DECREE



of 17 May. December 2012



on the implementation of certain provisions of the law on social and legal protection of children



The Ministry of labour and Social Affairs provides under section 58b of the paragraph. 2 and 3

Act No. 359/1999 Coll. on social and legal protection of children, as amended by law

No. 401/2012 Coll. (hereinafter the "Act"):



§ 1



The focus and scope of the evaluation of the situation of the child and his family



Evaluation of the child's situation and his family is based on the individual

access to the child and is carried out on the basis of



and evaluation of the situation of the child), which includes



1. measure the threat to the rights and interests of the child,



2. the definition of the social, health and other risks to which the child is

granted, the



3. assessment of the level of physical and mental development of the child with regard to the

the age of the child,



4. assessment of the progress of a child's education and prerequisites for further

education,



5. identification and assessment of individual needs and interests of the child,



6. the definition of the characteristics and determine the ability of the child, or

prerequisites for obtaining,



7. the findings and taking into account the opinion and wishes of the child, having regard to the age of the child

and his intellectual maturity,



8. other information necessary for the evaluation of the situation of the child in a particular

the case,



(b) the situation of the family, evaluator) which includes



1. analysis of the situation of the family and family environment,



2. analysis of the causes of the crisis in the family,



3. assessment of the relationship of parent and child,



4. determine the needs of the family,



5. determine the capabilities of the family relationship, economic and

social,



6. determine the educational competencies and prerequisites of the parents to child care and

evaluation of the potential risks in the upbringing of the child,



7. assessment of the physical and financial conditions of life of the family,



8. other information necessary for the evaluation of the situation of the family in a particular

the case,



(c) evaluation of the wider family environment), which includes



1. specify the options in the extended family, including relational, economic and

social opportunities and their usefulness for the family,



2. specify options in the wider social environment of the family, including

the availability and quality of social, health, educational-training and

community service and the safety of the site,



3. the additional information necessary for the evaluation of the wider family environment in

a specific case.



§ 2



The contents of the individual child's protection plan



(1) the individual child protection plan contains



and a description of the causes of the risk of the child) and the reasons for the initiation of the socio-legal

protection,



(b)) the objectives of the proposed action, means to achieve them, and indicators

the effectiveness of individual measures,



(c) the proposed measures required range) to the protection of the child and provided

to help parents or other persons responsible for the child's upbringing,



(d)) the way of the proposed measures, the fulfilment of the rights and interests of the child to the extent

social and legal protection,



e) methods of work with the family and the scale of intervention and help parents or

other persons responsible for the child's upbringing in the care of the child and its

education, which include



1. strengthening the role and function of the family,



2. the development of care and educational capabilities of the family,



3. support social inclusion, family



4. providing assistance to children placed in foster care and their families,

the provision of assistance to persons in the caretakers and register



5. strengthening competencies in the field of family education, training on

teaching and learning motivation



(f) the cooperation procedure) authority of the social and legal protection with the other institutions

public authorities and other natural persons and legal entities

involved in dealing with the situation of the child,

§ 3



The content and scope of training of individuals eligible to become

adoptive parent or foster parent of the child for adoption to a family



(1) preparation of individuals suitable to become an adoptive parent or foster parent

to the adoption of a child in a family contains the following thematic areas:

foster parent, of their family system and social contacts,



(b)) and the fulfilment of the rights and the knowledge of the needs of the child in foster care,

§ 4

§ 5

§ 6



Standards of quality social and legal protection
