GOVERNMENT REGULATION
of 18 May. may 2016,
amending Government Decree No. 478/2009 Coll. laying down certain
conditions for the grant of aid for fruit and vegetables and products processed from fruit,
vegetables and bananas to children in educational establishments, as amended by regulation
No 157/2014 Sb.
The Government ordered pursuant to section 2b, paragraph 1. 2 Act No. 252/1997 Coll.
Agriculture, as amended by Act No. 128/2003 Coll., Act No. 441/2005 Coll.
Act No. 291/2009 Coll., and pursuant to section 1 (1). 3 of Act No. 256/2000 Coll.
The State agricultural intervention fund and amending certain other
laws (the law on the State agricultural intervention fund), as amended by
Act No. 441/2005 Coll., Act No. 291/2009 Coll. and Act No. 179/2014
Coll.:
Article. (I)
Government Regulation No. 478/2009 Coll. laying down certain conditions for the
providing support for the fruit and vegetables and products made from fruits, vegetables and
bananas for children in educational establishments, as amended by Decree-Law No.
157/2014 Coll., is amended as follows:
1. In paragraph 1, the words "(hereinafter referred to as" support ") ' shall be deleted and the words" including children from
preparatory classes of primary schools ^ 3) (hereinafter referred to as the "first degree") "
replaced by the words "and children in preparatory classes in primary schools or in
the preparatory stage of primary education specialty ^ 3) (hereinafter referred to as "the first

3. In article 2 (2). 1 (b). and) the words "part IX" shall be replaced by ' sections
IX and XI ".
4. In article 2 (2). 1 (b). (b)) after the word "juice" is inserted after the word "salads".
5. In section 2, paragraph 1, the following paragraph 2 is added:
"(2) the amount of aid that could be granted on 1 piece of fruit and vegetable
corresponding to the number of pieces of fruit or vegetables with a total minimum
weight 100 g pack fruit puree or a salad with a minimum
weight 100 g or packing of fruit or vegetable juices with a minimum
volume 200 ml (hereinafter referred to as "portions"), may not exceed the amount referred to in
the annex to this regulation. ".
Paragraphs 2 to 5 shall become paragraphs 3 to 6.
6. In article 2 (2). 3 and 5, after the word "Share" is inserted after the word "portions" and the words
"the number of products" shall be replaced by the words "the number of servings".
7. In article 2 (2). 4, after the word "juice" is inserted after the word "salad".
8. In article 2 (2). 6 (b)):
"(b)) training and educational materials about products marketed in
the framework of the project "fruit and vegetables to schools" about healthy eating
habits and on the protection of the environment relating to the production,
the distribution and consumption of fruits and vegetables, with the exception of the establishment and operation of the
Internet presentations, ".
9. in section 2 (2). 6 at the end of subparagraph (d)) the following the word "or".
10. In section 2 (2). 6, point e) repealed.
Subparagraph (f)) is renumbered as paragraph (e)).
11. Footnote 17 reads:
"17) Article. 4 (4). 1 (b). (b)) point iii) and article. 4 (4). 5 of the Regulation Commission
delegated Regulation (EU) no 2016/247. ".
12. In the heading of section 3, the words "for the supply of products" shall be replaced by
"the applicant for support".
13. in section 3, paragraph 1 reads:
"(1) an application for the approval of the applicant for aid (hereinafter referred to as" request
the approval ") may submit a person
directly supplying a) products referred to in article. 5 (3). 2 (a). c) of Commission
delegated Regulation (EU) no 2016/247, or
b) controls the distribution of the products referred to in article. 5 (3). 2 (a). e) Regulation

14. in section 3, paragraph 3, including footnote No. 6 reads as follows:

15. in section 3, paragraph 4 is added:

16. in section 3, paragraph 3. 5, the words "for the supply of products" shall be replaced by
"as an applicant for support".
17. in section 3, paragraph 3. 6, after the words "which has" is inserted after "approved".
18. in section 3, paragraph 3. 7, the words "(article. 5 (3). 1 of Commission Regulation (EC) No.
288/2009) "shall be replaced by the words" pursuant to article. 4 (4). 1 Commission Regulation in the
delegated Regulation (EU) no 2016/247 ".
19. in paragraph 3, at the end of paragraph 8, the following sentence "of non-

23. in section 4, paragraph 3, the following paragraph 4 is added:

"approved".

27. in paragraph 4, the following paragraph 6 is added:

29. in section 4A(1). 1 introductory part of the provisions, the words "measures"
inserted the word "past".
30. Under section 4A(1). 2 (a). (b)), the words "a copy of the invoice with the description

Article II
Transitional provisions
1. The application for approval of an applicant for support for the school year 2016/2017 by
section 3 of the regulation of the Government No. 478/2009 Coll., in the version in force from the date of acquisition
the effectiveness of this regulation, transmit to the applicant the national agricultural
intervention fund to 15. June 2016.
2. The application for the grant of aid to products for the school year 2015/2016
is it Government Regulation No. 478/2009 Coll., in the version in force before the date of
entry into force of this regulation.
3. The application for the grant of aid for accompanying measures for school
the year 2015/2016 be used Government Regulation No. 478/2009 Coll., as amended by
effective before the date of entry into force of this regulation.
Article. (III)
The effectiveness of the
This Regulation shall enter into force on 1 January 2000. June 2016, with the exception of
the provisions of article. I, points 5, 6, 8, 9, 10, 21, 23, 24, 25, 26, 27, 30 and 32,
that will become effective on 1 January 2004. September 2016.
