on batteries and accumulators and amending Decree No. 383/2001 Coll.

Ministry of the environment shall establish under Section 31b para. 4, § 31 c

paragraph. 2, § 31e, para. 11, § paragraph 31f. 2, section 31 g para. 1 (b). (c)), section 31 h

paragraph. 4, § 31 para. 5 and section 31n para. 8 of the law No. 185/2001 Coll.

waste and amending certain other acts, as amended by Act No.

188/2004 Coll., Act No. 314/2006 Coll. and Act No. 297/2009 Coll. (hereinafter referred to

"the Act"):



PART THE FIRST



§ 1



The subject of the edit

§ 2



The mode of proof of compliance with the conditions laid down for the placing of batteries

or batteries on the market or into circulation, to the Customs Office



The person who imports the batteries or accumulators, proves to the Customs Office

compliance with the conditions for the placing on the market of batteries or accumulators or to

circulation by producing technical documentation.



§ 3



The details of the labelling of batteries or accumulators



(1) the batteries, accumulators and battery packs for the purpose of collecting and

separate collection indicate a graphic symbol referred to in annex No. 1.

(2) a graphic symbol referred to in paragraph 1 must occupy at least 3% of the area

the largest side of the battery, accumulator or battery pack, up to

area of 5 x 5 cm, and in the case of cylindrical cells of at least 1.5% of the total

of the battery or accumulator and a maximum area of 5 x 5 cm.



(3) the batteries, accumulators and battery packs need not be labelled in accordance with

paragraphs 1 and 2, if the size of the graphic symbol would be smaller than 0.5

× 0.5 cm; in this case, must be marked by a graphic symbol

paragraph 1, measuring at least 1 × 1 cm of their sales packaging ^ 2), and in

batteries or accumulators incorporated into the electrical equipment or

the attached sales packaging ^ 2) of electrical and electronic equipment.



(4) the presence of heavy metals in batteries, accumulators and button

§ 4

The content and scope of the annual report on batteries and accumulators

are listed in the model, the annual reports on implementation of take-back obligations

and separate collection of batteries and accumulators, which is given in annex No.

3 of this order.



§ 6



Technical requirements the take-back of used car

batteries or accumulators



Instead of the take-back of used automotive batteries or accumulators

must at least be covered and must be impermeable surface that is

resistant to the electrolyte, or must be equipped with containers

§ 7

§ 8



(1) Producers fulfilling the duties according to § 31 para. 1 (b). and) or (b))

the law shall provide a guarantee in accordance with section 31 g para. 1 (b). (c)) of the Act so that the

§ 9

PART TWO



§ 10



Transitional provisions



(1) Producers who were included on a list of producers before the date of the acquisition of

the effectiveness of this Ordinance, shall process the annual report on batteries and

accumulators for the period from the beginning of 2010 until the date of entry into force of

(2) Producers who were included on a list of producers before the date of the acquisition of

the effectiveness of this order, insert under section 8 (2). 1 of this order on the

the effective date of this order until the end of the calendar year, and

Amendment of the Decree on the details of the management of waste



In the Decree No. 383/2001 Coll., on details of the management of waste, in

amended by Decree No. 41/2005 Coll., section 16, including a title and notes
