1 quality objectives, the organizational structure, responsibilities and powers
leadership in terms of design and quality of the machinery,

2.2.2 technical design specifications, including standards that will be used
, and if they are not fully implemented the standards set out in § 3 para. 3,
means that will be used to ensure that the essential requirements
health and safety referred to in this Regulation

2.2.3 design control and design verification techniques, processes and systematic
measures that will be used when designing machinery covered
this Regulation applies,

2.2.4 appropriate methods, processes and systematic actions that will be used
manufacturing, quality control and quality assurance

2.2.5 checks and tests that will be carried out before, during
and after manufacture, and their frequency,

2.2.6 quality records, such as inspection reports, test results
data, calibration data, reports on the qualifications of the personnel concerned,

2.2.7 means of monitoring the achievement of the required design and quality
machinery and the effective operation of the quality assurance system
.

2.3 The body shall assess the quality assurance system in order
determine whether it satisfies the requirements of point 2.2.

The elements of the quality assurance system that correspond
harmonized standard shall be presumed to comply with the relevant requirements
according to section 2.2.

The auditing team must have at least one member with experience of assessing the
machinery. The assessment procedure must be
visit to the manufacturer's premises. During the tour
group auditors examine the technical documentation described in paragraph 2.1.3
to ensure that it meets the appropriate requirements to protect the health and safety
.


Decision notified body that has approved the quality assurance system
must be notified to the manufacturer or his authorized representative.
The notice must contain a summary of the assessment and a reasoned assessment
. Must be a procedure for appeal.

2.4 The manufacturer shall undertake to fulfill the obligations arising from
approved quality assurance system and ensure that even
remains adequate and efficient.

Manufacturer or his authorized representative shall inform the body which approved
quality assurance system informed of any intended change

Body shall examine the proposed changes and decide whether the modified
quality assurance system will still satisfy the requirements referred
2.2, or whether it requires reassessment.

Notified Body shall notify the manufacturer of its decision.
Notice must contain a summary of the examination and the reasoned assessment decision.

Third Surveillance under the responsibility of the Notified Body

3.1 The purpose of surveillance is to ensure that the manufacturer duly fulfills the obligations
arising from the approved quality assurance system.

3.2 The manufacturer shall authorize the body to oversee the entry into
the design, manufacture, inspection, testing and
storage and provide it with all necessary information, including:

3.2.1 quality assurance system documentation,

3.2.2 quality records required under the quality assurance system
relating to design, such as results of analyzes, calculations, tests
etc.,

3.2.3 quality records required under the quality assurance system
relating to production, such as inspection reports and results
testing, calibration data, reports on the qualifications of the personnel
etc.

3.3 Notified body carries out periodic audits to make sure that
manufacturer maintains and applies the quality assurance system, and transmits
manufacturer with audit reports. The frequency of periodic audits must be such that
every three years full reassessment is carried.

3.4 In addition, the body may pay the manufacturer unannounced visits
. The need for these additional visits and their frequency will be determined on the basis
system of visits undertaken for the purposes of supervision
NB. The system of visits to take into account the following factors

3.4.1 results of previous visits

3.4.2 need to monitor remedial measures,

3.4.3 any special conditions for approval of the system,

3.4.4 substantial changes to the organization of the manufacturing process, measures or procedures

During these visits, the body may, if necessary, carry
or have carried out tests to verify that the quality assurance system
working properly. The notified body must provide the manufacturer
report on the visit and, if a test, a test report.

Fourth The manufacturer or his authorized representative must, for
national authorities for a period of ten years from the last date of manufacture of machinery

Conditions of the authorization

First Authorized person, its director and the staff responsible for checking
not be the designer, manufacturer, supplier or installer of
machinery, nor the authorized representative of any of these people

in the design, manufacture, marketing or maintenance of machinery

which is authorized to employ staff with technical
knowledge and sufficient and appropriate experience to perform

Conformity assessment. It must have the means to properly
perform the technical and administrative tasks connected with verification;
also must have access to the equipment required for special verification.

Fourth Staff responsible for the verification must be

4.1 appropriate technical and vocational training,

4.2 knowledge of the requirements of the tests and adequate experience of such tests
,
4.3
ability to draw up certificates, records and reports required to authenticate the performance
tests.

Fifth It must be guaranteed impartiality of the verification.
Their remuneration must not depend on the number of tests carried out or on the results of these tests
.

6th Authorized persons to participate in coordination activities.
Also participate in European standardization, or be represented or
ensure that they know the situation of relevant standards.
