on the evaluation of the hazardous properties of the waste

Ministry of environment and the Ministry of health shall
pursuant to § 7 para. 10 and § 9 para. 6 of Act No. 185/2001 Coll., on waste and on the
amendments to certain other laws, (hereinafter referred to as the "Act"):
§ 1
The subject of the edit
This Decree lays down the content of the request for grant credentials to the reviews
the hazardous properties of the waste and the content of the proposal on the extension of the

§ 2

§ 3
Training content for the evaluation of the hazardous properties of waste
Training content for the evaluation of the hazardous properties of waste are:

§ 4
Hazardous properties of the waste and the methods of evaluation of the hazardous properties

§ 5
Collection of samples for the purpose of evaluating the hazardous properties of the waste

§ 6
The evaluation procedure of the hazardous properties of the waste
(1) the evaluation of the hazardous properties of the waste is carried out by comparing the

in accordance with paragraph 2, shall be carried out by comparing the values of indicators of dangerous
the properties listed in annex No. 1 with the results of the tests carried out
procedures according to the methods set out in annex 3.
(4) if the evaluation of the hazardous properties of waste listed in annex
2 to the law under the designation codes H4 to H8, H10 and H11 cannot be performed
in accordance with paragraph 2, shall be carried out on the basis of the content of chemical substances in the
waste contained according to the criteria listed in annex 2. Chemical

§ 7
The contents of the application for the evaluation of the hazardous properties of the waste

§ 8
The issuance and content of the certificate

§ 9

The hazardous properties of the waste definition and evaluation criteria
the hazardous properties of the waste
Waste shall be assessed as dangerous waste, if it is exceeded at least
one of the following criteria for the hazardous characteristics
waste:
H1
Explosive properties
This property should waste which can explode by external
thermal stimuli or are sensitive to impact or friction, or
they can cause reactions detonativního character or after the
ignition takes place fast explosive combustion.
As hazardous waste with the hazardous properties of the explosive shall be assessed

H2

Irritation

Toxicity

or skin penetration can lead to serious, acute or chronic

H7
Carcinogenicity
This property have wastes which contain carcinogenic substances or
preparations and can after inhalation, ingestion, or skin penetration lead to
cancer or increase the frequency of the occurrence of cancer.
H8
Skin corrosion
This property have wastes which contain corrosive substances or preparations
and may, in short, prolonged or repeated contact with the skin or
mucous membrane, cause its damage.
H9
Infectivity
As hazardous waste with the hazardous properties of the infectivity is assessed
wastes that contain viable micro-organisms or their toxins
and other infectious agents, with sufficient virulence in concentration or
the quantities of which are known or reliably assumed to cause
diseases of humans or other living organisms.
H10
Teratogenicity (toxicity for reproduction)
This property have wastes which contain teratogenic substances or
(toxic to reproduction), which can after inhalation, ingestion
or skin penetration, cause or increase the incidence of, non-heritable
congenital malformations or functional damage.
H11
Germ cell mutagenicity
This property have wastes which contain mutagenic substances or
preparations and can after inhalation, ingestion, or skin penetration to invoke
the creation or increase the likelihood of the occurrence of the hereditary genetic defects.
H12
The ability to give off very toxic or toxic gases in contact with water
or acids
This property have a waste that release in contact with water, air
or with acids or with air more than 1 l/h 1.kg-1 high
toxic or toxic gas.
H13
The capacity to release into the environment of hazardous substances at or after
their removal

-at least one substance classified as toxic for reproduction
category 3 with sentences R62 or R63 at a concentration of > = 5% of the total

-at least one substance classified as mutagenic category 1 or 2

-at least one of the substances classified as mutagenic category 3 with the sentence
R40 at a concentration of > = 1% of total waste (H11).

Methods of evaluation of the hazardous properties of the waste
1.
For the evaluation of dangerous properties of H1 explosive shall be used:

flammable materials, and for organic peroxides with a risk of detonation

For the evaluation of dangerous properties of H2 oxidizing ability, H3-and high
H3-B flammability and flammability shall apply the methods specified for testing
oxidizing ability and combustibility of chemical substances and preparations referred to
in the specific legislation. ^ 8)

In the evaluation of the hazardous properties of the H4 to H8, H10 and H11, proceed
in the following way: chemicals that rated the waste contains,
shall be classified under special legislation. ^ 2) classification

(i.e. percentage by weight) of the chemical substances in the waste.

Evaluation of the dangerous properties of the infectivity is based on the professional judgement of the
technology, a description of the waste and the possible content of the infectious agent in the

micro-organisms into classes of pathogenicity. Microbiological analyses of waste can
